Dear Lauren:
I have enclosed a certified copy of the Declaration I had recorded in the
Office of the Suffolk County Clerk in satisfaction of the condition to your April 21, 2004
approval ofthe referenced permit modification. The Declaration was recorded on May20,
2005 in Liber 12388 page 213.
As anticipated in my letter of December 10, 2004, the Declaration was signed
by the new owners, Jonathan and Madora Kibbe, who acquired the subject property from
Frances E. Nielsen in whose name the original application was made. As requested by
the Town Attorney, the second sentence of Paragraph 2 was deleted and the words "plus
one" were added after the word "majority" in Paragraph 3.

DECLARATION
DECLARATION, made the ~-t~ day of May, 2005, by JONATHAN KIBBE
and MADORA KIBBE, 49 Oriole Avenue, Bronxville, New York 10708, hereinafter referred
to as the Declarants.
WHEREAS, the Declarants are the owners of certain real property situate at
Fishers Island, Town of Southold, Suffolk County, New York, said real property being more
particularly described on Schedule A hereto (the "Real Property"); and
WHEREAS, the former owner of the Real Property, Frances E. Nielsen, has
made application to the Board of Trustees of the Town of Southold for an amended permit
pursuant to the Wetlands Law of the Town of Southold for construction of a screened
porch, deck and boulder wall at the Real Property; and
WHEREAS, the Real Property contains freshwater wetlands, said wetlands
having been flagged and located on the Site Plan prepared by CME/CPK Design Group
dated December 15, 2001, revised June 24, 2004, July 15, 2002 and May 4, 2004; and
WHEREAS, in consideration of the granting of such amended wetlands
permit, the Board of Trustees of the Town of Southold and the Declarants have deemed
it to be in the best interests of the Town of Southold and the owners and prospective
owners of the Real Property that within the covenants and restrictions be imposed on the
Real Property, and as a condition of said approval, the Board of Trustees of the Town of
Southold has required that the within Declaration be recorded in the Office of the Suffolk
County Clerk; and
WHEREAS, the Declarants have considered the foregoing and determined
that the same will be for the best interests of the Declarants and subsequent owners of the
Real Property;
NOW, THEREFORE, THIS DECLARATION WlTNESSETH:
That the Declarants, for the purpose of carrying out the intentions above
expressed, do hereby make known, admit, publish, covenant and agree that the said Real
Property described on Schedule A shall hereinafter be subject to the following covenants
which shall run with the land and shall be binding upon all purchasers of said premises,
their heirs, executors, legal representatives, distributees, successors and assigns, to wit:
1. There shall be maintained on the Real Property a conservation buffer
over the area described on Schedule B (the "Buffer Area"). The following shall be adhered
to in the Buffer Area:
A. No top soil, loam, sand, gravel, rock or minerals shall be excavated
or removed therefrom.
B. No streets, roadways, or other rights ofway or easements for vehicular
use shall be constructed or granted therein.
C. No liquid or sewage waste or other objectionable or offensive material
or refuse shall be permitted to be discharged into the Buffer Area nor shall any portion
thereof be used as a leechin9 field for sewage disposal or for the placement, construction
or maintenance of individual or shared septic systems.
D. No dumping, placement, storage or burning of any liquid or solid
waste, garbage, ashes, sawdust, trash, rubbish, refuse or other objectionable, unsightly
or offensive materials shall be undertaken in the Buffer Area.

E. The Buffer Area will forever be kept open and free of all buildings and
other structures, including but not limited to walls, fences and berms.
2. Notwithstanding anything to the contrary contained herein, nothing
shall preclude the Declarants or their successors or assigns from maintaining the Buffer
Area so long as the Buffer Area remains in a natural state, subject to the required
approvals, if any, of the Board of Trustees of the Town of Southold and any other
governmental agencies with jurisdiction.
3. The covenants and restrictions set forth in this Declaration may not
be changed except by a vote of a majority plus one of the Board of Trustees of the Town
of Southold, or any successor Town Board, or anyone having jurisdiction over wetlands
regulated by the Town of Southold.

Please transfer the referenced permit which was issued in the name of
Frances E. Nielsen to the new owners of the subject property, Jonathan Kibbe and Madora
Kibbe.
I recently caused a Declaration signed by the new owners to be filed in the
Office of the Suffolk County Clerk. A certified copy of that Declaration, which provided for
a non-disturbance area on the subject property in accordance with the condition to the
permit modification you granted in April 2004, was forwarded to you under cover of my
letter of May 24, 2005.
At the time you approve the transfer to the Kibbes, I would appreciate it if you
would extend the expiration date of the amended permit, if necessary, so that it does not
expire prior to the end of this year.

Dear Mr. Just:
The following action was taken by the Board of Town Trustees
during a regular Meeting, held on May 24,2000, regarding the
above matter.
WHEREAS, FRANCES E. NIELSEN, applied to the Southold Town
Trustees for a permit under the provisions of the Wetland
Ordinance of the Town of Southold, application dated December
16, 1999 and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on May 24, 2000, at which time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 97-18 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approves the application of
FRANCES E. NIELSEN to construct a deck, patio, retaining wall,
pool equipment shed, backwash, leaching pool and regrade area of
pool. Survey being redone based upon that the pool being moved
out of our jurisdiction.
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct and complete project will expire two years
from the date it is signed. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trust~es are to be notified
upon completion of said project.

WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on May 24, 2000, at which time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 97-18 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approves the application of
FRANCES E. NIELSEN to construct a deck, patio, retaining wall,
pool equipment shed, backwash, leaching pool and regrade area of
pool. Survey being redone based upon that the pool being moved
out of our jurisdiction.
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct and complete project will expire two years
from the date it is signed. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.
