PAGLIARULO East End Rd., Fishers Island SCTM#3-3-7 Dear Mr. Just: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, August 29, 2001 regarding the above matter: WHEREAS, JOSEPH B. PAGLIARULO applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated July 11, 2001, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on August 29, 2001, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 97 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, 2 NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees ap~)rove the application of JOSEPH M. PAGLIARULO to install a 4'X 130' seasonal dock, 4'X 16' ramp and 6'X 20' float to be secured by two 6" piles, with the condition that the dock is taken out no later than November 15, and put in no earlier than March 31 of each year. BE IT FURTHER RESOLVED that this determination should not be considered a determination made for any other Department or Agency, which may also have an application pending for the same or similar project. Permit to construct and complete project will expire two years from the date it is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. WATERWAY: Fishers Island Sound, Long Island Sound LOCATION: Fishers Island, Town of Southold, Suffolk County, New York. A detailed description and plans of the applicant's activity are enclosed to assist in your review. The decision whether to issue a permit will be based on an evaluation of the probable impact, including cumulative impacts, of the proposed activity on the public interest. That decision will reflect the national concern for both protection and utilization of important resources. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. All factors which may be relevant to the proposal will be considered including the cumulative effects thereof; among those are conservation, economics, aesthetics, general environmental concerns, wetlands, historical properties, fish and wildlife values, floodplain values, land use, navigation, shoreline erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, consideration of property ownership and,in general the needs and welfare of the people. The Corps of Engineers is soliciting comments from the public; Federal, state, and local agencies and officials; Indian Tribes; and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects, and the other public interest factors listed above. Comments are used in preparation of an Environmental Assessment and/or an Environmental Impact Statement pursuant to the National Environmental Policy Act. Comments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity. ALL COMMENTS REGARDING THE PERMIT APPLICATION MUST BE PREPARED IN WRITING AND MAILED TO REACH THIS OFFICE BEFORE THE EXPIRATION DATE OF THIS NOTICE, otherwise, it will be presumed that there are no objections to the activity. Any person may request, in writing, before this public notice expires, that a public hearing be held to collect information necessary to consider this application. Requests for public hearings shall state, with particularity, the reasons why a public hearing should be held. Our preliminary determination is that the activity for which authorization is sought herein is not likely to affect any Federally endangered or threatened species or their critical habitat. However, pursuant to Section 7 of the Endangered Species Act (16 U.S.C. 1531), the District Engineer is consulting with the appropriate Federal agency to determine the presence of and potential impacts to listed species in the project area or their critical habitat. Based upon a review of the latest published version of the National Register of Historic Places, there are no known sites eligible for, or included in, the Register within the permit area. Presently unknown archeological, scientific, prehistorical, or historical data may be lost by work accomplished under the required permit. Pursuant to Section 307 (c) of the Coastal Zone Management Act of 1972 as amended [16 U.S.C. 1456 (c)], for activities under consideration that are located within the coastal zone of a state which has a federally approved coastal zone management program, the applicant has certified in the permit application that the activity complies with, and will be conducted in a manner that is consistent with, the approved state coastal zone management program. By this public notice, we are requesting the state's concurrence with, objection to, or waiver of the applicant's certification. No permit decision will be made until one of these actiom occur. Pagliarulo 16 8arringer Ro~d Darien, CT 06820 Activity: Pier Assembly Waterway: Fishers Island Sound, Long Island Sound Location: Fishers Island, Town of 5outhold, Suffolk County, Mew York The following comments ore in response to the above applicant's proposed Pier Assembly in a port of Chocomount Cove, Fishers Island, New York. ]: am representing Mo~jeret W. 5pofford, o long time home and property owner on the Cove who feels that the construction of o 168 foot Pier anywhere in Chocomount Cove would be detrimental to the Chocomount Cove is a relatively small body of water located on the northern side of Fishers ]:sland. The porticular section of the Cove that the applicant has applied to build on, is the most scenic, protected and therefore most habitable for all forms of bird, animal and plant life. This portion also contains a strip of sandy beach which provides for recreationol swimming by the homeowners in the Cove. This part of the Cove is 50 % sand beach with the other half consisting of marsh grasses, recks, kelp seaweed and other typical saltwater growth. [t is home to o wide variety of shore birds as well as providing the right environment for shellfish, crab, mussel, and a variety of smaller foodfish. Numerous land birds and animals also thrive in the area due to its noturol vegetation and to 2 freshwater springs which are located on or very close to applicant's proposed pier site. These springs are unique to this area of the island and provide an unknown amount of ecological balance to the cove. Additionolly, from an historical and archeological view, significant evidence has shown Indian remains from either a settling or burial grounds, or both, in the vicinity of the Z freshwater springs. Research by $ohn Pfeiffer and Dr. Funk has been done on these Indian habitats and published under the title '2 Springs." The construction of a 168 foot pier into the Cove would upset the balance of all the forms of life that exist there. The pier would cut across the Cove at such an angle to rn~ke access to the beach almost impassible or at the least navigationally dangerous. It would also upset the tranquil nature that exists there now. Aesthetically, there is very little that can be said of the proposed pier. The following excerpts are cited os they relate to the considerations surrounding this project. There mc~/be others applicable but this propased action appears clearly inconsistent with these I~lYState policies. The Long ]~sland Sound Study by the EPA, presents the problems relating to Living Resources and Habitat Management os follows: "The coc~tal environs of Long ]~sland Sound represent a unique and highly Productive ecosystem with a diverse or~/of living resources, ranging from Microscopic plants and animals that drift with the currents to seaweeds and Economically important finfish, shellfish and crustaceans.]~n addition, many Other types of wildlife, such os birds, sea turtles, end marine mammals, spend All or part of their lives in the Sound, on its shores, or in its watershed. ' 'A principal human cause of harm to the Sound's living resources is water pollution, [as well as ] .,.destruction end degrodstion of habitat." ' Approximately 25-30 percent of the Souncrs tidal wetlands have been destroyed during the last century by filling, dredging and development." New York State's Coastal N~nagemant Program Policies raise concerns in similar fashion: ' Significant coastal fish and wildlife habitats will be protected, preserved, and where practical, restored sa as to maintain their viability os habitats." · ]~n order the protect and preserve a significant habitat, land and water uses or development shall not be undertaken if such actions destroy or significantly impair the viability of an area as a habitat. ' 'broining...Filling,..Groding...Physical alteration of shore areas through channelization or construction of shore structure.....$uch action therefore would be inconsistent with the above policy...' [ Extracted from Policy 7] This attitude is also expressed in Policy 44: · Preserve and protect tidal and freshwater wetlands and preserve the benefits derived from these areas." In Summary: The con. ruction of a fixed pier ~il'h romp and float of 168 f~t in tota~ ~engt'h into the sm~H confines of Chocamount Cove for the ~<pre~sed purpose of ' Private Recreotiono~ Docking ' does not serve the n~eds nor the welfare of the people. In addition to the environmental concerns outlined above, safety ,navigational and water pollution issues must be considered also. Although in o somewhat sheltered area, Chocomount Cove is still subject to the furies of the typical New England, Long Island 5ound weather I~tterns. The breakup of some or all of that pier structure could cause damages and losses to both life end property in the area. The pier would also be a hazard to navigation in the cove, where pleasure sailing boots often moor overnight amongst the local commercial lobster pots. The presence of a large 168 foot pier and concomitant power boat[s] with the usual or unusual discharges of oils and gas etc., has the potential of upsetting a presently well-balanced ecosystem and as such does nat serve the total living population of tiny Chocomount Cove.
