Dear Mr. Just:
The Southold Town Board of Trustees reviewed the site plan prepared by Chandler,
Palmer & King last revised June 18,2003 and determined the construction of a covered
porch onto the proposed single-family dwelling to be out of the Wetland jurisdiction
under Chapter 97 of the Town Wetland Code and Chapter 37 of the Town Code.
Therefore, in accordance with the current Tidal Wetlands Code (Chapter 97) and the
Coastal Erosion Hazard Area (Chapter 37) no permit is required. Please be advised,
however, that no construction, sedimentation, or disturbance of any kind may take place
seaward of the tidal wetlands jurisdictional boundary or seaward of the coastal erosion
hazard area as indicated above, without a permit. It is your responsibility to ensure that
all necessary precautions are taken to prevent any sedimentation or other alteration or
disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and
Coastal Erosion Hazard Area, which may result from your project. Such precautions
may include maintaining adequate work area between the tidal wetland jurisdictional
boundary and the coastal erosion hazard area and your project or erecting a temporary
fence, barrier, or hay bale berm.
However, any activity within 100' of a Wetland line or seaward of the Coastal Erosion
Hazard Area would require permits from this office.
This determination is not a determination from any other agency.

Dear Mr. Just:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, August 21, 2002 regarding the above matter:
WHEREAS, J.M.O. Environmental Consulting on behalf of JOSEPH A. KADDIS, JR. applied
to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the
ToviIl of Southold, application dated July 2, 2002, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
August 21, 2002, at which time all interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 of the Southold
Town Code,

WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of JOSEPH A. KADDIS, JR.
to construct a single-family dwelling, associated sanitary system, waterline, underground
utilities, deck, covered porch, garage and patio, with the condition that gutters and drywells are
installed to contain the roof run-off and hay bales are placed down along the 75' non-disturbance
buffer, all as depicted on the site plan dated June 24, 2002.
BE IT FURTHER RESOLVED that this determination should not be considered a determination
made for any other Department or Agency, which may also have an application pending for the
same or similar project.
Permit to construct and complete project will expire two years from the date it is signed. Fees
must be paid, if applicable, and permit issued within six months of the date of this notification.
Inspections are required at a fee of$5.00 per inspection. (See attached schedule.)

At the meeting of the South old Town ConserVation Advisory Council held Wednesday,
July 17, 2002, the following recommendation was made:

system, watertine, underground utilities, deck, covered porch, garage and patio. All
structures shall be located +/-103'landward of the tid,,1 wetlands boundary with a staked
line of hay bales installed +/-75' from the wetlands.

The CAC did not make an inspection, therefore no recommendation was made.

At the present time we are seeking to modity the above noted permit. The requested
modification is to allow for the construction of the dwelling, porch and decking in a
different configuration than originally approved. It should also be noted on the enclosed
plans prepared by Chandler, Palmer & King (6/18/03) that all construction activity shall
be located approximately lOr landward of the existing Tidal Wetlands Line.

A detailed description and plans of the applicant's activity are enclosed to assist in your review.
The decision whether to issue a permit will be based on an evaluation of the probable impact, including
cumulative impacts, of the proposed activity on the public interest. That decision will reflect the national concern
for both protection and utilization of important resources. The benefits which reasonably may be expected to
accrue from the proposal must be balanced against its reasonably foreseeable detriments. All factors which may
be relevant to the proposal will be considered including the cumulative effects thereof; among those are
conservation, economics, aesthetics, general environmental concerns, wetlands, historical properties, fish and
wildlife values, floodplain values, land use, navigation, shoreline erosion and accretion, recreation, water supply
and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, consideration
of property ownership and,in general the needs and welfare of the people.
The Corps of Engineers is soliciting comments from the public; Federal, state, and local agencies and officials;
Indian Tribes; and other interested parties in order to consider and evaluate the impacts of this proposed activity.
Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify,
condition or deny a permit for this proposal. To make this decision, corrunents are used to assess impacts on
endangered species, historic properties, water quality, general environmental effects, and the other public interest
factors listed above. Comments are used in preparation of an Environmental Assessment and/or an Environmental
ln1pact Statement pursuant to the National Environmental Policy Act. Comments are also used to determine the
need for a public hearing and to determine the overall public interest of the proposed activity.
ALL COMMENTS REGARDING THE PERMIT APPLICATION MUST BE PREPARED IN WRITING AND
MAILED TO REACH THIS OFFICE BEFORE THE EXPIRATION DATE OF THIS NOTICE, otherwise, it
will be presumed that there are no objections to the activity.
Any person may request, in writing, before this public notice expires, that a public hearing be held to collect
information necessary to consider this application. Requests for public hearings shall state, with particularity,
the. reasons why a public hearing should be held. It should be noted that information submitted by mail is
considered just as carefully in the permit decision process and bears the same weight as that furnished at a public
hearing.

Our preliminary determination is that the activity for which authorization is sought herein is not likely to affect
any Federally endangered or threatened species or their critical habitat. However, pursuant to Section 7 of the
Endangered Species Act (16 U .S.C. 1531), the District Engineer is consulting with the appropriate Federal agency
to determine the presence of and potential impacts to listed species in the project area or their critical habitat.
The Magnuson-Stevens Fishery Conservation and Management Act, as amended by the Sustainable Fisheries Act
of 1996 (Public Law 104-267), requires all federal agencies to consult with National Marine Fisheries Service
(NMFS) on all actions, or proposed actions, permitted, funded, or undertaken by the agency, that may adversely
affect Essential Fish Habitat (EFH). A complete description of the project is given in the attached Work
Description. The District Engineer has made the preliminary determination that the site-specific effects are not
likely to be substantial: Further ~onsultation with NMFS regarding EFH impacts and conservation
recol11IJ1eadllt.iQ.!ls is being conducted and will be concluded prior to the final decision.
Based upon a review of the lat~tÍ published version of the National Register of Historic Places, there are no
known sites eligible for, or includi!d in, the Register within the permit area. Presently unknown archeological,
scientific, prehistorical, or historical djlta may be lost by work accomplished under the required permit.
Pursuant to Section 307 (c) of the Coastal Zone Management Act of 1972 as amended [16 U.S.C. 1456 (c)], for
activities under consideration that are located within the coastal zone of a state which has a federally approved
coastal zone management program, the applicant has certified in the permit application that the activity complies
with, and will be conducted in a manner that is consistent with, the approved state coastal zone management
program. By this public notice, we are requesting the state's concurrence with, objection to, or waiver of the
applicant's certification. No permit decision will be made until one of these actions occur. For activities within
the coastal zone of New York State, the applicant's certification and accompanying information is available from
the Consistency Coordinator, New York State Department of State, Division of Coastal Resources and Waterfront
Revitalization, Coastal Zone Management Program, 41 State Street, Albany, New York 12231, Telephone (518)
474-6000. Conunents regarding the applicant's certification, and copies of any letters to this office connnenting
upon this proposal, shoul~ be so addressed.
In addition to any required water quality certificate and coastal zone management program concurrence, .the

WORK DESCRlYfION
The applicant, Joseph Kaddis, has requested Department of the Army authorization to
construct a pier and install mooring pilings in Fishers Island Sound, Block Island Sound
at Fishers Island, Town of Southold, Suffolk County, New York.
The work would involve construction of a 140' X 6' pile-supported, fixed timber pier.
The project would also involve the installation of seven (7) mooring pilings that would be
spaced 20-feet apart. Three (3) pilings would be installed west of the pier, three (3) east
of the proposed pier, and one (I) directly north of the pier terminus.
The proposed work could have a minor adverse impact on Essential Fish Habitat (EFH)
and EFH-managed species as a result of temporary increase in turbidity during
construction. Although this may adversely affect the feeding success of some EFH-
managed species or their prey, it is expected that fish populations would avoid the area of
disturbance during construction. In addition, the proposed structures would offer
attachment surfaces for encrusting organisms, which would increase both the biological
diversity of the area and the forage base for EFH-managed species, as well as provide
other ecological benefits.
The stated purpose of this project is to provige a safe mooring facility for vessels and
recreational access to surrounding waterways.
