Dear Mr. Lark:
The Southold Town Board of Trustees reviewed the survey prepared by Richard H.
Strouse last revised May 17, 2004 and determined the proposed reconstruction of the
existing dwelling to be out of the Wetland jurisdiction under Chapter 97 of the Town
Wetland Code and Chapter 37 of the Town Code.
Therefore, in accordance with the current Tidal Wetlands Code (Chapter 97) and the
Coastal Erosion Hazard Area (Chapter 37) no permit is required. Please be advised,
however, that no construction, sedimentation, or disturbance of any kind may take place
seaward of the tidal wetlands jurisdictional boundary or seaward of the coastal erosion
hazard area as indicated above, without a permit. It is your responsibility to ensure that
all necessary precautions are taken to prevent any sedimentation or other alteration or
disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and
Coastal Erosion Hazard Area, which may result from your project. Such precautions
may include maintaining adequate work area between the tidal wetland jurisdictional
boundary and the coastal erosion hazard area and your project or erecting a temporary
fence, barrier, or hay bale berm.
However, any activity within 100' of a Wetland line or seaward of the Coastal Erosion
Hazard Area would require permits from this office.
This determination is not a determination from any other agency.

Gentlemen:
I represent BD Remodeling & Restoration as agent for Whitney
B. Armstrong in its application for a building permit from the
Southold Town Building Department to reconstruct a house
utilizing the existing footprint. The original house was
destroyed by fire on December 15, 2003.
Enclosed for your review is a survey of CME Engineering,
Land Surveying & Architecture, PLLC revised 05/17/2004. Kindly
let me know if the Town Trustees have jurisdiction on this
property. If not, I would appreciate you forwarding me a letter
of non-jurisdiction.

Gentlemen:
On July 12, 2006 the Board of Town Trustees issued a letter
of non-jurisdiction. The Armstrongs have decided to amend their
application by extending the new house 57' to the east which
would place it 60' from the top of the bluff area at its closest
point but it would still be 113' from the ordinary high water.
Enclosed for your review is Site Survey (A003) prepared by
Thomas Phifer and Partners dated 21 December 2006, Kindly let me
know if the Town Trustees will require a permit for the revised
application.
