SPECIAL PERMIT. By resolution of the Board it was determined that a special permit ( ) be granted ( ) be denied pursuant to Article .................... Section .................... Subsection ................ paragraph .................... of the Zoning Ordinance, and the decision of the Building Inspector ( ) be reversed ( ) be confirmed because 2. VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (,~-m~t) produce undue hardship because it would not be in keeping with the development and would prevent applicant from erectin~ sufficient income producing cottages to justify her investment (b) The-hardship created (is) ~ unique and ~ (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because there ~'s several other s,,mmer cottages on the same size lots. Board unanimously grants application on condition that the location of the house to be constructe~ on Lot 8 conforms to the prevailing setback established by the residence on Lot No. 7 so far as distance from Sound View Avenue is concerned. It is the further condition that the residence shall not be closer to Goldin T~e than the prevailing front yard line established by the residences on Lots 10 and 12. STRICT APPLICATION OF THE ORDINANCE would produce UNDUE HARDSHIP because this lot is part of a development on a filed map, which map was filed in the Suffolk COunty Clerk's Office on November 22, 1932 as Map No. ll06 and is known as ,Subdivision of Property owned by Nathan Goldin, Situate at Southold, Suffolk Co., N.Y." There are at present summer cottages on Lots l0 and 12, which lots are 50 by 85, approximately. On the East side of .Gqldin Lane in the same development there are also several summer cottages on the same size lots. 2. The ha~shipcreotedis UNIQUE andis notshared by all properties alike in the immediate vicinityofthisproperty and inthisuse district ~couse this application is.made . . simultaneously with application for other lots ia ~h~s development on the west side of Goldin Lane, since cottages were built on many lots prior to the enactment of the zoningordin~ce. To require strict compliance on these lots would not be in keeping with the development and would prevent applicant from erecting sufficient income producing cqttages to justify her investment. 3.
