Dear Mr, Burger:
I have inspected this site to determine if whether or not approvals from the N.Y.S.D.E.C.
or Southold Town Trustees would be needed to renovate the existing residence and
garage. The Town Trustees have jurisdiction over projects that are located within 100 of
areas of wetlands or within 100-of the Apparent High Tide Line. In inspecting the site as
well as the survey of the property prepared by Barrett,Bonacci and Van Weele, P.C.
(10/15/02) it was noted that both of the buildings are located greater than 100 from the
existing wetlands and the AHWL. Therefore the Trustees have no jurisdiction over the
renovation of these structures.
Under the Tidal Wetlands regulations, the N.Y.S.D.E.C. has jurisdiction over all those
areas located within 300-of tidal wetlands unless the project is located"landward of the
10J elevation contour on a gradual,natural slope;or landward of the topographical crest
of a bluff,cliff or dune in excess of 10 in elevation."Given this the project would be out
of the N.Y.S.D.E.C.'s jurisdiction.

Dear Mr. Burger:
I have inspected this site to determine if whether or not approvals from the N.Y.S.D.E.C.
or Southold Town Trustees would be needed to renovate the existing residence and
garage. The Town Trustees have jurisdiction over projects that are located within 100 of
areas of wetlands or within 100 of the Apparent High Tide Line. In inspecting the site as
well as the survey of the property prepared by Barrett,Bonacci and Van Weele,P.C.
(10/15/02)it was noted that both of the buildings are located greater than 100 from the
existing wetlands and the AHWL. Therefore the Trustees have no jurisdiction over the
renovation of these structures.
Under the Tidal Wetlands regulations,the N.Y.S.D.E.C. has jurisdiction over all those
areas located within 300 of tidal wetlands unless the project is located"landward of the
10 elevation contour on a gradual, natural slope; or landward of the topographical crest
of a bluff, cliff or dune in excess of 10 in elevation." Given this the project would be out
of the N.Y.S.D.E.C.'s jurisdiction.
