Dear Mr. &Mrs. Ahlers:
The following action was taken by the Board of Town Trustees during a Regular Meeting,held
on January 23, 2002,regarding the above matter.
WHEREAS,PAUL &PATRICIA ARLERS applied to the Southold Town Trustees for a
permit under the provisions of the Wetland Ordinance of the Town of Southold, application
dated January 3, 2002
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
January 23, 2002 at which time all interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standard set forth in Chapter 97-18 of the Southold
Town Code.
WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,

NOW THEREFORE BE IT.
RESOLVED,that the Board of Trustees approved the application of Paul& Patricia Ahlers for
a Wetland Permit to relocate front entrance adding front porch- front bay window add 2'x12' bay
window on side of house—reconfigure rear entrance and wooden steps and increase patio area
add 12'x16' shed—reconfigure a portion of existing roof line to accommodate second floor
bedroom add drywells and gutters on creek side of house.
BE IT FURTHER RESOLVED that this determination should not be considered a determination
made for any other Department or Agency,which may also have an application pending for the
same or similar project.
Fee must be paid, if applicable and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified when project is started and on
completion of said project.

1. The proposed accessory shed, on a non-conforming 22,825 square foot parcel in the R-40 District, is
not permitted pursuant to Article III Section 100-.33C,which states;
"In the case of a waterfront parcel, accessory buildings and structures may be located in the
front,provided that such buildings and structures meet the front-yard setback requirements
set forth by this code."
According to Article XXIV, section 100-244 B., lots measuring between 20,000 and 39,999 square
feet require a principal front yard setback of 40 feet. Plans note a front yard setback of 29.3 feet.
2. In addition the proposed accessory shed is not permitted pursuant to Article IIIA, Section 100-33 A.
4,which states,
"On lots containing more than twenty thousand(20,000) square feet up to thirty nine thousand
square feet such buildings shall be set back no less than five(5) feet from the side yard line."
The proposed accessory shed is noted as being+/- 3.4 feet from the side yard line.
Total lot coverage, following the proposed construction,would be+/- 13 feet.

MEETING OF APRIL 18, 2002

Property Location: 1905 Gull Pond Lane, Greenport Parcel: 35-4-16
BASIS OF APPLICATION: Building Inspector's January 8, 2002 Notice of Disapproval, updated
April 9, 2002, for the reason that applicant's plan to locate an accessory storage building with a
setback is less than five feet from the side property line and less than 40 feet from the front
property line
AREA VARIANCE REQUESTED: Applicant was disapproved in his building permit application to
the Building Department to construct a 12' x 16' accessory storage building at 29.3+- feet from the
west line and 3.4+- feet from the south line, at its closest points.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on April 18, 2002, at which
time written and oral evidence was presented. Based upon all testimony, documentation, personal
inspection of the property and the area, and other evidence, the Zoning Board finds the following
facts to be true and relevant.
PROPERTY DESCRIPTION: The applicant's property is located on the northeast side of Gull
Pond Lane in Greenport. The property is shown as Lot 1 on the Map of Fordham Acres (1962),
and is improved with a one-story house with garage and accessory pool structure, as shown on the
survey prepared by David H. Fox June 1, 2001, amended July 2, 2001 for the applicants.
REASONS FOR BOARD ACTION, DESCRIBED BELOW: Based on the testimony and record
before the Board and personal inspection, the Board makes the following findings:
1. Grant of the area variance will produce an undesirable change in character of neighborhood or
a detriment to nearby properties. The above-mentioned variance will have no significant impact on
the neighborhood.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for applicant
to pursue, other than an area variance. Do to the location of the existing house, flood zone and
wet land in the rear yard; the suggested location is the logical location.
3. The requested area variance is minimum. The 1' 8" variance to the 3" 4" set back is minor.
There is no evidence that the grant of the variance will have an adverse effect or impact on the
physical or environmental conditions in the neighborhood or district. The variance well has no
environmental impact on the neighborhood.

BOARD RESOLUTION ACTION OF THE BOARD: In considering all of the above factors, and
applying the balancing test under New York Town Law, motion was offered by Member Orlando,
seconded by Chairman Goehringer, and duly carried, to
APPROVE, the variance as applied for.
This action does not authorize or condone any current or future use, setback or other feature of the
subject property that violates the Zoning Code, other than such uses, setbacks and other features
as are expressly addressed in this action.
