1. STRICT APPLICATION OF THE ORDINANCE would produce UNDUE HARDSHIP because
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district because
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because the roadway in Paradise Shores has been
established for almost 20 years and there are approximately 18 homes which
have been erected or purchased on property in Paradise Shores, the owners
knowing in each case that this was a private road to be maintained by them
and that it does not meet the requirements of a'highway that it be at leas
3 -rods in width, so that it can never become a Town highway. All olf!l/t.~.

Upon these facts, applicant respectfully urges that under Section i ~
280a of the Town Law "the circumstances of the case do not require i, "

a reasonable exception and issuing the building permit sought by 1.''-
applicant for an extension to his home. This additional constructi_CO:,."
will require no additional services from the Town of Southold and 1s a
matter of a property owner seeking to improve. his property for the

construction also will add to the tax income of the Town of Southold

Dear Mr. Terry:
Herewith in duplicate is the completed form of
appeal which you so kindly sent me, and which I trust
I have completed in form satisfactory to warrant the
Board of Appeals in granting my request.
Again, I will not appear at the hearing, unless
I hear from someone to the contrary, but would ask

that it cannot be granted, so that I may have the

P. S. I am writing this P. S. on a separate sheet so
that you can put it in the apnropriate file, separate
and apart from my individual application.
I will get in touch with Mr. Larck as soon as
poss ible to complete the new form of appli ca tion for
open development area. I am curious, however, about
the rejection by the Planning Board of the application
previously submitted, in view of the fact that the
Town Board apparently approved it, and wondered whether
minutes of the Planning Board set forth their reasons
for rejection, since it would seem that a 19 foot
drive'Iay is a substantial mode of access to homes on
the road. I had intended to discuss this with you
tomorrow, but in view of the snow today, will postpone
this to possibly next Saturday, if you happen to be
in your offIce on Saturday mornings.
In any event, thank you for your several
courtesies extended to me and to the Association.

BuIlding Inspector

Dear Mr. Terry:
Belatedly, I wish to thank you for your very
helpful letter of December 26, with regard to my
proposed construction at Paradise Shores. As you
are undoubtedly aware from the very date of your
letter, this was the height of the holiday season
and one commitment or another, together with a
case of the flu, has kept me from getting out to
see you and filing the building permit as you re-
quested.
My principal reason for delay was that, un-
fortunately, I have never taken any precise measure-
ments of the sIze of my house so as to be able to
fill in the reverse side of the Application for
Building Permit. Meanwhile, so that you do not think
I have disregarded your suggestions and your request
for filing a permit, I have completed the form to
the best of my ability, with respect to the various
dimensIons. Actually, I had intended to file when
the outside alteration work commenced, which I would
like to do myself when the Easter vacation rolls
around, and it amounts to a 9 foot extension of the
northerly side of the building, with the idea of
extending the present roof not only over this ex-
tens ion, but over an open porch that we would 1 ike
to put in in the "jog" of the house in the front.
This you will see in the dotted lines that I have
indicated on the diagram.
In any event, as soon as I can get to Southold
I will undertake to get exact measurements and discuss
with you then the desirability of filing an amended
diagram, but meanwhile you will have for your records
thIs application which I hope will cover me in the
interim period.
Thanks again for your assistance.
Very truly yours,
BBll:d!2;

Dear Sir:
I am the owner of a cottage at Paradise Shores,
which I had occasion to visit for the first time in
several weeks, yesterday.
I have contracted with F'rancis Schriefer to put
a foundation under the buildin[': and had my attention
called to the violation notice tacked to the outside
of my cottage. Since I was not yet to the point
"There I Has erecting any structure, I was under the
impression that I would be required to file for a
building permit only in the spring, when I plan to
build a small extension on to the building, bu~ if
T am incorrect in my conclusion, would you forward
to me a form of application for building permit
w'lich, I assume, will indicate the fee involved, to-
,'ether Hi th a copy of the ordinance which requires
the fIling of such permit, so that I can be guided
by it in any future Hork I have done on the premises.
Obviously, I intend to comply with the law in all
respects and my failure to file heretofore is due
possibly to a mistaken impression of the requirements
of your ordinance.
A self-addressed envelope is enclosed for your
convenience.

Your letter ot December 23rd at hand, Thank you very much
for writing.
The red tag which I put on your house is for the purpose of getting
information on the work proposed, rather than an outright violation,
and if a violation exists to give the owner a chance to file befo;e
the date on the notice, otherwise the name is turned in to one oftthe
justices of peace for a warrant to be issued.
I am enclosing a copy of the Zoning Ordinance which applys to the
whole town. I would call YOllr attention to Article VII, section 703,
which requires a permit before commencing any work. The fee for an
addition to an existing dwelling is $,.00.
In the case of Paradise Shores, and other developments etc. on
private roads, no building permits can be issued until the area served
by the private road is declared an open development area and the
private road is approved as suita~l. and adequate access by the Planning
Board and approved by the Town Board. I have written to !bps. Larck,
as president of the Paradise Shores Assn., and asked him t~ file a map
showing the roads and file an application for an opendevel~pment area,
under sect.Jon 200-a of th~ Town Law. I have heard nothing)from him
yet but expect to soon. Possibly a word from you or othe~ property
owners in the neighborhood would be in or ere
I am shure you gave your job to a good man and that he, viII do
an excellent job for you. I would not stop him from putt1~ a cellar
under the existing building, but could not let it extend b~ond
existing lines until a permit has been secured,
If I can be of further assistance t, you or your nei&hbors, I viII
do vhat ever I can to help at any time.
Yours truly
IJbl')"'- \;
