No. 5474— DANIEL and TINA FINNE FEB 1 9 2004 Property Location: 1020 Seventh Street, Greenport CTM 1000-48-2-40 (unmerged from adjacent CTM #48-2-19) -/-40 71 Fw Southo?d Town Cknk FINDINGS OF FACT PROPERTY FACTS/DESCRIPTION: The applicant's property, shown with an area of 4,500 sq. ft. with 45 ft. frontage along the west side of Seventh Street, is presently improved with a one-story frame house situated 4.5 feet from the front lot line (zero setback from the front stoop), and 8 ft. from the southerly side lot line. The adjacent property, CTM 48-2-19, consists of 9,000 sq. ft. with 90 ft. of frontage along Seventh Street and 100 ft. frontage along the south side of Flint Street. BASIS OF APPLICATION: Article II, Section 100-26, based on the Building Inspector's December 12, 2003 Notice of Disapproval, for the reason that the subject lot merged with an adjacent lot to the east, CTM #1000-48-2-19, due to common ownership for a period of time after July 1, 1983. It was also noted that under Exceptions at Section 100-26C5, lots which are recognized under 100- 24 shall not be deemed if each lot is currently development with a one-family dwelling with a minimum 850 sq. ft. which falls within the existing lot lines and which has a certificate of occupancy or would qualify for one. The Building Department states that although the subject lot is currently developed, the house measures a total of 383+- sq. ft. APPLICANTS' REQUEST: Applicant requests a Lot Waiver to unmerge Suffolk County Tax Map Lot 40 (Greenport Driving Park Lot 56), from the adjacent SCTM Lot 19 (Greenport Driving Park Lots 57 and 58) which contains 9,000 sq. ft. and is improved with a dwelling. REASONS FOR BOARD ACTION, DESCRIBED BELOW: Based on the testimony presented, materials submitted and personal inspection, the Board makes the following findings: 1. The November 7, 2003 title search, prepared by South Bay Abstract, Inc., indicates that CTM 48-2-40 was transferred 10/1/1976 to Frank A. Field, and to Frank A. Field Realty Inc. on 3/17/1984. The adjacent house parcel, 48-2-19 was also transferred 12/12/1977 to Frank A. Field, and to Frank A. Field Realty, Inc. on 3/17/1984. 2. The title search also confirmed that Frank A. Field Realty owned each lot and conveyed the lots to George Freeman on 2/10/1987 and 7/15/1987. Freeman continued ownership of each of the two parcels until 11/14/1994, when CTM 40, was transferred to the previous owner, Frank A. Field Realty, Inc. The applicants, Daniel and Tina Finne, are the current owners, having acquired the property on 4/15/2003. Page 2—February 12,2004 ZBA Appl. No.5474—Daniel and Tina Finne 1000-48-2-40 at Greenport 3. Each property has a dwelling structure on it since before the start of zoning in 1957, and both lots are consistent with most lots in the area. 4. This waiver of merger will recognize the original lot lines for Lot 56 shown on the Map of Greenport Driving Park filed December 1, 1909 in the Office of the Suffolk County Clerk, and in the originals deeds, dating back to 1953 and 1956, and earlier. 5. Information was submitted by applicant to show that the waiver will avoid economic hardship because both lots are owner by different owners and to continue with this merger will deprive each homeowner of the reasonable use of their property. No increase in the number of dwellings is proposed; each lot is improved with a dwelling. 6. In granting this waiver, the Board finds that the better interest of the town will be served because the applicant intends to reconstruct a house on the property within the required setbacks for this zone, utilizing all of the current codes pertaining to fire, building, safety, and zoning codes that apply. RESOLUTION: On motion by Member Orlando, seconded by Member Dinizio, it was RESOLVED, to GRANT the lot waiver, as applied for. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action.
