SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 15,281 sq. ft. lot has 150.70 along First Street and lot depth of 101.57 feet, and is improved with a one-family, two-story frame house and detached swimming pool, as shown on the December 5, 2003 survey prepared by John C. Ehlers, L.S. BASIS OF APPLICATION: Building Department's March 12, 2004 Notice of Disapproval, amended March 22, 2004, citing Code Sections 100-242A and 100-244 in its denial of a building permit application. Applicants propose second-story additions for additional living area and an upper deck, over the existing dwelling construction, and adding a roofed entry over the existing concrete patio, portions of which are less than 35 feet from the front lot line, and adding a new garage with 733 sq. ft., with an increased lot coverage from the existing 23.9% to 28.7%. The Code limitation is 20%. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on May 20, 2004, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicants request a variance with respect to a proposed 733 sq. ft. two-car accessory garage at the northwest corner of the lot, which will add 733 sq. ft. of additional lot coverage, for a total of 28.7%, as shown on the 2/19/04 site plan prepared by JFT Architect Also requested is a 7.4 ft. front yard setback at its closest point, for additions which include a second-story deck over the existing deck and gable roof construction over the existing entry. The existing setback is 7.4 feet. The existing lot coverage is 23.9%. ADDITIONAL INFORMATION:AMENDED RELIEF: Prior to the May 20, 2004 public hearing, letters were submitted from concerned neighbors relative to the proposed' garage and amount of lot coverage relief requested. During the May 20, 2004 hearing, the applicants offered to remove the proposed garage from-their application, and no other new construction is requested or stated in the `. Maga 2—gine 3,2004 ZBA No.5522—E.Katsoulas CTM 1000-117-7-27 Building Department's Notice of Disapproval that would increase the degree of nonconforming lot coverage. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the relief requested will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicants removed their plan for a 733 sq. ft. detached garage which would have increased the lot coverage to 28.7% on the first request. The second request is for construction over existing building area that does not increase the lot coverage, and therefore the lot coverage will remain at 23.9%. The setback for the second-story construction will be within the same building setback line, and applicant has agreed to keep the lower deck open with only a roof, without an enclosure, as exists. The home has existed in the current location on the lot for many years. The additions at the front of the house are similar in size to other homes in the area. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance because the house is existing, and the new additions will be second-story construction. 3. The variance granted herein is not substantial. The existing lot coverage of 23.9% will remain unchanged, and the setback for the additions do not extend further into the front yard area. 4. The difficulty was self-created since the home existed in its present location for many years in a nonconforming location. 5. No evidence has been submitted to suggest that a variance in this community of single-family residences will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of this relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of additions, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Member Tortora, and duly carried, to GRANT the variance with regard to the front yard setback as applied for, as shown on the plan prepared 2/19/04 by JFT Architect, SUBJECT TO THE CONDITION that the lower deck 1y 4, i'- !lags 3— ,,ijne 3,2004 ZBA No.5522—E.Katsoulas CTM 1000-117-7-27 not be enclosed or filled. (A) The'proposed new 1 story structure for a garage measuring 24.2 feet in length to be located parallel to, and only 3.5 feet away from the property line, with an approximate height of 11 — 13 feet or more (one story = approx. 9 feet plus a 23° pitch roof), would have the effect of an 11-13-foot (or more) fence running along side my property. The area on my property directly adjacent to the proposed new garage structure is utilized for re-creational and leisure activities that measures 34 feet in length and, between my house and the property line, only 14-feet in width.A 24-foot long structure of 11-13 feet or more in heights would box in, and block off open air space from my leisure space disadvantageously.
