PROPERTY FACTS/DESCRIPTION: The applicant's 8.75-acre parcel is located in the M-II District with 460 feet along the east side of Wickham Avenue, Mattituck. The property is improved with a stucco and frame restaurant building, swimming pool, security and office areas related to marina's boat storage. Also existing is a 25,000 sq. ft. boat storage building. BASIS OF APPLICATION: Building Department's December 18, 2003 Notice of Disapproval, citing Code Section 100-239.4B in its denial of a building permit application concerning new additions, for the reason that the addition is proposed at less than 75 feet from the bulkhead. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on May 20, 2004, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicant wishes to construct an addition on the west side of the existing boat storage building with setbacks at 58.5 feet, 62 feet and 68 feet to the bulkhead, at its closest points as shown on the 1/18/04 plan prepared by East End Design Associates. The plan shows that the new office construction will be two-story and the boat storage addition will be 34'11" in height to meet code requirements. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the relief requested will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The existing boat sales and shop are housed in a small wood frame building on the site adjacent to the existing storage building. The office for the facility appears to be situated in a small, detached building west of the driveway entering the facility. Q Page Z—June 3,2004 i ZBA No.5494—Matt-A-Mar,LLC -- CTM 114-3-1 (NI-II Zone) The proposed addition will maintain the same lines of the existing building, presently 65 feet from the bulkhead, and will incorporate all of these uses into a new larger building. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing location of the buildings and layout of the property provides no alternative but to apply for a variance. The applicant's business is in need of office areas, sales and enclosed storage, and the addition will consolidate the uses, and remove a nonconforming building. 3. The variance granted herein is substantial. The amount of relief requested is 65 feet, for a 10 ft. reduction of the code required 75 feet. 4. The difficulty is self-created in that it is applicant's desire to build new office and enclosed storage areas, as addition to the existing nonconforming building and maintaining the same building line parallel to the southerly bulkhead. The reduction is the maximum that the Board would consider. 5. No evidence has been submitted to suggest that a variance in this M-II Marine Zone District will have an adverse impact on the physical or environmental conditions in the neighborhood. Information has been received from the Suffolk County Soil and Water Conservation District dated May 25, 2004 indicating that the shoreline is well-vegetated and appears to be stabile, and that the existing bulkhead appears to be in good condition. The roof runoff is being directly into drywells for the existing building, and no erosion problems were found at this time. The applicants are proposing installation of dry wells to adequately contain surface water runoff and to prevent it from entering Mattituck Creek. 6. Grant of this relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an addition, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Member Tortora, and duly carried, to GRANT the variance as applied for, as shown on the February 22, 1989 survey, revised March 31, 2004 by John Metzger, L.S. and January 18, 2004 plan prepared by East End Design Associates, SUBJECT TO THE FOLLOWING CONDITIONS: 1. All roof runoff toward the creek shall be placed into storm drains. 2. Road enhancement (without asphalt pavement) between the building and bulkhead and creek shall be a determination issued by the Town Trustees, N.Y.S. Department of Environmental Conservation, or, if need be, the ZBA, and with appropriate drainage. l Pate 3.—June 3,2004 ZBA No.5494—Matt-A-Mar,LLC CTM 114-3-1 (M-II Zone) 3. Fire access shall be provided and remain open and unobstructed for a minimum 35 ft. width for emergency vehicles between the existing building/proposed additions and the bulkheads. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In performing this balancing test, the Zoning Board is charged with the responsibility to consider the five factors enumerated in Town Law Section 267b-3 (b) . The variance should be granted for the following reasons : 1 . No undesirable change will be produced in the character of the neighborhood or a detriment to nearby properties, if the variance is granted. The property is a commercial marina zoned MII on 8 . 75 acres . The existing commercial structure used for Marine repairs and storage is located at 65 feet from the bulkhead. The existing structure is to be expanded and continued along the existing setback. 2 . The benefit sought by the applicant can not be achieved by some method, feasible for the applicant to pursue, other than an area variance . The existing building can not be enlarged without a variance. The setback was established by the existing building located at 65 feet from the bulkhead. The proposed expansion will house the Marina office presently in a separate structure . The consolidation of the use will enable the applicant to remove an old nonconforming building. 3 . The area variance is not substantial The application of the balancing test weighs in favor of the grant of the variance . The bulkhead is located within the applicants land (underwater land in private ownership) and the Marina uses are all integrated on the property. • The existing structures to be expanded are set back 65 feet from the existing bulkhead necessitating only a 10 ' variance. 4 . The variance will have no adverse effect or impact on the physical or environmental conditions in the neighborhood or district . The property is a commercial Marina, the use is carefully monitored by the DEC and Town Trustees . The proposed structure will enhance the environmental protections already in place since the work at the Boat yard will be performed inside a controlled building. 5 . The alleged difficulty was not self-created. The existing structure predates the regulations and expansion of the building is not practical without a variance . 6 . The variance requested is the minimum variance practicable given the personal benefits anticipated by the applicant . The shoreline is , well vegetated and appears to be stabile. Roof runoff from the existing building is directed into drywells. No erosion problems are , present at this time. The proposed-structure shows it will also direct roof runoff into drywells. This will eliminate some of the present surface, water runoff from the asphalt and open areas, ' thereby reducing the amount of - surface water runoff that can enter Mattituck Creek.
