SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicants' 91,618 sq. ft. lot has 360 ft. frontage along the east side of Marratooka Road, and 215.36 feet along the southerly property line. The eastern section of the property contains tidal wetlands adjacent to Deep Hole Creek, and the lot is improved with a single-family, two-story residence with porches, wood deck, detached in-ground swimming pool, asphalt driveways, and extensive landscaping, as shown on the 3-21-00 survey, revised 12-9- 03 by Joseph A. Ingegno, L.S. BASIS OF APPLICATION: Building Department's March 4, 2004, Notice of Disapproval, amended March 11, 2004 citing Code Section 100-33 in its denial of a building permit application concerning a proposed accessory pool house structure. The reason stated is that the proposed detached building is not permitted in a side yard location. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on April 22, 2004, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicants wish to construct a 12' x 24' accessory building (nonhabitable, with the only indoor plumbing for a toilet and sink, and wet bar sink) in the southerly yard area near the swimming pool. The distance between the new pool house location and the front line along Marratooka Road will be 58'6", and 38' to the southerly property line. The height of the proposed building will be 12'7" to the top of the roof ridge, and 16' to the top of the cupola. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: r -6 Page 2—May 6,2004 ZBA No.5514—T.and S.Meriam CTM 115-11-26 1. Grant of the relief requested will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicants are proposing to remove the existing 10.4' x 10.4' frame storage shed, replacing it with a new 12' x 24' accessory building near the swimming pool which exists in a side yard. At the public hearing, the Board considered and discussed letters submitted by nearby landowners with concerns about their property values and their enjoyment of present water views. Existing trees and plantings have landscaped the applicants' property over the years, providing screening from the street and other nearby areas. The Board at the hearing asked the architect to remove a window in the changing room replacing it with a door that open to the outside, which was agreed. The architect also confirmed that the use will be a permitted accessory use, without a stove or indoor cooking facilities, and no heat or air- conditioning, no indoor shower or tub, no sleeping or bunk-house use. The building will be 123 feet from the edge of wetlands, at its closest point, 58'6" from the front lot line and 38' from the southerly side line. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The lot is 360 ft. wide with accessory structures already existing in this southerly side yard area. No benefit would be achieved to locate the accessory building on the east side of the house because the building and utility hookups would be closer to the adjacent wetland area. 3. The variance granted herein is substantial because the location requested is defined by the code as a side yard, although the yard gives the appears of a rear yard with the existing the inground swimming pool and other improvements. 4. The difficulty was self-created when the new construction was planned with relative code requirements in effect. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of this relief is the minimum action necessary and adequate to enable applicants to enjoy the benefit of an accessory pool house building, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Member Dinizio, and duly carried, to GRANT the variance as applied for, as shown on the 3/4/04 site plan by Samuels & r` 1• ` Page 3—May 6,2004 ZBA No.5514—T.and S.Meriam CTM 115-11-26 Steelman, Architects and construction diagrams with a ZBA dated stamp of March 16, 2004, SUBJECT TO THE FOLLOWING CONDITIONS: 1. No kitchen; no indoor cooking. 2. No heat or air-conditioning. 3. No sleeping or similar habitable use. 4. The window shown on the construction plans (in changing area) shall be removed and replaced with a door to the outside (outdoors). 5. Use of this building shall remain accessory, and not be converted to living area. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. Although the proposed Pool House is larger than the existing shed, the style will be similar with the surroundings, and it will be screened from the road by plantings. (2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because of the location of the existing residence on,the lot, which delineates the lines which establish the "side yard". There is only 5'-10" from the required front yard setback line to the existing building setback line: not enough dimension to locate the Pool House in the front yard (allowed on waterfront property). Similarly, the rear line of the side yard, determined by the edge of the residence, extends to within 100 feet of the wetlands line, making it impossible to located the pool house in the rear yard (by Trustees regulations). Therefore, the Pool House must be located in the side yard, although this is not allowed by zoning code. (3) The amount of relief requested is not'substantial because the proposed Pool House is so small. Also, it will be further from the road than is the house. I am one of four, individuals who owns the property directly across lviarratooka Road from where the pool house would be built. My concern is that this building will block water view of Deep Hole Creek and therefore lower the value of my property. I am further concerned that as improvements are inade to the Miriam's property the taxes on my property will increase while the salability goes down. Please take these concerns into consideration when reviewing the appeal of building this pool house. SAMUELS: The old one is 7 probably about 10 by 10, 100 square feet. 8 This is 12 by 24, which is 288 square feet, a 9 little lower, but it's about 13 feet to the 10 ridge. 11 Here the situation is peculiar in 12 that the pool house can only be located -- or 13 the accessory structure -- only in the front 14 or rear yard. Because of the positioning of 15 the house and the waterfront, those yards are 16 not useable. It's a five foot wide area which 17 is theoretically the front yard by their 18 definition, and obviously you can't fit a pool 19 house in that. And in the rear yard it's 20 taken up entirely by the 100 foot setback. 21 CHAIRWOMAN OLIVA: And you have to 22 take down all those trees? 23 MR. SAMUELS: No. Just a couple 24 of the arborvitae they put in. None of the 25 mature trees. I mean, those screening trees 1 2 were put in last year. 3 CHAIRWOMAN OLIVA: They're nice. 4 MR. SAMUELS: They are. They'll 5 be moved. 6 CHAIRWOMAN OLIVA: Beautiful piece 7 of property. 8 MR. SAMUELS: Isn't it? It's an 9 old 1920s house. 10 BOARD MEMBER GOEHRINGER: It's the 11 original Audien estate, then they moved next 12 door, Dr. Bought it and then, of course, 13 operated out of there for his entire career. 14 THE WITNESS: Right. We 15 completely restored the house now. It's 16 really nice. 17 CHAIRWOMAN OLIVA: Very nice. 18 BOARD MEMBER GOEHRINGER: Can I go 19 on this one second? 20 CHAIRWOMAN OLIVA: Go ahead. 21 BOARD MEMBER GOEHRINGER: Tom, 22 we've been kind of getting away from this, but 23 I need to discuss with you the issue of at 24 least the changing room should have a door 25 open to the outside so that window should be 1 2 taken out and that door should be opened to 3 the outside so as not to create -- this has 4 nothing to do with your client, okay, this is 5 a generic statement from me, I'm not speaking 6 for the Board -- the door should be taken -- I 7 don't care if it's a door, if it's completely 8 glassed open, it doesn't make any difference 9 to me, but that should be opened so as not to 10 create a bunkhouse effect, so to speak. 11 MR. There was a 12 bit of confusion in the Building Department 13 when this first went in because Dameon thought 14 that was the intention, I told him it wasn't, 15 and so he wanted the wording changed in the 16 kitchen -- we called it kitchenette, he said 17 no, it has to be called a wet bar, and so we 18 did that. I think I understand that's where 19 you're coming from here, and that wouldn't be 20 the first time I heard that kind of a 21 suggestion. Although, they were satisfied 22 with the use over at the Building Department, 23 the intended use. 24 BOARD MEMBER GOEHRINGER: No heat? 25 MR. SAMUELS: No heat. 1 2 BOARD MEMBER GOEHRINGER: No air 3 conditioning? 4 MR. SAMUELS: No. 5 CHAIRWOMAN OLIVA: Refrigerator? 6 MR. SAMUELS: There will be a 7 refrigerator, little sink for drinks out there 8 CHAIRWOMAN OLIVA: No stove? 9 MR. SAMUELS: No. It clearly is 10 from our standpoint, from the Miriam's 11 standpoint, it absolutely is an accessory use. 12 They're not intending to turn it into a 13 bunkhouse. 14 CHAIRWOMAN OLIVA: It's a summer 15 use? 16 MR. SAMUELS: Yes, it's for the 17 pool. I mean, I know there's been an awful 18 lot of accessory buildings converted 19 illegally, but in this instance I think it's 20 almost physically impossible, it's really just 21 too small for that. 22 BOARD MEMBER GOEHRINGER: We're 23 not saying this client, I mean, they could 24 sell the property? 25 MR. SAMUELS: Of course, I 1 2 understand your point. 3 CHAIRWOMAN OLIVA: Vince? 4 BOARD MEMBER ORLANDO: No 5 questions. 6 CHAIRWOMAN OLIVA: Lydia? 7 BOARD MEMBER TORTORA: I'm just 8 reviewing some of the comments, the concerns 9 of the neighbors and I think they should be 10 placed in the record. 11 CHAIRWOMAN OLIVA: Yes. 12 BOARD MEMBER TORTORA: One 13 neighbor is concerned about property values in 14 the neighborhood, that this would possibly 15 decrease it, another neighbor is concerned 16 that water view would be -- 17 BOARD MEMBER GOEHRINGER: Would be 18 diminished. 19 BOARD MEMBER TORTORA: The same 20 neighbor was -- 21 CHAIRWOMAN OLIVA: Leaching pools 22 and -- 23 BOARD MEMBER TORTORA: Yes, that's 24 the one concern I would ask you to address, 25 the letter that the proposed leaching pool may 1 2 restrict future location of a well at this 3 property and the suggestion that the leaching 4 pool be located as far from their property 5 line as possible. 6 MR. SAMUELS: Well, of course 7 that's the Health Department's review. 8 BOARD MEMBER ORLANDO: I think 9 put it by the existing ones. 10 MR. SAMUELS: It's possible it 11 could go a little closer to the existing ones, 12 although there is a separation requirement 13 there too. I would say that they are about 14 that close to putting public water down 15 Maratuka Road and Bungalow Lane. I mean, it's 16 the Water Authority intends to, it's part of 17 their new project, they haven't scheduled it 18 yet, so that issue will be removed. And the 19 Caines have said that they intend to hook up 20 as soon as it's available. But it's true, the 21 circle or 150 foot radius does partially cross 22 their property. It's true. 23 BOARD MEMBER TORTORA: Is there 24 some way that we can eliminate that concern? 25 It does seem to be a concern in my mind at 1 2 least. 3 MR. SAMUELS: We can do the best 4 we can to move it as far away -- I can't say 5 at the moment because we're also respecting 6 the sanitary, I mean the wells of the people 7 on the other side of Marratooka Maratuka Road, including 8 the lady who wrote, Mrs. Dalrymple, which had 9 an effect on where the replacement system went 10 in the first place for the main residence, 11 which was fixed partly by our well, which was 12 fixed by the next guy's sanitary up the road. 13 MS. KOWALSKI: It's like a domino? 14 MR. SAMUELS: It is. 15 CHAIRWOMAN OLIVA: Once you get 16 the public water, you don't have to worry? 17 MR. SAMUELS: And that is, I mean 18 they have taken it now all the way to the 19 first road off -- I'm sorry, I can't think of 20 the name, it's a little private road to the 21 left. 22 CHAIRWOMAN OLIVA: Bungalow Lane? 23 MR. SAMUELS: It's the one before 24 that on the left. 25 BOARD MEMBER GOEHRINGER: Buxton's 1 2 Point. 3 THE WITNESS: Buxton's point. 4 CHAIRWOMAN OLIVA: Oh, they went 5 down Buxton's Point? 6 THE WITNESS: Yes. That's where 7 it stops. 8 CHAIRWOMAN OLIVA: You're just 9 about there then? 10 MR. SAMUELS: They intend to take 11 it down Bungalow Lane and Park Avenue, and the 12 whole neighborhood, but they just haven't 13 scheduled it. They have the 50 percent from 14 what I understand from what's his name at the 15 Water Authority. 16 BOARD MEMBER TORTORA: People 17 don't have to sign up. 18 MR. SAMUELS: That's true. 19 BOARD MEMBER TORTORA: That's my 20 concern. 21 MR. SAMUELS: We can certainly 22 try. We can make every effort to move it as 23 far away as McCaine's property and I certainly 24 will guarantee we will do that, we will move 25 it just as far as we can. 1 2 BOARD MEMBER GOEHRINGER: You're 3 talking about the leaching pool? 4 MR. SAMUELS: The leaching pool. 5 BOARD MEMBER ORLANDO: How close 6 is their well to your leaching pool, obviously 7 more than one 50 feet? 8 MR. SAMUELS: Yes, it is. I 9 think it's in their basement. 10 MR. SAMUELS: And I would just 11 also mention, by the way, this is, as a pool 12 house, this is going to get very little use 13 and the Health Department standards, of 14 course, are probably greatly in excess of the 15 actual likelihood of leachate coming anywhere 16 near their lot. But your point is well taken 17 and I understand it. 18 CHAIRWOMAN OLIVA: Jim? 19 BOARD MEMBER DINIZIO: I was also 20 under the impression that the reason you went 21 to the Health Department was that the one 22 property wouldn't effect the other 23 MR. SAMUELS: That's correct. 24 BOARD MEMBER DINIZIO: If they 25 wanted to put a well in, they would have to go 1 2 to the Health Department, the Health 3 Department would have this on record, they 4 wouldn't allow them to go in. 5 MR. SAMUELS: To be honest with 6 you, I don't know if they would have to go to 7 the Health Department because it's an existing 8 residence, you know, there is kind of a 9 grandfather situation. 10 BOARD MEMBER DINIZIO: Again, one 11 would think that if they were going to put a 12 well in, they would want to do that to know 13 what's next door. 14 MR. SAMUELS: You would think, 15 and certainly to test the water, right. 16 BOARD MEMBER DINIZIO: Yes. So I 17 think -- 18 MR. SAMUELS: It's a valid 19 concern on the part of the Caines. 20 BOARD MEMBER DINIZIO: I suppose 21 you actually could -- 22 MR. SAMUELS: And we'll go just 23 as far as we can as per the Health Department 24 regulations, those are the ones that we're 25 needing to satisfy, not that we don't need to 1 2 satisfy you as well, but regarding that system 3 at least. 4 BOARD MEMBER DINIZIO: Did I read 5 something that you were taking down a 6 windmill? 7 CHAIRWOMAN OLIVA: No, the pool 8 house looks as though -- the old one. 9 MR. SAMUELS: Pat Richards works 10 in my office, and it was her in-laws' house 11 and she refers to it as the windmill because I 12 think originally, the wells are canted in like 13 this, and there probably was a structure, a 14 superstructure that went up to a windmill. 15 MR. SAMUELS: Like as a comoginal 16 point. It's not a windmill like Hook Mill or 17 something. 18 MR.
