SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under
consideration in'this application and determines that this review falls under the Type II category of
the State's List of Actions, without an adverse effect on the environment if the project is implemented
as planned.
PROPERTY FACTS/DESCRIPTION: The applicant's 47,437 sq. ft. parcel is an unimproved lot
located in the Marine II Zone District, with 177 ft. frontage along the north side of the Main Road,
and lot depth of 269.97 feet along the west side, 226.51 feet along the east side, and 184.92 feet
along the rear lot line adjacent to the Long Island Rail Road, Southold, as shown on the March 29,
1983 survey map prepared by Roderick VanTuyl, P.C.
BASIS OF APPLICATION: Building Department's October 15, 2003 Notice of Disapproval, citing
Section 100-122, in its denial of a building permit application for the reason that the proposed marine
showroom warehouse is located at less than 35 feet from front lot line.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on December 18, 2003, at
which time written and oral evidence were presented. Based upon all testimony, documentation,
personal inspection of the property, and other evidence, the Zoning Board finds the following facts to
be true and relevant:
AREA VARIANCE RELIEF REQUESTED: Applicant wishes to construct a new marine
showroom/warehouse building with a front yard setback of 25 feet, instead of the code required 35
feet. A 50 ft. wide right-of-way easement runs along the westerly line of this lot as access to other
properties to the north. The Building Inspector has determined the westerly lot line to be a front yard
line, requiring a minimum 35 ft. setback as a corner lot (instead of a 25 ft. minimum for a side lot
line).
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and
personal inspections, the Board makes the following findings:
1. Grant of the relief requested will not produce an undesirable change in the character of the
neighborhood or a detriment to nearby properties. Applicants wish to construct an 11,400 sq. ft.

marine showroom/store/warehouse building. The property is zoned Marine II and has two front
yards, stemming from a private right-of-way on the west side of their property. The Code requires a
35 ft. setback, and the applicants propose a 10 ft. reduction for a 25 ft. setback. The building is
located at 25 feet from the right-of-way, and the site activity is minimized to the neighbors who will
use the right-of-way on the west side. At least 50 percent of the surrounding area is used for marine
purposes, and the right-of-way does not face residential front yards.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for the
applicant to pursue, other than an area variance. The applicants propose to move from their present
building on the opposite side of the Main Road (NYS Route 25) to this larger facility for their marine
operations. The is no alternative but to request a variance for a 10 ft. reduction.
3. The difficulty was self-created because a smaller building could have been proposed, however,
since the private right-of-way is for limited use by owners of property on the opposite site of the
Railroad tracks, the activities will be less intense.
4. No evidence has been submitted to suggest that a variance in this Marine II Zone District will
have an adverse impact on the physical or environmental conditions in the neighborhood.
5. Grant of the relief requested is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of a new building, while preserving and protecting the character of the
neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing
test under New York Town Law 267-B, motion was offered by Member Orlando, seconded by
Member Goehringer, and duly carried, to
GRANT the variance as applied for, as shown on the plan prepared by S.L. Maresca, P.E.
revised 6/16/03.
This action does not authorize or condone any current or future use, setback or other feature of the
subject property that may violate the Zoning Code, other than such uses, setbacks and other
features as are expressly addressed in this action.

Part A: AREA VARIANCE REASONS
ZONING 13C333�'¢ OF APPEAL
(1) An undesirable change will not be produced in the CHARACTER of the neighborhood or a ` '— ----__
detriment to nearby properties, if granted,because: A 10' variance is minimal in nature, and the
side requiring the variance is not used by a residential structure, it is a road, and only used as a
thoroughfare.
(2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the
applicant to pursue, other than an area variance, because: The building has been located to
minimize the activity on the westerly side of the property as to minimize any ongoing influence
to the neighbors who use the road.
(3) The amount of relief requested is not substantial because: A 10' variance is almost
unperceivable within the context of the project.
(4) The variance will NOT have an adverse effect or impact on the physical or environmental
conditions in the neighborhood or district because: The westerly property line is perceived to be
a side yard, and is technically a front yard. The traveling public will not be aware of the
difference.
(5) Has the variance been self-created? YES—However it is necessary due to the uniqueness of the
parcel with the road adjacent to the west and the desire to minimize the impact on Route 25.
(6) Additional information about the surrounding topography and building areas that relate to the
difficulty in meeting the code requirements: This legally existing lot consists of a lot area less
than what is presently required by this zone. It is further constrained by a R.O.W. on its westerly
boundary that technically creates a second front yard.
It is the owner's intention to focus his business activity on the easterly side of his property,
allowing his mobility between an adjacent related ownership site.
Additionally, owner could locate his building closer to the road(35' front on Route 25)than he
has presently chosen to locate it(80' from Route 25). He has increased his Route 25 setback
228%of what is allowable by code in order to achieve his goals and minimize the impact on
Route 25. By choosing to do this, it has necessitated the location of his structure closer to the
(25' westerly)R.O.W. than the code allows (35'). We feel that this 28%decrease in side yard is
a benefit to the community.
This is the MINIMUM that is necessary and adequate, and at the same time preserves and
protects the character of the neighborhood and the health, safety, and welfare of the community.

building will have a front yard setback of 25 feet.

a.This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 3 ..
sets of plans, accurate plot plan to scale.Fee according to schedule.
b.Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d.Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing,the extension of the permit for an
addition six months.Thereafter, a new permit shall be required.

Southold. Mr. McCarthy, good afternoon, how
12 are you?
MR. MCCARTHY: Good afternoon,
13 likewise . How' s everybody? Tom McCarthy
Management, representing the applicant , Main
• 14 Road Brokerage . Just the nature of the
application and the need for relief . Bill
15 Witski, who owns Albertson Marine and is a
principal of Main Road Brokerage is going to
16 be moving his operation from the north side
of -- I'm sorry from the south side of 25 into
17 the north side of 25 into this new facility.
This is a facility he will own, and presently
18 where he is located he does not own the
building, is a tenant and needs to move . He
19 is looking to have a warehouse and store
showroom and some bathrooms for his patrons .
20 The gist of the disapproval from the Building
Department stems from the fact that to the
21 westerly property line, his 50 foot right of
way on the west side of the property he has
22 deeded access across that right of way. It' s
not his intention through the Planning Board
23 application to use the right of way, but
because he does have a right of way across it,
24 the Building Inspector gave us a disapproval
and determined it' s a front yard. We have two
25 front yards, one is on 25 . We' re in the M2
Zone, which dictates a 35 foot setback. We

2 have, in consideration of the size of the
building, we've really moved the building back
3 off of 25 to lessen the impact to the
traveling public, down 25 we' re back 225
4 percent of what we need to be back of off of
Route 25 . The traveling public will really
5 see this building, and it will see the side of
the building as a side yard. They won' t
6 realize that technically it' s a front yard.
In the M2 zoneithe side yard minimum
7 requirement is 20 feet ; we meet that plus five
feet . So we really meet the spirit and intent
8 of the! code. If he did not have deeded access
across the right of way, we would not be in
9 front of you.
BOARD MEMBER TORTORA: You don' t
10 own the right of way?
MR. MCCARTHY: He does not own the
11 right of way, no. If he didn' t have deed
access, we wouldn' t be here we' d be continuing
12 through our process with the Planning Board,
so it' s really a technicality.
13 BOARD MEMBER ORLANDO: Does that
right of way access the railroad?
14 MR. MCCARTHY: No. I think three
or four homes are back there . Again, it meets
15 the spirit and intent of the code being a side
yard; although, it' s technically a side yard,
16 and it' s the minimum that' s necessary for Mr.
Witski and Main Road Brokerage in order to
17 accomplish their business . They have a
related company that owns an adjoining parcel
18 of property to the east, and they plan on
using these sites, although they will both be
19 independent and stand-alone from each other
for site plan purposes, they will both be used
20 physically together. We dealt with the
Planning Board and they have cross access
21 going between the two properties . You see on
the site plan there' s ADHP, they' ll be cross
22 access between the two properties . So they
would be able to bring their boats from one
23 property to the other property if they' re
being worked on or stored or what have you.
24 And that' s why this building is being pushed
as far as it is to the west ; it ' s to
25 accommodate and facilitate large boats, travel
lifts, fork lifts, what have you, between the

2 two buildings .
CHAIRWOMAN OLIVA: Some of these
3 buildings are going to be used for a dry dock?
MR. MCCARTHY: Yes, I believe he' s
4 going to use --
CHAIRWOMAN OLIVA: Big buildings .
5 MR. MCCARTHY: Yes .
CHAIRWOMAN OLIVA: Which, for big
6 boats you need big buildings .
MR. MCCARTHY: Yes . Big boats
7 need big buildings, although they' re not
looking for any variances as far as size or
8 lot coverage or height or anything like that .
We certainly -- dealing with the other
9 criteria within the zone . It' s the minimum
that' s necessary to accommodate its business
10 given the circulation plan he had laid out on
the site, with how the boats move, the travel
11 lifts, the fork lifts, et cetera .
CHAIRWOMAN OLIVA: You have to go
12 to Planning Board for site plan approval?
MR. MCCARTHY: Yes, we' re in the
13 Planning Board right now, as a matter of fact .
We' re in the Planning Board, Health Department
14 and all the other agencies .
CHAIRWOMAN OLIVA: Mrs . Tortora?
15 BOARD MEMBER TORTORA: I don' t have
a heck of a lot of questions . You already
16 submitted these plans to the Planning Board?
MR. MCCARTHY: Yes, and I believe
17 you have a memorandum from the Planning Board
in your ZBA file .
18 BOARD MEMBER TORTORA: Have they
made any initial suggestions as far as
19 landscaping?
MR. MCCARTHY: Yes, and we' re
20 working with them and incorporating that into
their landscape plan.
21 BOARD MEMBER TORTORA: The width
of the building' s 100 feet?
22 MR. MCCARTHY: Yes .
BOARD MEMBER TORTORA: Thank you
23 very much.
CHAIRWOMAN OLIVA: Mr. Orlando.
24 BOARD MEMBER ORLANDO: I have no
questions for Mr. McCarthy, but a question for
25 our own Board. Member Horning, didn' t you
mention at the last meeting about the right of

2 way; didn' t the Zoning Board make some sort of
a statement about right of ways several years
3 ago, or am I misinformed?
BOARD MEMBER HORNING: We did. We
4 came to an interpretation that a right of way
was not a front yard, property adjoining a
5 right of way wasinot a front yard.
MS . KOWALSKI : In certain
6 situations .
BOARD MEMBER ORLANDO: So it
7 wasn' t generic?
BOARD MEMBER HORNING: No.
8 MR. MCCARTHY: We've been informed
by the Building Inspector that helped us
9 interpret it was if the applicant had a deeded
right across that right of way, then it was
10 considered a front yard; if they did not have
a deeded right across it, then it was whatever
11 yard they wanted it to be, be it side or rear.
BOARD MEMBER HORNING: And we
12 ruled on a private right of way situation.
MR. MCCARTHY: And this is a
13 private right of way as well .
CHAIRWOMAN OLIVA: Mr.
14 Goehringer.
BOARD MEMBER GOEHRINGER: I was
15 over to the office this past Saturday and
Mr. Witski, Senior showed me, I believe
16 probably the map you have in front of you,
Tom, and we ran over the actual size of the
17 building, its proximity to the existing
building that' s there, of course there' s a lot
18 of boats on there right now, and I really
don' t have any questions . We know it' s a
19 boating area, and if it' s compatible with the
zone that' s it .
20 MR. MCCARTHY: Any further

In reference to the memo request for information dated October 1, 2003.
The Planning Board (PB) held a work session on October 6, 2003 and would like to
offer the following comments and concerns.
1. The PB is currently reviewing a site plan for a new 12,000 sq. ft. building with
6,500 sq. ft. of warehouse and 5,000 sq. ft. of showroom space on a 1.089
acres parcel in the MII Zone.
2. The proposed site plan use appears to be appropriate for the zone and will
need to be certified by the Building Inspector before site plan final approval.
3. The parking as proposed will be adequate to meet the Town Code
requirements for the proposed use.
4. The Planning Board is concerned about the parking on the Main Road
frontage. As proposed the parking will be elevated so it will flow with the
proposed 8' building elevation. The property is mapped on a FEMA firm
map to be in an AE flood zone. The building is proposed to be elevated
for flood proofing and to be compliant with the regulations. Proposed
grade of the parking lot above the Main Road average elevations will
pronounce the parking lot. We would like to see the parking rearranged to
be further away from the Main Road frontage, screened or lower in
proposed elevations.

Please find enclosed a copy of the Legal Notice describing your recent application. The Notice
will be published in the next issue of the Long Island Traveler-Watchman newspaper.
1) Before December 5th: Please send the enclosed Legal Notice, CERTIFIED MAIL,
RETURN RECEIPT REQUESTED, with both a letter including your telephone number and
contact person, and a copy of your map filed with this application which shows the new
construction area, to all owners of land (vacant or improved) surrounding yours, including
land across any street, railroad tracks, or right-of-way that borders your property (please see
revised Town Code Ch. 58 enclosed). Use the current addresses shown on the assessment
rolls maintained by the Town Assessors' Office located at Southold Town Hall (765-1937) and
the County Real Property Office at the County Center, Riverhead. If you know of another
address for a neighbor, you may want to send the notice to that address as well, If any letter
Is returned to you undeliverable, you are requested to make other attempts to obtain a
mailing addressor to deliver the letter to the current owner, to the best of your ability and
to confirm this in either a written statement, or at the hearing, with the returned letter.
2) Bv. December 11th: Please make arrangements to place the enclosed poster on a sign
board such as plywood or similar material, posting it at your property for seven (7) days; the
sign should remain up until the day of the hearing. Securely place the sign on your property
facing the street, no more than 10 feet from the front property line bordering the street. (If you
border more than one street or roadway, an extra sign is available for the additional front yard.)
If you need a replacement poster, please contact us.
3) Before December l2th, please either mail or deliver to our office your Affidavit of Mailing
(form enclosed) with parcel numbers noted for each, and return it with the white receipts
postmarked by the Post Office. (Also, when the green signature cards are returned to you by
the Post Office, please mail or deliver them to us before the scheduled hearing.) If any
signature card is not returned, please advise the Board at the hearing and return it when
available. These will be kept in the permanent record as proof of all Notices. Please also file
your Affidavit of Posting with our department to show proof that the sign will have been posted
for at least seven (7) days prior to the meeting.

pending with Town Departments. Presently, the Board of Appeals is reviewing an
Appeal of the Building Department's June 30, 2003 Notice of Disapproval for
variance relief (copy attached). The plans submitted for review by the ZBA are
dated 4IQ24prepared by S. L. Maresca, Consulting Engineer.
The Planning Board may be involved regarding a pre-submission review under the
site plan regulations of the Zoning Code and your comments regarding this
pending application are requested.
By way of a copy of this letter, the applicant's attorney is requested to submit the
same plans to the Building Department, and current site plan data to your
Department, if it hasn't already been submitted in a pre-submission review.
