Box 1179 Southold, New York 11971-0959 CONSERVATION ADVISORY COUNCIL TOWN OF SOUTHOLD MINUTES Tues., December 7, 2004 Down's Farm Preserve 6:00 PM A meeting of the Southold Town Conservation Advisory Council was held Tues., December 7, 2004 at Down's Farm Preserve. Present Were: Absent Were: Don Wilder, Chairman William Cook, Jr., Member Doris McGreevy, Member Jack McGreevy, Member Nicholas Dickerson, Junior Member Lauren Standish, Secretary Tom Schlichter, Member Peggy Dickerson, Trustee CALL TO ORDER Chairman Don Wilder called the meeting to order at 6:00 PM. CHAIRMAN'S ANNOUNCEMENTS REPORTS Doris McGreevy reported that she attended the Nature Conservancy meeting on Dec. 2, 2004, with the Trustees. The main topic was shoreline hardening and she brought back a binder summarizing the events of the evening. Doris will represent the CAC at the next Trustee meeting on Mon., December 20, 2004 at 7:00 PM. - APPROVAL OF MINUTES Moved by Don Wilder, seconded by Nicholas Dickerson, to Approve the Minutes of November 9, 2004. DISCUSSION AND RECOMMENDATION OF WETLAND PERMIT & COASTAL EROSION PERMIT APPLICATIONS Moved by Doris McGreevy, seconded by Don Wilder, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of MARK ANGELSON to construct an approx. 4'X 87' stairway to provide access to the shoreline from the top of the bluff. The stairway will be between 2' and 6' above the existing grade and terminate at the bottom of the bluff, +/-40' landward of the highwater mark. Located: County Rd. 48, Southold. SCTM#73-6-2 The CAC recommends Approval of the application with the Condition a detailed landscaping plan for the bluff is submitted before the permit is issued. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Jack McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of GEOFFROY PENNY to reconstruct the existing 232' bulkhead, in-place with plastic interlocking sheathing, and matching the existing elevation. Located: 570 Mason Dr., Cutchogue. SCTM#104-7-2 The CAC recommends Approval of the application with the Condition no treated lumber is used and a 30' non-turf buffer is installed landward of the bulkhead. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by William Cook, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of EDWARD JENSEN to construct a second-floor addition over the existing dwelling, construct an open porch, and a new pitched roof over existing shed. Located: 440 Sunset Way, Southold. SCTM#91-1-8 The CAC recommends Approval of the application with the condition gutters and drywells are installed to contain the roof run-off. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Doris McGreevy, it was RESOLVED to TABLE the Wetland Permit application of HERIBERT ORTH to construct a 45'X 60' two-story frame dwelling, 24'X 24' garage and 8'X 10' breezeway, pervious driveway and on-site sewage disposal system. Clear and maintain a 4' wide pervious path to proposed dock, and construct a 4'X 45' timber dock with steps to grade. Located: 640 Willis Creek Dr., Mattituck. SCTM#115-17-17.12 The CAC Tabled the application for the following reasons: the property wasn't staked trees above a 4" dia. to be removed should be labeled question whether or not the docking facility exceeds 1/3 the width of the creek The CAC requests an opportunity to re-inspect the property when properly staked. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Jack McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of STEPHEN HAWKES WITH POA FOR JANE COOKE to construct 271 linear ft. of bulkhead within 18" of the existing structure, rebuilding in-place, the steps from the top of the bulkhead to the beach. Place approx. 450 cy. of clean fill from an upland source as backfill. Located: 10025 Nassau Point Rd., Cutchogue. SCTM#119-1-11,12&13 The CAC recommends Approval of the application with the Condition the bulkhead is replaced in-place, or landward of existing, the top of the bluff is replanted, and all trees that were recently removed should be replaced. Vote of Council: Ayes: All Motion Carried Moved by William Cook, seconded by Don Wilder, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of KATHLEEN ZUAR to construct a front-entrance arbor off the southwestern corner of the existing dwelling (80 sq.ft.); remove an existing rear wood deck (85.6 sq.ft.); construct a rear screened-in porch off 4 the northwestern corner of the dwelling (192 sq.ft.); construct a rear deck off the northeastern side of the existing dwelling (540 sq.ft.); remove an existing stone driveway from within the western corner of the subject property (880 sq.ft.); construct a driveway within the southwestern section of subject property (2,100 sq.ft.); construct a wood walkway off the existing rear retaining wall measuring 4'X 35' (w/steps) and supported with ten (10) posts; and remove any and all invasive and/or non-native vegetation within the area situated from the existing rear retaining wall 35' seaward (2,600 sq.ft.) and re-vegetate with Rugosa Rose and American Beach Grass. Located: 1905 Bay Shore Rd., Greenport. SCTM#53-4-9 The CAC recommends Approval of the application with the Condition of a 10' non-turf buffer. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Nicholas Dickerson, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of ANTHONY & NICOLE SPIRIDAKlS to construct a single-family dwelling with a garage. Located: 8915 Soundview Ave., Southold. SCTM#59-6-27.3 The CAC recommends Approval to construct a single-family dwelling with the condition hay bales are placed down before construction and a limit to the number of trees removed. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Doris McGreevy, it was RESOLVED to TABLE the Wetland Permit application of CHRISTOPHER & GLORIA GROOCOCK to construct a replacement dock consisting 3' wide steps leading to a 4' wide fixed "T" dock with an overall length of 69'. Located: 1030 West Creek Ave., Cutchogue. SCTM#103-13-8 The CAC Tabled the application because the project was not staked. The CAC requests the applicant indicate what type of materials are to be used on the dock. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Don Wilder, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit application of DAVID SHANKS to construct a 1,100 sq.ft, second-story addition to the existing dwelling. Located: 1165 Calves Neck Rd., Southold. SCTM#63-7-34 Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Nicholas Dickerson, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of JOAN SHANNON to construct a new bulkhead (75'+/-) contiguous (within 18" seaward) to the existing timber bulkhead (75'+/-) along the southern property boundary. Located: 7080 Peconic Bay Blvd., Laurel. SCTM#126-11-7 The CAC recommends Approval with the Condition the bulkhead is replaced in-place and the existing buffer is maintained. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Doris McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of LEONARD M. SESSA to reconstruct a 4'X 38' timber dock and replacement of existing piles inkind/inplace. Located: 1525 Naugles Dr., Mattituck. SCTM#99-4-27 The CAC recommends Approval with the Condition the entire structure is replaced, in- place, and a protective barrier is installed in order to prevent oil and chemicals from going into Mattituck Inlet. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Nicholas Dickerson, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit application of MATINE, INC. requests a Wetland Permit to construct a 62'X 52' single-family dwelling and pervious driveway. Located: 435 Albacore Dr., Southold. SCTM#57-1-20 Vote of Council: Ayes: All Motion Carried 6 Moved by Don Wilder, seconded by Jack McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL of the Wetland Permit application of WEST LAKE ASSOC. to hydraulically dredge silted in entrance to West Lake and provide boat access. Spoil to be hydraulically pumped to adjacent empty lot on West Lake #131. Located: West Lake Dr. & Little Peconic Bay Lane, Southold. SCTM#90-1-11&90-1-13 The CAC recommends Approval of the application, however the spoil disposal area was unclear and the condition of the existing bulkheads on both sides of the entrance should be examined. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by William Cook, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of DOUGLAS CARLEN for the existing 12'X 16' deck. Located: 5550 New Suffolk Ave., Mattituck. SCTM#115-10-5 The CAC recommends Approval of the application with the Condition there is no hardening of the shoreline. Vote of Council: Ayes: All Motion Carried Moved by William Cook, seconded by Doris McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of INGEBORG MUELLER to remove and replace (in-place) approx. 102 linear ft. of existing timber bulkhead (and a +/-7' nor[hedy return) with vinyl bulkhead and backfill with approx. 15 cy. of clean sand fill to be trucked in from an upland source. Remove and replace (inkind/inplace) 4'X 9' wood platform and 3'X 10' stairs to beach. Located: 1435 Westview Dr., Mattituck. SCTM#113-9-8.1 The CAC recommends Approval of the application with the Condition of a 30' non-tuff buffer landward of the bulkhead. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Doris McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Wetland Permit application of RICHARD M. BLAIR to install a 20'X 40' in-ground swimming pool with on-grade 4' wide deck at pool perimeter. Located: 900 Mason Dr., Cutchogue. SCTM#104-7-4 The CAC recommends Approval with the Condition drywells are installed to contain the pool backwash. Vote of Council: Ayes: All Motion Carried DISCUSSION AND RECOMMENDATION OF APPLICATIONS TO AMEND PERMITS Moved by Don Wilder, seconded by Doris McGreevy, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH A CONDITION of the Amendment application of JOHN MORSE to Amend Permit #5843 to resheath (on landward side) approx. 119 linear ft. of existing timber bulkhead with vinyl sheathing and replace (within 18") approx. 125 linear ft. of existing concrete seawall with vinyl bulkhead and backfill with approx. 100 cy. of clean sand to be trucked in from an upland source. Remove (5) existing timber groins; and replace only failed sections of timber sheathing (as necessary) in existing timber jetty. Located: 820 Old Salt Rd., Mattituck. SCTM#144-5-15 The CAC recommends Approval of the application with the Condition the groins/jetties are not replaced because they are less than 50% functional. Vote of Council: Ayes: All Motion Carried The next meeting the Conservation Advisory Council has been scheduled for Tuesday, January 11,2005 at 6:00 PM at Down's Farm Preserve.
