BEING AND INTENDED TO BE the same premises conveyed to the party of the first
part by deed dated November 17, 2001, recorded December 4, 2001, in Liber 12156
cp 480.
SUBJECT TO the rights of others to use said property as set forth in deed recorded
in Suffolk County at Liber 9697 page 543 and deed dated December 18, 1986 between
Andrew L. Lettieri and Bernice T. Lettieri, as grantor and D.P. Acre, Inc., as
grantee for premises designated as SCTM 1000-023.00-01.00-018.000 and as also set
forth in deed dated November 17, 2001, recorded December 4, 2001 in Liber
12156 cp 480.
SUBJECT TO the right of use and access by others as set forth in deed dated
November 17, 2001 recorded on December 4, 2001 in Liber 12156 cp 480.
AS SET FORTH in Chapter 59 and Chapter 6 of the Town Code of the Town of
Southold OPEN SPACE acquired by the Town pursuant to the provisions of those
chapters shall not thereafter be alienated, except upon the affirmative vote
of a majority of the Town Board after a public hearing and upon the approval
of the electors of the Town voting on a proposition submitted at a special or
biennial town election. No subsequent amendment of the provisions of those
Chapters shall alter the limitations imposed upon the alienation of development
rights acquired by the Town prior to any such amendment. This covenant shall
run with the land in perpetuity.
TOGETHER with all right, title and interest, if any, of the party of the first part of, in and to any streets and roads
abutting the above-described premises to the center lines thereof; TOGETHER with the appurtenances and all the
estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein
granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the flfSt part covenants that the party· of the first part has not done or suffered anything whereby the
said premises have been incumbered in any way whatever, except as aforesaid.
AND the party of the flfSt part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part
will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund
to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment
of the cost of the improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as ifit read "parties" whenever the sense of this indenture so requires.
