1. Thar the said Board of Trustees and the Town of Southold are released from any and
aU damages, or claims for damages, of suits arising directly or indirecdy as a result of any oper-
ation performed pursuant to this permit, and the said Permittee will, at his or her own expeose,
defend any and all such suits inidaœd by thitd parties, and the said Permittee usnroes fuIIlJahility
with respect thereto, to the romplete exclusion of the Board of Trustees of the Town of Southold
2. That this Permit Is valid for a period of 24 mos. which Is coasidered to he the
estimated time required to complete the work involved, but should åtcumstances warrant, request
for an exrension may be made to the Board at a later date.
3. TIlat this Permit should he retained indefinitely, or as long as the said Permittee wishes
to maintain the strocture or project involved, to provide evidence to anyone concerned that auth·
orization was originally obtiuned.
4. That the work involved will he suhject to the inspection and approval of the Board or
its agents, and non-compUance with the provisions of the originating application, may he cause for
revocation of this Pertnit by resolution of the said Board.
5. Thar there will be no unreasonable interference with navigation as a result of the work
herein aLid1Orized.
6. That there shall he no interference with the right of the public to pass and rep... aloog
the beach between high and low water marks.
7. That if funue operations of the Town of Southold require the removal and/or alterations
In the location of the work herein authorized, or if, in the opinion of the Board of TrusteeS, the
work shall cause unreasonahle ohstruct1on to free navigation, the said Permittee will be required,
upon due notice, to remove or alter this work or project herein stated without expenses to the Town
of Southold.
8. That rhe said Board will be notified by the Permirtee ot the completion of the work auth·
orized.
9. That the Permittee will obtain all other permits and consents d:>at may he required onp-
plemental to this permit which may he subject to revoke upou failure to obtain same.

Dear Mr. Cichanowicz:
The following action was taken by the Board of Town Trustees during its Regular
Meeting held on Wednesday, December 15, 1999 regarding the above matter:
WHEREAS, David J. Cichanowicz on behalf of ED FRANCESCHINI applied to the
South old Trustees for a permit under the provisions of the Wetland Ordinance of the
Town of Southold, application dated November 26, 1999, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on December 15, 1999, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety, and general welfare of the people nf the town,

NOW THEREFORE- BE IT,
RESOLVED, that the Board of Trustees approved the application of ED
FRANCESCHINI to reshape and contour the manmade pond to make it more
environmentally appealing.
BE IT FURTHER RESOLVED, that this determination should not be considered a
determination made for any other department or agency which may also have an
application pending for the same or similar Pl·oject.
Pel'mit to construct and complete project will expire two years from the date it is signed.
Fees must be paid, if applicable, and permit issued within six months of the date of this
notification.
Two inspections al'e requÌl'ed and the Trustees are to be notified upon completion of said
project.

To whom it may concern:
This letter is in response to the application of Mr. Edward
Franceschini, for approval of "Reshaping and Contouring of the Existing
Man Made Pond", Before a permit is issued for this work, I request that the
Trustees review some concerns that I have.
Mr. Franceschini has asked permission to fill in a section of the pond
that lies on both of our properties. The sketch that has been given to me does
not show any measurements with regards to the amount of pond that will be
filled in. My concern is, what will happen to the water level on the section of
pond that is on my property? By filling this section in will the contour of the
pond be changed so that I am now left with a "Hole"? If the water level is
reduced, will the Trustees have a concern with issuing a permit so that I may
enlarge the pond on my property?
My second concern is the Drainage Pipe that runs from the pond
through my property to the Marsh. This pipe carries the overflow from the
pond to the Marsh, and the overflow from the Marsh to the Pond. If the
contour of the pond is changed will my property now have a flooding
problem, and will the Town take responsibility for this problem? Also, in a
letter from the office of the Engineer, Town of South old dated August 8,
1997. The town may be asking permission to route the rain run off from Cox
Neck Road onto my property. How will this, along with the reshaping of the
pond affect my property?
I have enclosed a copy on my survey which shows the location of my
property line and the Drainage Pipe, and a copy of the letter from the Town
Engineer. Thank you for your review of this matter.

As per your request, I have reviewed drainage requirements for the proposed construction located
on the above referenced property and I offer the following comments:
# I. The existing fresh water wetland on and adjacent to this property is large enough to handle any
additional run-off generated by the proposed construction. Surface water run-offthat is allowed to flow
into the wetlands through densely vegetated side slopes that surround the marsh should not have any
negative impacts on the quality of the wetlands.
# 2. The building envelope for this site appears to be located on the west side of the access road. Most
of the land on this side of the road has steep side slopes that should, if possible, remain undisturbed.
Currently, the overall site is stable and heavily vegetated. When and if construction begins, the process of
clearing and excavating foundations could create severe erosion problems at the site. I strongly
recommend the establishment of erosion controls to prevent silt from eroding into the wetland areas.
Siting building envelopes, wherever possible, onllatter terrains will also help to minimize potential erosion
that could even wash out the existing road under heavy rainfall conditions.
One additional item that I feel should be mentioned at this time is the Town's Road Run-Off
Program that is being coordinated through the Trustees and the Highway Department As I am sure you
already know, the Town is currently ttying to modify certain sites to prevent road run-offtrom directly
entering our creeks and bays. The section of Cox Neck Road immediately adjacent to the access road and
wetlands mentioned above is one of those locations. The hope is that the owner of the property currently
under your review, as well as other property owners with property adjacent to the wetland, will not object
to run-off from Cox Neck Road entering the wetland first. This will provide additional filtration and
containment of the run-off. The high point or maximum level of the pond will still be controlled by an
overflow culvert that allows water to directly enter the creek under high volume or overflow conditions.
If you still have questions concerning drainage and run-off generated at this site, please arrange a
time so that we can meet and discuss them further.

A meeting of the Southold Town Conservation Advisory Council was held Monday,
December 6, 1999. The following recommendations were made:

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
