existing 6'x16' floating dock and installing a 6'x20' floating dock secured with two(2) 8"diameter
pilings;the installation of one(1) 10"diameter tie-off pile eight(8)feet seaward of the proposed float;

Conforms to the application for a Trustees Permit heretofore filed in this
office Dated April 29, 1997 pursuant to which Trustees Wetland Permit#4750
Dated June 16, 1997,was issued and Amended on May 15,2019 and conforms to all of the
requirements and conditions of the applicable provisions of law. The project
for which this certificate is being issued is for the construction of a 24' seaward extension of the
existingdock by constructing a 4'x20' fixed timber catwalk extension onto the seaward end of the
existing 4'x38' catwalk-,relocating the existing 3'x12' hinged d ramp to the seaward end of the extended
catwalk-,removing the existing 6'x16' floating dock and installing a 6'x20' floating dock secured with

Dear Mr. Herrmann:
The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wednesday, May 15, 2019:
WHEREAS, En Consultants, on behalf of RANDI & ALFRED SILBER applied to the
Southold Town Trustees for an Amendment to Wetland Permit#4750 under the
provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the
Town of Southold, application dated March 5, 2019, and,
WHEREAS, said application was referred to the Southold Town-Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application be
found Inconsistent with the LWRP, and,
WHEREAS, the Board of Trustees has furthered Policies 6.3, 9.3 and 9.4 of the Local
Waterfront Revitalization Program to the greatest extent possible through the imposition
of the following Best Management Practice requirements: an existing 10' non-turf buffer
and the beneficial increase in water depth due to extension, and
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on May 15, 2019, at which time all interested persons were given an
opportunity to be heard, and,
a ;
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management
Practice requirement imposed above, the Board of Trustees deems the action to be
Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5
of the Southold Town Code, and,
BE IT FURTHER
RESOLVED, that the Board of Trustees APPROVE the Amendment to Wetland Permit
#4750 to constructa' 24' seaward extension of the existing dock by constructing a 4'x20'
fixed timber catwalk extension onto the seaward end of the existing 4'x38' catwalk;
relocating the existing 3'x12' hinged ramp to the seaward end of the extended catwalk;
removing the existing 6'x16' floating dock and installing a 6'x20' floating dock secured
with two (2) 8" diameter pilings; the installation of one (1) 10" diameter tie-off pile eight
(8) feet seaward of the proposed float; and for the connection of water and electricity to
the dock; with the condition that if dock surface needs replacement in the future that _ _-

prepared by En-Consultants, dated March 1, 2019, and stamped approved on May 15,
2019.

NOTIFICATION OF OTHER PERMITTEE OBLIGATIONS
NATURAL RESOURCE PERMIT CONDITIONS - Apply to the Following
Permits: TIDAL WETLANDS
1. Conformance With-Plans All activities authorized by this permit must be in strict conformance
with the approved plans submitted by the applicant or applicant's agent as part of the permit application.
Such approved plans were prepared by En-Consultants on 3/1/2019 and stamped "NYSDEC Approved"
on 4/22/2019.
2. Post Permit Sign The permit sign enclosed with this permit shall be posted in a conspicuous

location on the worksite and adequately protected from the weather.
3. Notice of Commencement At least 48 hours prior to commencement of the project,the permittee
ari contractor shall sign and return the-to-p-portion of the enclosed notificafiori form certifying that they
are fully aware of and understand all terms and conditions of this permit. Within 30 days of completion
of project,the bottom portion of the form must also be signed and returned, along with photographs of
the completed work.
4. No Construction Debris in Wetland or Adjacent Area Any debris or excess material from
construction of this project shall be completely removed from the adjacent area(upland)and removed to
an approved upland area for disposal. No debris is permitted in wetlands and/or protected buffer areas.
S. Materials Disposed at Upland Site Any demolition debris, excess construction materials, and/or
excess excavated materials shall be immediately and completely disposed of in an authorized solid waste
management facility. These materials shall be suitably stabilized as not to re-enter any water body,
wetland or wetland adjacent area.
6. No Disturbance to Vegetated Tidal Wetlands There shall be no disturbance to vegetated tidal
wetlands or protected buffer areas as a result of the permitted activities.
7. Storage of Equipment,Materials The storage of construction equipment and materials shall be
confined to the upland area landward of the bulkhead or on a barge.

8. Dock, Catwalk Size Dock or catwalk shall not exceed 4 feet in width and shall be a minimum of 4
feet above grade(as measured from ground to bottom of dock/catwalk decking) over tidal wetland areas.
9. Wood Preservatives
a. Pressure treated wood used for construction of in-water structures must have undergone a
treatment process approved(stamped or otherwise marked as certified)by the American Wood .
Preservative-Association.
b. Wood treated with Pentachlorophenol (PCP)must not be used in marine or brackish waters. Wood
treated with PCP must be aged in the open air for at least three months prior to in-water use.
c. The use of creosote treated wood is prohibited both in the water and upland areas.
d. Chromated Copper Arsenate(CCA)pressure treated wood must be clean and free of CCA surface
deposits. Wood with surface deposits must be washed for at least 5 minutes under running water
prior to use. The washing must occur greater than 100 feet landward of any regulated wetland
and/or water body. (Note "E." below for handling wash water.)
e. Any wood debris such as sawdust or wash water must not,enter any water body, including wetlands
or protected buffer areas.
10. No Floats,Ramps in Vegetated Tidal Wetlands Floats and ramps may not rest on or be stored in
any vegetated tidal wetland.
11. Float Installation The float shall be installed only at the approved location with a minimum water
depth of 2%feet, measured at apparent low tide.
12. No Prop Dredging Prop dredging, or the act of utilizing and/or directing the propeller or
propulsion system of a motorized vessel and/or the water-borne forces created by said propeller or
propulsion system,to excavate or displace_existing.bottom sediment_and benthic habitat for the director _
indirect purpose of establishing or increasing water depth, is a regulated activity and is not authorized by
this permit. Prop dredging is strictly prohibited without further written authorization(permit,
modification or amendment)from the department.
13. No Dredging or Excavation No dredging,excavating or other alteration of shoreline or
underwater areas is authorized by this permit,nor shall issuance of this permit be construed to suggest
that the Department will issue a permit for such activities in the(future.
14. No Permanent Structures on Dock No permanent structures shall be installed on
dock/catwalk/float without first obtaining written Department approval (permit,modification,or
amendment).
15. Docks at Property Lines Docks/catwalks/floats must not:
a. extend laterally beyond property lines,
b. interfere with navigation, or
c. interfere with other landowners riparian rights.

16. Pilings at Property Lines Pilings shall not:
a. extend laterally beyond property lines,
b. interfere with navigation, or
c. interfere with other landowners riparian rights.
17. No Structures on Pilings No structures,other than structures specifically authorized by this
permit, shall be constructed on pilings without further authorization from the department(permit,
modification or amendment).
18. Install,Maintain Erosion Controls Necessary erosion control measures, i.e., straw bales, silt
fencing, etc., are to be placed on the downslope edge of any disturbed area. This sediment barrier is to
be put in place before any disturbance of the ground occurs and is to be maintained in good and
functional condition until thick vegetative cover is established.
19. Maintain Erosion Controls All erosion control devices shall be maintained in good and functional
'condition until the project has been completed and the area has been stabilized.
20. State May Order Removal or Alteration of Work If future operations by the State of New York
require an alteration in the position of the structure or work herein authorized, or if,in the opinion of the
Department of Environmental Conservation it shall cause unreasonable obstruction to the free navigation
of said waters or flood flows or endanger the health, safety or welfare of the people of the State,or cause
loss or destruction of the natural resources of the State,the owner may be ordered by the Department to
remove or alter the structural work,obstructions, or hazards caused thereby without expense to the State,
and if, upon the expiration or revocation of this permit,the structure,fill, excavation, or other
modification of the watercourse hereby authorized shall not be completed,the owners, shall,without
expense to the State, and to such extent and in such time and manner as the Department of
Environmental Conservation may require,remove all or any portion of the uncompleted structure or fill
and restore to its former condition_.the navigable and flood capacity of the watercourse. No claim shall
be made against the State of New York on account of any such removal or alteration.-
21.
lteration:21. State May Require Site Restoration If upon the expiration or revocation of this permit,the
! project hereby authorized has not been completed,the applicant shall, without expense to the State, and
to such extent and in such timd and manner as the Department of Environmental Conservation may
lawfully require,remove all or any portion of the uncompleted structure or fill and restore the site to its
former condition. No claim shall be made against the State of New York on account of any such
removal or alteration.
22. Precautions Against Contamination of Waters All necessary precautions shall be taken to
preclude contamination of any wetland or waterway by suspended solids, sediments,fuels, solvents,
lubricants, epoxy coatings,paints, concrete, leachate or any other environmentally deleterious materials
associated with the project.

23. State Not Liable for Damage The State of New York shall in no case be liable for any damage or
injury to the structure or work herein authorized which may be caused by or result from future operations
undertaken by the State for the conservation or improvement of navigation, or for other purposes, and no
claim or right to compensation shall accrue from any such damage.
GENERAL CONDITIONS - Apply to ALL Authorized Permits:
1. Facility Inspection by The Department The permitted site or facility, including relevant records, is
subject to inspection at reasonable hours and intervals by an authorized representative of the Department
of Environmental Conservation(the Department)to determine whether the permittee is complying with
this permit and the ECL. Such representative may order the work suspended pursuant to ECL 71- 0301
and SAPA 401(3).
The permittee shall provide a person to accompany the Department's representative during an inspection
to the permit area when requested by the Department.
A copy of this permit,including all referenced maps, drawings and special conditions,must be available
for inspection by the Department at all times at the project site or facility. Failure to produce a copy of
the permit upon request by a Department representative is a violation of this permit.
2. Relationship of this Permit to Other Department Orders and Determinations Unless expressly
provided for by the Department, issuance of this permit does not modify, supersede or rescind any order
or determination previously issued by the Department or any of the terms,conditions or requirements
contained in such order or determination.
- - -- -- -3. Applications For Permit Renewals,Modifications or Transfers- The permittee must submit a -
separate written application to the Department for permit renewal,modification or transfer of this
permit. Such application must include any forms or supplemental information the Department requires.
Any renewal,modification or transfer granted by the Department must be in writing. Submission of
applications for permit renewal,modification or transfer are to be submitted to:

4. Submission of Renewal Application The permittee must submit a renewal application at least 30
days before permit expiration for the following permit authorizations: Tidal Wetlands.
5. Permit Modifications,Suspensions and Revocations by the Department The Department
reserves the right to exercise all available authority to modify, suspend or revoke this permit. The
grounds for modification, suspension or revocation include:
a. materially false or inaccurate statements in the permit application or supporting papers;

b. failure by the permittee to comply with any terms or conditions of the permit;
c. exceeding the scope of the project as described in the permit application;

d. -newly discovered material information or a material change in environmental conditions,relevant
technology or applicable law or regulations since the issuance of the existing permit;
e. noncompliance with previously issued permit conditions, orders of the commissioner,any
provisions of the Environmental Conservation Law or regulations of the Department related to
the permitted activity.-
6. Permit Transfer Permits are transferrable unless specifically prohibited by statute,regulation or
another permit condition. 'Applications for permit transfer should be submitted prior to actual transfer of
ownership.
NOTIFICATION OF OTHER PERMITTEE OBLIGATIONS
Item A: Permittee Accepts Legal Responsibility and Agrees to Indemnification
The permittee,excepting state or federal agencies, expressly agrees to indemnify and hold harmless the
Department of Environmental Conservation of the State of New York,its representatives, employees,
and agents ("DEC")for all claims, suits, actions, and damages,to the extent attributable to the
permittee's acts or omissions in connection with the permittee's undertaking of activities in connection
with, or operation and maintenance of,the facility or facilities authorized by the permit whether in
compliance or not in compliance with the terms and conditions of the permit. This indemnification does
not extend to any claims, suits,actions,or damages to the extent attributable to DEC's own negligent or
intentional acts or omissions, or to any claims, suits,or actions naming the DEC and arising under

Item B: Permittee's Contractors to Comply with Permit
The permittee is responsible for informing its independent contractors,employees, agents and assigns of
their responsibility to comply with this permit, including all special conditions while acting as the
.permittee's agent with respect to the permitted activities, and such persons shall be subject to the same
sanctions for violations of the Environmental Conservation Law as those prescribed for the permittee.
Item C: Permittee Responsible for Obtaining Other Required Permits
The permittee is responsible for obtaining any other permits,approvals, lands, easements and rights-of-
way that may be required to carry out the activities that are authorized by this permit.
Item D: No Right to Trespass or Interfere with Riparian Rights
This permit does not convey to the permittee any right to trespass upon the lands or interfere with the
riparian rights of others in order to perform the permitted work nor does it authorize the impairment of
any rights,title, or interest in real or personal property held or vested in a person not a party to the

The proposed action is located within a New York State Department of State Significant Fish
and Wildlife Habitat Area, a New York State Critical Environmental Area and a Peconic
Estuary Critical Natural Resource Area.
En-Consultants on behalf of RANDI &ALFRED SILBER requests an Amendment to Wetland
Permit#4750 to construct a 24' seaward extension of the existing dock by constructing a 4'x20'
fixed timber catwalk extension onto the seaward end of the existing 4'x38' catwalk; relocating the
existing 3'x12' hinged ramp to the seaward end of the extended catwalk; removing the existing
6'x16' floating dock and installing a 6'x20' floating dock secured with two (2) 8" diameter pilings; the
installation of one (1) 10" diameter tie-off pile eight (8) feet seaward of the proposed float; and for
the connection of water and electricity to the dock. Located: 1570 Mason Drive, Cutchogue.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the proposed action is INCONSISTENT with LWRP Policy 9.4, and therefore, INCONSISTENT with
the LWRP.
Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board
of Trustees laws and regulations for all Andros Patent and other lands under
their jurisdiction

1. Comply with Trustee regulations and recommendations as set forth in
Trustee permit conditions
The applicant fails to prove that the action meets the following requirements § 275-11 Construction
and operation standards C. 2 (d) of the Southold Town Code:
(d) Review and approval of dock applications. Before issuing a permit for a dock structure, the
Trustees shall consider whether the dock will have any of the following harmful effects:
[2] Whether the dock will unduly interfere with the public use of waterways for swimming,
boating, fishing, shellfishing, waterskiing and other water-dependent activities
This information has not been provided, rather, the submitted materials focus on
the physical attributes of the dock.
[6] Whether the dock will cause habitat fragmentation and loss of significant coastal fish and
wildlife habitats;
The proposed action is located within a New York State Critical Environmental
Area. At the discretion of the Board of Trustees, any operations proposed in
critical environmental areas (§ 275-2) may be subject to more stringent
requirements than detailed in this section. Such requirements may include, but
are not limited to, denial of certain operations, shortening or reducing the size of
structures, and increasing the width of non-disturbance buffers. It is
} recommended that in the event the action is approved, a non-disturbance be
established to mitigate the local impacts from the dock structure.
[11] Whether the cumulative impacts of a residential and commercial dock will change the
waterway or the environment and whether alternate design, construction, and location of the
dock will minimize cumulative impacts, and
If approved, the extension of the dock structure would set precedent.
[12] Whether adequate facilities are available to boat owners and/or operators for fueling,
discharge of waste and rubbish, electrical service and water service.
No such facilities are proposed or discussed.
9.3 Preserve the public interest in and use of lands and waters held in public trust by the state
and the Town of Southold.
` A. Limit grants, leases, easements, permits or lesser interest in lands underwater in
accordance with an assessment of potential adverse impacts of the proposed use,
structure, or facility on public interest in public lands under water.
The extension of the dock structure will result in a net decrease in public access
on public underwater lands.
9.4 Assure public access to public trust lands and navigable waters.
E. Provide access to, and reasonable recreational use of, navigable waters and public trust
lands under water.
3. Obstruction of navigable waters and underwater lands is limited.

b. to the minimum necessary for access to navigable waters. The minimum is
determined by evaluating the following factors:
(vi) whether or not alternative means to gain access are available.
The applicant presently enjoys access to the waterbody via an
existing dock structure. The extension of the dock to
accommodate vessel draft at the expense of public access is not
supported by this policy. Alternative docking and mooring
options should be considered.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
I. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its si nig ficant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus, each answer must be explained in detail, listing both supporting and non-

At mean lower low water, nearly the entire floating dock of the existing permitted dock(WP
#4750) lies in water less than 2 feet deep, which is insufficient for the owner's vessel and well
below the 30-inch water depth recommended for floating docks by the New York State
Department of Environmental Conservation in their "Tidal Wetlands Guidance Document [for]
Residential Catwalks and Docks." But because the existing dock ends well landward of the
seaward extent of the adjoining dock to the east and the pier line(s) established by the seaward
extents of the neighboring docks to the east and west, the dock can be extended seaward to a
depth of 30 inches at mean lower low water in a way that the'entire dock facility remains situated
inside the pier line; well within the one-third width of the waterway; and compliant in all other
ways with the "construction and operation standards" for docks set forth by Town Code Section
275-11(C)(2). And the catwalk extension and new float would both be constructed with
untreated decking. Therefore, the proposed extension of the existing permitted dock would not
result in a "fragmentation of ecological communities;"nor result in the physical loss, degradation,
or functional loss of ecological components or have any other significant adverse impacts on the
adjacent tidal wetland ecocsystem.

Please find enclosed an application to amend the captioned Wetlands Permit, which was issued
on June 16, 1997, and transferred to the applicants on February 15, 1997.
At mean lower low water, nearly the entire floating dock lies in water less than 2 feet deep,
which is insufficient for the owner's vessel and well below the 30-inch water depth
recommended for floating docks by the New York State Department of Environmental
Conservation in their "Tidal Wetlands Guidance Document [for] Residential Catwalks and
Docks." But because the existing dock ends well landward of the seaward extent of the
adjoining dock to the east and the pier line(s) established by the seaward extents of the
neighboring docks to the east and west, the dock can be extended seaward to a depth of 30 inches
at mean lower low water in a way that the entire dock facility remains situated inside the pier
line; well within the one-third width of the waterway; and compliant in all other ways with the

Specifically, the applicant proposes an overall 24' seaward extension of the dock by constructing
a 20' extension to the existing catwalk, relocating the existing ramp to the end of the extended
catwalk, and installing a 6' x 20' floating dock in place of the existing 6' x 16' float to be
removed. Also proposed is a tie-off pile positioned 8 feet seaward of the end of the float, all as
depicted on the project plan prepared by En-Consultants, dated March 1, 2019.

Dear Mr. Fitzgerald:
The following action was taken by the Board of Town Trustees
during its regular meeting held on Wednesday, May 28, 1997
regarding the above matter:
WHEREAS, Proper-T Permit Services on behalf of GRACE KAUFMANN
applied to the Southold Town Trustees for a permit under the
provisions of the Wetland Ordinance of the Town of Southold,
application dated April 29, 1997, and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on May 28, 1997, at which time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 37-18 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,

RESOLVED, that the Board of Trustees grant a Wetland Permit to
construct a fixed walkway 4' X 38" , hinged ramp 3' X 12' and
floating dock 6 ' X 16' secure floating dock with two 2"
galvanized pipes. Close seaward end of boat ramp in existing
wood retaining wall, 2 c.y. of clean sand as per plans dated
June 6, 1997 , and,
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project. _
Permit to construct project will expire two years from the date
it is signed. Fees must be paid, if applicable, and permit
issued within six months of the date of this notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

Dear Ms. Kolecheski,
The Southold Town Board of Trustees always tries to allow the
applicant access from the upland into the water for recreation
purposes. However, the size of the structure is one that is of
great concern to our board. Since the Town owns the bottom by
virtue of a Colonial Patent, we try to minimize the structure as
much as possible. our decision was based on this fact plus the
applicant' s wishes.
I am enclosing some of our rules and regulations regarding
docks, wharfs, etc.
