Dear Ms. Mesiano,
The following action was taken by the Board of Town Trustees
during a Regular Meeting, held on March 22, 2000, regarding the
above matter:
WHEREAS, KERMIT JOHNS, applied to the Southold Town Trustees
for a permit under the provision$ of the Wetland Ordinance of
the Town of Southold, application dated December 29 1999 and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on March 22, 2000, at which time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 97-18 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,

RESOLVED, that the Board of Trustees approves the application of
KERMIT JOHNS to construct a 4' X 90' fixed timber walk with 4' X
8' steps down to water. Located: 1800 Broadwaters Road,
Cutchogue.
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct and complete proiect will expire two years
from the date it is signed. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.
FEES: 4' X 90' walkway = 360' X $3 = $1,080
4' X 8' steps = 32' X $3 = $96
TOTAL: 1,176.00

SOUTHOLD TOWN
CONSERVATION ADVISORY COUNCIL
At the meeting of the Southold Town Conservation Advisory Council held Tuesday, January 18,
2000, the following recommendation was made:
Moved by Bill McDermott, seconded by Richard Smith, it was
RESOLVED to recommend to the Southold Town Board of Trustees DISAPPROVAL of the
Wetland Permit Application of KERMIT JOHNS 104-9-10 to construct a 4'X 100' fixed timber
walk, 3'X 12' ramp and a 6'X 20' float on 6" diameter low-profile piles to be installed ITom
existing retaining wall over tidal wetlands to Haywaters Cove, inkind/inplace repair/replacement
of existing +/-30' timber wall and steps.
1800 Broadwaters Rd., Cutchogue
The CAC recommends Disapproval because the proposed structure would limit public access to
the marsh system.
The trade-off of the potential negative impact on the wetland system from the proposed catwalk
for available water depth is not warranted.
Vote of Council. Ayes: All
