Dear Mr. Haje:
The following action was taken by the Board of Town Trustees
during its regular meeting held on October 23, 1996 regarding
the above matter:
WHEREAS, En-Consultants on behalf of BRUNO CIPPITELLI applied to
the Southold Town Trustees for a permit under the provisions of
the Wetland Ordinance of the Town of Southold, application dated
August 15, 1996, and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on October 23, 1996, at which time
all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
chapter 37-18 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,

NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees grant a Wetland Permit to
construct a timber dock consisting of a 4' X 88' fixed elevated
walk, (4' above grade of marsh), a 3' X 14' hinged ramp, and a
6' X 20' float with 2 pile dolphins as per surVey dated 10/9/96.
Subject to the following: If dock is longer than a line drawn
between docks on either side, dock must be cut back to be no
longer then that line, and,
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct project will expire two years from the date
it is signed. Fees must be paid, if applicable, and permit
issued within six months of the date of this notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

The following recommendation was adopted at the meeting of the Southold Town
Conservation Advisory Council on September 23, 1996 :

Moved by Robert Keith, seconded by Betty Wells, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
of the Wetland Permit Application of BRUNO CIPPITELLI 104-10-7 to construct
a timber dock consisting of a 4' x 88' fixed elevated (4' above grade of marsh)
walk; 3' x 14' hinged ramp; 6' x 20' float secured by (2) pile dolphins.

Appl. for dock at Broadwaters Cove
Dear Mr. Krupski,
I represent Jerry and Marion Gelbwak, owners of the property immediately to the
east of the applicant in the above captioned matter. The Gelbwaks have serious concerns
about the dock in question.
As you know, the drawing submitted with this application is not to scale and it is
therefore difficult to detennine the impact of the dock on adjacent property owners. The
application does show that the catwalk is proposed to be 4 feet ITom the eastern edge of
the Cippitelli property. There is an existing dock in a right of way on the eastern edge of
the Gelbwak property. Permitting the Cippitelli dock to be sited as requested would place
a dock on each edge of the Gelbwak property. Furthermore, there is a small cottage on
the northwest comer of the Gelbwak property and the dock in question would be directly
in ITont of this cottage. We request that the dock be sited in the middle of the 71 feet of
creek ITontage available to the Cippitellis.
The application shows a fixed 88 foot long catwalk to the 14 foot ramp leading to
the 20 foot float. This is a total of 122 feet of structure Again because of the lack of
scale it is impossible to detennine how far this structure will project into the creek. As
you will note, there are three docks existent in this comer of Broadwaters creek. There is
a potential for three more docks since neither the Gelbwaks, Cippitelli nor the property to
the west ofCippitelli have docks. To avoid further disturbance ofthe limited flow in this
creek, and to provide safer navigation for aU, the docks added should be as short a structure
as possible. There is no appreciable channel on this side of the creek so there is no
advantage to a long dock trying to reach greater water depth. We request that the length
of the dock be limited to that of the existing docks to the east and west.
I will attend the hearing on September 25, so that we may discuss this matter
further, if you desire.
