Box 1179 Southold, New York 11971 Telephone (516) 765-1892 Fax (516) 765-1823 BOARD OF TOWN TRUSTEES TOWN OF SOUTHOLD November 21, 1997 En-Consultants Inc. 1329 North Sea Road Southampton NY 11968 Re: ARTHUR BURNS SCTM U05-1-4 Dear Mr. Haje, The following action was taken by the Board of Town Trustees during its Regular Meeting held on November 18, 1997, regarding the above matter: WHEREAS, ARTHUR BURNS, applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ornin~nce of the Town of Southold, application dated September 19, 1997 and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on November 18, 1997, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and" WHEREAS, the structure complies with the standard set forth in Chapter 97-18 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, - . . NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees approves the application of ARTHUR BURNS to construct approx. 200 l.f. of timber rer~ining wall, construct 2- 20+/-' of angled returns to be armored with 2-3 ton armor stone on east & west sides of property, 200 c.y. of clean sand will be trucked in and remove existing remnants of old dilapidated bulkhead. BE IT FURTHER RESOLVED that this determination should not be considered a determination made for any other Department or Agency which may also have an application pending for the same· or similar project. Permit to construct and complete project will expire two years from the date it is signed. Fees must be paid, if applic"hlF>, and permit issued within six months of the date of this notification. All work would occur landward of the spring high tide line of Long Island Sound at Mattituck, Town of Southold, Suffolk County, New York. Our review indicates that since the proposed work does not appear to include dredging or construction activities in or over any navigable waters of the United States, the placement of any dredged or fill material in any waters of the United States (including coastal or inland wetlands) or the accomplishment of any work affecting the course, location, condition or capacity of such areas, a Department of the Army permit will not be required. Care should be taken so that any fill or construction materials, including debris, do not enter the waterway to become a drift or pollution hazard. During construction, concrete or leachate shall not escape or be discharged, nor shall washings from transit mix trucks, mixers, or other devices enter tidal wetlands and or protected buffer areas. 2. Any debris or excess material from construction of this project shall be completely removed from the adjacent area (upland) and removed to an approved upland area for disposal. No debris is permitted in tidal wetlands and or protected buffer areas. 3. The storage of construction equipment and materials shall be confined to within the project work site and or upland areas greater than linear feet from the tidal wetland boundary. 4. All fill shall consist of "clean" sand. gravel, or soil (not asphalt, flyash, broken concrete or demolition debris). 5. No excavation of the beach is authorized for the purpose of obtaining fill or stone materials. 6. All peripheral berms, cofferdams, rock revetments, seawalls, gabions, bulkheads etc. shall be completed prior to placement of any fill material behind such structures. 7. Ifthis goal is not met, the applicant shall re-evaluate the restoration project in order to determine how to meet the mitigation goal and submit plans to be approved to the Bureau of Marine Habitat Protection, Building 40 SUNY, Stony Brook, NY I 1790- 2356. 8. 9. The permittee shall cause all exposed faces or disturbed areas to be vegetated to prevent soil erosion prior to the project completion or expiration date of this permit, whichever comes first. 10. SUPPLEMENTARY SPECIAL CONDITIONS following conditions apply to all Tidal Wetlands; Freshwater Wetlands; Coastal Erosion Management; and Wild, scenic, and Recreational Rivers Pe~its: A copy of this permit, including all conditions and approved plans, shall be available at the project site whenever authorized work is in progress. The permit sign enclosed with the permit shall be protected from the weather and posted in a conspicuous location at the work site until all authorized work has been complet~d. B. The permittee shall require that any contractor, project engineer, or other person responsible for the overall supervision of this project reads, understands, and complies with this permit and all its general, special, and supplementary special conditions. Any failure to comply precisely with all of the terms and conditions of this permit, unless authorized in wTiting, shall be treated as a violation of the Environmental Conservation Law. If any of the permit conditions are unclear, the permittee shall contact the Division of Regulatory Affairs at the address on page one or telephone (516) 444-0365. c. If project design modifications become necessary after permit issuance, the permittee shall submit L~e appropriate plan changes for approval by the Regional Permit Administrator prior to undertaking any such mOdifications. The permittee is advised that substantial modification may require submission of a new application for permit. D. At least 48 hours prior to commencement of the project, the permittee and contractor shall sign and return the top portion of the enclosed notification form certifying that they are fully aware of and understand all terms and conditions of this permit. Within 30 days of completion of the permitted work, the bottom po~ion of that form shall also be signed and returned, along with photographs of the completed work and, if required, a survey. E. For projects involving activities to be undertaken in phases over a period of more than one year, the permittee shall notify the Regicnal Permit Administrator in writing at least 48 hours prior to recommencing work in subseque~t years. F. PROJECT DESCRIPTION Arthur Burns SCTM# 1000-105-01-04 Construct an approximately 200 linear foot timber retaining wall. Construct two(2) +/- 20' angled returns to be armored with 1-3 ton armor stone on the east and west sides of property. Approximately 200 cubic yards of clean sand will be trucked in from an approved upland source. Equipment access will be gained via Sound Beach Drive; travel will occur along the beach; material will be staged on site until it is used. Remove existing remnants of old, dilapidated bulkhead. . . ADDENDUM TO FCAF: ARTHUR BURNS 28) Because the project property is located adjacent to the State designated littoral zone tidal wetlands of Long Island Sound, the project must be consistent with Policy 44. The proposêd project will be consistent with this policy because it will not affect benefits derived ftom the adjacent, unvegetated tidal wetlands, and will require a Tidal Wetlands Act pennit ftom the NYSDEC. 2f) Because the proposed retaining wall will be constructed within the rocky beach environment of Long Island Sound, the project must be consistent with Policy 12. The project entails 1) the removal of an existing, dilapidated bulkhead and consequently the liberation of approximately 42 feet ofbeachftont; and 2) the construction of an erosion control structure which will stabilize the toe of a currently eroding bluff. Therefore, the project will be consistent Policy 12, as it will help to maintain the natural protective features on the site, i.e., the beach and bluff. 38) Because the proposed activity will occur at a waterfront site, it must be consistent with Policies 2, 21, and 22. The proposed rock revetment will be consistent with Policy 22 in that it will not alter or affect existing water-related recreation on Long Island Sound. Policies 2 and 21 do not apply to the project. 3c) Because the rock revetment is an erosion control structure, the proposed project must be consistent with Policies 13, 14, and 16. Pursuant to Policy 14, construction of the revetment will not cause or increase erosion at adjacent properties. Because the adjacent bluffs are currently unstabilized, the retaining wall will be constructed with two angled returns, which will be armored with 1 - 3 ton stone. This construction design is intended to minimize potential downdrift scour effects more commonly seen in sandy dune environments along the Atlantic Ocean. The net effect of the project should only be to prevent further erosion of the subject bluff, without causing adverse effects to adjacent properties. The revetment will be designed and constructed in accordance with generalIy accepted engineering practice, and thus, excluding any catastrophic occurrences, has a reasonable probability of controllíng erosion for at least thirty years.
