Pert of the comideradon for the issuance of the Permit does understand and proscribe to the fob
lowing:
I. That the said Board of Trustees and the Town of Southold m'e relmsed from any ~
aH damages, nr dnlm~ for damages, of suits arising directly or indire~dy as · result of any oper-
ation performed porsuant to tbls permit, and the said Permietee will, at bis or he~ own expem~
defend any and all such su~tsinitiated by ~ pa~ie~ and the said Peemirtee assumes fall liability
with respect thereto, to the complete e~clusion of the Board of Trmtees of the Town of Southold

estimated time required to complete the work involved, but should dreumstances wat~-ang request

3. That this Permit should be retained indeflni~ely, or as long as the said Petailttee wishes
to maintain the structnre or projec~ involved, to provide evidence to ~nyone concerned tha~ anth-
orizatinn w~s originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or
it~ agents, and non-compUance with the provisions of the originating application, may be cause for
revocation of this Permit by resolution of the said Board.
5. That there will be no tmreasonable interference with mtvigatlon as a r~ult of the work
herein affthorized.
6. That there shall be no interference with the rigi~t of the pubUc to pass and repass along
the beach between high and low water marks.
7. That ff future operations of the Town of Sonthold require the removal and/or alterntions
in the location of the work herein anthoctzed~ or if, in the opinion of the l[k~nrd of Tmstee~ the
work shall cause unreasonable obstmmon to free navigation, the said Petmittee will be t~lalted~
upon due notice, to remove or alter this work or project herein stated without e~pemes to the To~n
of Southold.

Amendment to Permit #5098 to construct two 10'X 15' additions to the deck.

At the meeting of the Southold Town Conservation Advisory Council held Monday, September
20, 1999, the following recommendation was made:
