Davis 26659 Main Road Orient, NY 11957 RE: BRIAN BRILLE SCTM #18-3-30.4 Dear Mr. Davis, The Southold Town Board of Trustees reviewed the survey dated and received in our office on August 20, 1999 and determined that the construction of a proposed single family dwelling and pool, to be out of the Trustee Wetland jurisdiction, under Chapter 97, and Coastal Erosion Hazacd Area jurisdiction under Chapter 37, of the Town Code. However, any activity within 75' of the Wetland line would require permits 'from this office. This determination ks not a determination from any other agency. This Firm represents Brian Brille who is seeking to construct a new single family residence on the aforementioned property. Enclosed herewith for your review please find the following materials: (l) Two stamped surveys of subject parcel prepared by Joseph A. lngegno, Land Surveyor, last revised July 15, 1999 showing all proposed structures and existing contour lines; (2) Photos showing the location of the proposed structures; the location of the property's pond; and, the property's bluff and beach front; (3) Location map; and (4) Endorsement: A jurisdictional inquiry is hereby made pursuant to Chapter 97: Wetlands contained within the Town Code. On behalf of Mr. Brille, I request a Letter of Non- Jurisdiction pursuant to Chapter 97-13; Definitions: Wetlands (A)(3) on the basis that the proposed structures are located greater than 75 feet from the apparent high water mark (tidal wetland boundary), and pursuant to Chapter 97-13; Definitions: Wetlands (B)(2) on the basis that the proposed structures are located greater than 75 feet from the most landward edge of the flagged freshwater wetlands.
