KEVIN MCLAIJGHLIN: I'm here on behalf of Mr. ScarmaW, my client has been served with a notice of
vtolat~n cbn.cer~ng a fence that was constructed appwx: 25 yoarsago, which everyone has admitted he
obtaified all.of the.necessary permits at that tlrae to erect. Basically he has done nothing with the fence since
then l~hi¢l~st.,stopped there. How the violation that he is served with is violation #Sec. 9720 of the code

ago, ~ fenice ~ns. To now try to say that we are in violation of this section of the Code is ludierous.
We,re not do~ anything. We haven't done anything in 25 years. Under this logic, if you had a house, let's
say~ tliat wits'75ifeet back and didn't need any kind of permits, and you lost 15 feet of Beacb~out due to a storm,

got some.:pictures,hat I would like to mb. mit, most of which are the neighborhood around where the fence is
located, I;know some of you were there, we met at the site, some month or six weeks ago, and I t~hinlr if you
remember Being there and if you look at the pictures, there was some discussion at the site oft his be/rig an
obstn!aion~ and' I would agree that.certainly in some sense of the word that is an obstruction but there have to
Be six or eight obstructions right in'the pictures of this property. There are groins going out, there are cement
piers l~ohig :Out:, there are fences going out, and I think if you take a look at all of these pictures you'll see that
all'of*hlngs :are ~bstructiom, all of which may or may not have permits, I'm not aware, all I know is that my
client'i fence had a permit when it was built. The last two pictures I would like to submit to this Board are

beach erosion., t would like to submit these to the Board.

the'field, you showed us a Building Permit for a chain-linked fence?
KEVIN MCLAUGHHN: Yes, I have a copy ortho ..... a Building Permit was issued in 1973 to erect a 6 foot
high chain-linked fence, that is my only copy, and I would be happy to submit a copy to the Board, tomorrow, I
can drop one off.

KEVIN MCLAUC:ff-ILIN: Now I understand there are no operations presently being conducted nor have been
conducted for 25 years and therefore with all due respect I submit this Board has no jurisdiction.

had and the other Board members ...

· fiT, MURPHY:,.; I live at 2165 Bay Ave. in East Marion, about two houses in from the bay. On Memorial Day
weekend, it was my child, I was the one who issued the complaint who went underneath the dock and who got

caught around that fence that was well into the water past the high-water mark, and speaking to the people
regarding the coastal rights in the State of New York. I have an excopt from the Newsday, it's in
the Newsday for the past couple of weeks now, that in New York, it is every citizen's birthright and in theory it
means that the lowliest peon is entitled to walk on the beach in front of the wealthiest millionaire's oceanfront
land house. So that fence is blocking my access to walk along the beach, and it is blocking my access and that
is how my child got caught-up under the fence. There is another dock that's falling down fight nex~ to that
adjacent piece of property and if everyone has access in the State of New York to walk freely in the water and
on the beach and the high-water mark down, then how can that fence be allowed to r~aln there, aI our access.
In that neighborhood there are predominat¢ly elderly people or people who have children. IfI want to take a
walk along the beach with my children I want them ??? to that fence or anything else. The other groins and the
piers that go out, any one can walk over them in that area. This poses a threat to anyone who wants to walk
freely along the beach with their family members. I gave you a copy of all the photos I have regarding that and
how far that goe~ into the water and we did discuss that.

there is no CAC comments here. I think we wanted a non-tuff'buffer to the 10' contour. Ifthe applicant wants
to clear her view, which I assungd he would, he should'appeal to us in writing and show us what he wants
afterwards, lqon-turfmeans that he can put landscaping in front.
IIM F1TZOER2,I.D: May I make a comment on that? I gave you some months an article, I think it was
published'by the Cooperative Extension Service, and the poini of the article was that well-maLm_~i~ed groin was
a better deterrent to bad !htn~s going in water than a non-tort'buffer.
TRUSr~.,. KRUPSKI: AcO~lly I did read that and I do remember it, having an agricultural background and a
degree in plato science, I find that article to be an over-simplification and sort of a real generic One-sided, sort
cfa'little slice of the whole picture and I didn't quite agree with the way it worded. I think in the long nm as far
as propen'y maintenance goes, I think the non-turf buffer is the safest bet towards keeping nutrients entering the
~reek. and like I said,'they can landscape it, and clear for a view. I did not agree with that article.

FRANCINE PRATO: I have a question, I 'ma neighbor there too. Can you just define to me a "non-tuff
buffer".
TRUS'r~/,E KRUPSKI: Well, some of the problems with turf going all the way to the water is that the nm-off
would naturally flow much quicker to the water, of course, this property, most waterffonI properties are
rmturally graded towards the water. So anything that you put on the low end is going to run, on heavy rains,
directly into the creek. If you put in the non-turf buffer, you can put in plantings, flowing, non-flowing, native
grasses, and all kinds of things you can put in that will slow the water coming down and you won't get that
quick flush in heavy in rain of nutrients or whatever is put on the lawn.

The following action was taken by the Board of Town Trustees
during its regular meeting held on September 30, 1993 regarding
the above matter:
WHEREAS, ANTHONY SCARMATO applied to the Southold Town
Trustees for a permit under the provisions of the Wetland
Ordinance of the Town of Southold, application dated June 7,
1993 and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and,
WHEREAS, a public hearing was held by the Town Trustees with
respect to said application on Thursday, Septeraber 30, 1993 at
which time all interested persons were given an opportunity to
be heard, and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,

WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the Board has determined that the project as proposed

Repair in place 73 I.f. of easterly return. Approximately 100 c.y.
of clean fill to be trucked in from upland source. Construct a 4' x
4' platform, 4' wide steps from proposed retaining wall to beach.
Distance between new and old retaining wall is necessitated by
presence of improvements such as fish pond located close behind
existing wall which will not allow tie back system to extend very far
landward. To compensate, new wall will be 4' out so a 10' tie rod
and deadman system can be utilized to afford adequate lateral
stability.
The Council strongly recommend ~1 because the applicant is
proposing to take 4' of beach; there ~s a strong chance the beach
would be destroyed; and would create "pockets" along the side of

structure. The Council suggests replacement be in kind/in place or
within 18".

16{ hinged ramp; 6' x 16' float secured by two pilings. Place
approximately 10 c.y. of sand and grade into a berm approximately 3'
wide at the base and 1.5' high to extend the width of the parcel (68
+/- '), above AHW and wetlands. Following grading, berm will be
planted with Ammorphilla breviligulata on 18" centers. Purpose of
berm is to prevent occasional flooding of upland as occurred during
12/92 and 3/93.
The Council recommends disapproval of the berm because it could
destroy the existing marsh. The Council recommends approval of
the dock.
