The following action was taken by the Board of Town Trustees
during its regular meeting held on April 27, 1995 regarding the
above matter:
WHEREAS, Proper-T Services, on behalf of MICHAEL SLADE,
applied to the Southold Town Trustees for a permit under the
provisions of the Wetland Ordinance of the Town of Southold,
application dated February 10, 1995 and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on ~P~IL ~7 1995, at which time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 37-18 of the Southold Town Code, which will be listed on
a separate page, and,

Dear Mr. Krupski:
I would appreciate the opportunity to address the Board at the Work Session on October 29th
with regard to my request for an extension of this pern1Ït. I fully understand that the original
pennit expired six months ago, but I ask your indulgence in reconsidering the requirement that
a new pern1Ït must be applied for.
On 2/19/97, when the Board acted upon my request for an anlendment to the original pennit,
there were only two months left before its expiration. It was all oversight on my part that an
extension was not applied for in conjunction with the amendment, because it should have been
obvious to everyone that the work could not be completed before the exiJlting 4/27/97 expira-
tion date. The NYSDEC Pern1Ït had not been received and we were still in discussions with
them over the details of the project as amended at their "reqm:st". Even if we had the DEC
pennit, it is not likely that the work could have been completed in the remaining time at that
time of year.
The basis for my request is that pennits issued by the Trustees are, according to the Tenns and
Conditions, "valid for a period of 24 mos. which is considered to be the estimated time re-
quired to complete the work involved, but should circumstances warrant, request for an exten-
sion may be made to the Board at a later date." The point is, 1 suggest, that the expiration
dating is flexible, as it should be, and is conditioned on the re<lSOnable ability of the applicant to
cause the completion of the work in the time specified. The fact that both the Board and I
overlooked the pending expiration when the amendment was being reviewed does not change
any of the physical aspects of the project, and the new dating I seek is the same as it would
have been if it had been extended at the time of the amendment.

Construct rock revetment approximately 135 feet long and from 12 feet to 20 feet wide, ap-
proximately. Dredge specified area around docks to depth of from four feet below mean low
water to seven feet below mean low water yielding approximately 350 cubic yards of spoil;
maintenance dredge over a ten-year period as necessary to maintain depths.

FULL ENVIRONMENTAL ASSESSMENT FORM

Purpose: The full EAF is designed to help applicants and agencies determine. in an orderly manner. whether a project
or action may be significant. The question of whether an action may be significant is not always easy to answer. Frequent·
Iy. there are aspects of a project that are subjective or unmeasureable. It is also understood that those who determine
significance may have little or no formal knowledge of the environment or may be technically expert in environmental
analysis. In addition, many who have knowledge in one particular area may not be aware of the broader concems affecting
the question of significance.
The full EAF is intended to provide a method whereby applicants and agencies can be assured thát the determination
process has been orderly, comprehensive in nature, yet flexible to allow introduction of information to fit a project or action.
Full EAF Components: The full EAF is comprised of three parts:
Part 1: Provides objective data and information about a given project and its site. By identifying bilsic project
data, it assists a reviewer in the analysis that takes place in Parts 2 and 3.
Part 2: Focuses on identifying the range of possible impacts that may occur from a project or action. It provides
guidance as to whether an impact is likely to be considered small to moderate or whether it is a potentially·
large impact. The form also identifies whether an impact can be mitigated or reduced
Part 3: If any impact in Part 2 is identified as potentially-large. then Part 3 is used to evaluate whether or not the
impact is actually important.

sections ofbulkheading on Dr. Slade's property. We finally obtained DEC approval on 9/9/97.
In the meantime, the Trustee pennit expired, unnoticed, through an oversight on my part.

The following recommendation was passed at the Southold Town Conservation
Advisory Council meeting which was held Friday, February 14, 1997:

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH A STIPULATION AND A CONCERN of the Amendment to Permit request
of MICHAEL SLADE 110-7-26 to amend permit to include the following:
1. Replace in kind/in place approximately 40 I. f. of existing bulkhead
2. Reconstruct approximately 125 I.f. of existing bulkhead by adding
new sheathing on the seaward side of the piles.
3. Replace in kind/in place 4 existing functioning docks.
The Council recommends approval with the stipulation that the revetment join
the existing retaining wall (as was in the original plan. The CAC wonders
why the original plan is not being followed)
The Council is also concerned that the new bulkhead is greater than 18" from
the old bulkhead and wonder should this be allowed,

RESOLVED that the Southold Town Board of Trustees approve the
request for an Amendment to Permit #4440 to construct approx.
135' X 12' to 20' wide rock revetment instead of bulkhead to tie
into two existing bulkheads as per DEC requirement and dredge
area around docks to depth of from 4' below MLW to 7' below
MLW yielding approx. 350 c.y. of spoil and a 10 year
maintenance period as necessary, and that any excess spoil be
given to the Highway Department. Located: 1435 West Road,
Cutchogue.
This does not constitute any other permits from any other
agencies.

permit pursuant to Section 10 of the Rivers and Harbors Act of 1899 (33 USC 403).

A detailed description and plans of the applicant's activity are enclosed to assist in your review.
The decision whether to issue a permit will be based on an evaluation of the probable impact,
including cumulative impacts, of the proposed activity on the public interest. That decision will reflect
the national concern for both protection and utilization of important resources. The benefits which
reasonably may be expected to accrue from the proposal must be balanced against its reasonably
foreseeable detriments. All factors which may be relevant to the proposal will be considered including
the cumulative effects thereof; among those are conservation, economics, aesthetics, general
environmental concerns, wetlands, historical properties, fish and wildlife values, floodplain values, land
use, navigation, shoreline erosion and accretion, recreation, water supply and conservation, water quality,
energy needs, safety, food and fiber production, mineral needs, consideration of property ownership and,
in general, the needs and welfare of the people.
The Corps of Engineers is soliciting comments from the public; Federal, state, and local agencies
and officials; Indian Tribes; and other interested parties in order to consider and evaluate the impacts of
this proposed activity. Any comments received will be considered by the Corps of Engineers to determine
whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments
are used to assess impacts on endangered species, historic properties, water quality, general
environmental effects, and the other public interest factors listed above. Comments are used in
preparation of an Environmental Assessment and/or an Environmental Impact Statement pursuant to the
National Environmental Policy Act. Comments are also used to determine the need for a public hearing
and to determine the overall public interest of the proposed activity.
ALL COMMENTS REGARDING THE PERMIT APPLICATION MUST BE PREPARED IN
WRITING AND MAILED TO REACH THIS OFFICE BEFORE THE EXPIRATION DATE OF THIS
NOTICE, otherwise, it will be presumed that there are no objections to the activity.
Any person may request, in writing, before this public notice expires, that a public hearing be
held to collect information necessary to consider this application. Requests for public hearings shall state,
with particularity, the reasons why a public hearing should be held. It should be noted that information

WORK DESCRIPTION
The applicant, Michael Slade, has requested Department of the Anny authorization to construct
bullchead and dredge and excavate material from Wickham Creek, Little Peconic Bay at
Cutchogue, Town of Southold, Suffolk County, New York with subsequent upland disposal.
The work would involve construction of approximately 13S linear feet of new bulkhead above
the mean high water mark in line with adjacent bulkheads and excavate and dredge, with ten
years maintenance, approximately 7S cubic yards of material from an irregularly shaped area
waterward of the new bullchead to a depth of 4 feet below mean low water. Three additional
dredging events are anticipated during the ten year life of permit, removing approximately 60
cubic yards of material per event. The material from initial and subsequent dredging events
would be used as backfill material behind the proposed bullchead.
The stated purpose of this project is to protect the applicant's property from effects of erosion,
and to provide adequate mooring depths.

RESOLVED that pursuant to Article 8 of the Environmental Conservation
Law, State Environmental Quality Review and 6NYCRR Part 617,
Section 617.10 and Chapter 44 of the Code of the Town of Southold,
notice is hereby given that the Southold Town Trustees,' as Lead
Agency for the action described below, has determined that the
project will not have a significant effect on the environment.
Please take further notice that this declaration should not be
considered a determination made for any other department or agency
which may also have an application pending for the same or similar
project.
TYPE OF ACTION: Type: I
DESCRIPTION OF ACTION: Applicant requests a Wetland Permit to
construct approx. 135' of new bulkhead joining two existing bulkhead
structures, excavate and dredge small area adjacent to new bulkhead
using spoil to backfill bulkhead. Located 1435 West Road, Cutchogue.
LOCATION: SCTM #1000-110-7-26
REASONS SUPPORTING THIS DETERMINATION:
1. An on site inspection has been conducted by the Board of
Trustees.
2. An environmental assessment, submitted by the applicant and
reviewed and completed by the Board of Trustees, has indicated that
no significant adverse effects to the environment are likely to occur
should the project be implemented as planned.

The CAC recommends approval with the stipulation that the 50' buffer be
maintained from a Trustees established wetland line (the CAC disagrees with
the line shown on the submitted plan); that there be no further disturbance of
the buffer than that which has already occurred; that roof runoff be controlled
by installing drywells; and that silt fence with haybales be used during
construction.

The Southold Town Conservation Advisory Council did not make an inspection
of and therefore cannot make a recommendation concerning the Wetland
Application of LOUIS M. BACON 13~-3-5 to restore South Pond (SH-5).
Phragmites and root mass shall be removed (excavated) and trucked to an
upland site (greater than 100' from freshwater wetlands and greater than 300'
from tidal wetlands) for disposal. For disposal a pit shall be excavated,
material shall be placed in pit, covered with a PVC liner and a ~, - 6' layer
of soil shall be placed on top of liner. In restoring pond, approximately
17,000 c. y. of soil shall be removed to create depths of 1 1/2' - 16'. Pond
shall be planted with rooted emergent vegetation. Existing road located within
adjacent area shall be utilized during excavation then replanted and
abandoned. Creenbrier and dead vegetation shall be removed from adjacent
area (100') and a wetlands transitional area shall be created. An area of
Phragmites located southwest of pond along Creat Peconic Bay shall be hand cut
to assure that no seed material returns to pond. Approximately 1,000 c. y. of
clean sand shall be placed in area located between pond and Creat Peconic Bay
to strengthen shoreline from storm surge. Area shall then be planted with
American Beach Crass.

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH CONDITIONS of the Wetland Application of MICHAEL SLADE 110-7-26
to construct approximately 135' of new bulkhead joining two existing bulkhead
structures. Excavate and dredge small area adjacent to new bulkhead, using
spoil to backfill bulkhead.
The CAC recommends approval with the assumption that the side with
the slips Is zoned M1; if it is not then the CAC recommends disapproval of
the dredging.

as that furnished at a public hearing.
Our preliminary determination is that the activity for which authorization is sought herein is not
likely to affect any Federally endangered or threatened species or their critical habitat. However,
pursuant to Section 7 of the Endangered Species Act (16 U.S.C. 1531), the District Engineer is consulting
with the appropriate Federal agency to determine the presence of and potential impacts to listed species
in the project area or their critical habitat.
Based upon a review of the latest published version of the National Register of Historic Places,
there are no known sites eligible for, or included in, the Register within the permit area. Presently
unknown archeological, scientific, prehistorical, or historical data may be lost by work accomplished
under the required pennit.
Reviews of activities pursuant to Section 404 of the Clean Water Act will include application of
the guidelines promulgated by the Administrator, U. S. Environmental Protection Agency, under authority
of Section 404 (b) of the Clean Water Act and the applicant will obtain a water quality certificate or
waiver from the appropriate state agency in accordance with Section 401 of the Clean Water Act prior
to a pennit decision.
Pursuant to Section 307 (c) of the Coastal Zone Management Act of 1972 as amended [16 U.S.C.
1456 (c)], for activities under consideration that are located within the coastal zone of a state which has
a federally approved coastal zone management program, the applicant has certified in the permit
a¡¡plication that the activity complies with, and will be conducted in a manner that is consistent with, the
approved state coastal zone management program. By this public notice, we are requesting the state's
concurrence with, objection to, or waiver of the applicant's certification. No permit decision will be
made until one of these actions occur. For activities within the coastal zone of New York State, the
applicant's certification and accompanying infonnation is available from the Consistency Coordinator,
New York State Department of State, Division of Coastal Resources and Waterfront Revitalization,
Coastal Zone Management Program, 162 Washington Avenue, Albany, New York 12231, Telephone
(518) 474-3642. Comments regarding the applicant's certification, and copies of any letters to this office
commenting upon this proposal, should be so addressed.
In addition to any required water quality certificate and coastal zone management program
concurrence, the applicant has obtained or requested the following governmental authorization for the
