the State of New York, 1893; and Chapter 404 of the Laws of the
State of New York 1952; and the Southold Town Ordinance en-
titled "REGULATING AND THE PLACING OF OBSTRUCTIONS
IN AND ON TOWN WATERS AND PUBLIC LANDS and the

of South old Town Trustees authorizes and permits the following:
Wetland Permit to construct an 1150 s. f. second floor addition
and 128 s. f. second floor deck, to be built in the confines
of the existing footprint.
all in accord.ance with the detailed specifications as presented in
the originating application.

1. ThaI the said Board of Trustees and the Town of Southold are rdcased from any and
aU damages, or claims for damages, of suirs arising directly or Indirecdy as a result of any oper-
ation performed pursuant to this permit, and the said Permittee will, at his or her own expense,
defend any and all such suirs Initiated by third parties, and the said Permittee assumes full liahility
with respecl thereto, to the complete exclusion of the Board of T1U5teeS of the Town of Southold
2. ThaI this Permit is valid for a period of 24 mos. which is coasideœd to he the
estimated time required to complete the work Involved, but should drC\1lDSW)ces warrant, reqnest
for an extension may be made to the Board at a later date.

3. l1,.t this Permit should he retained Indefinitely, or as long as the said Penni~ wishes
to maintain the structure or project involv~, to provide evidence to anyone concerned that aud:J.·
orization was originally obtained.
4. That the work Involved will he subject to the Inspection and approval of the Board or
irs agenls, and non-compliance with the provisions of the originating application, may be cause for
revocation of this Pennil by resolution of the said Board.
5. Thar Ibere will he no unreasonable interference with navigation as a result of the work
herein au"thorized.
6. That there shall he no interference with the right of the public to pus and repass along
the heach betweeo high and low water marks.
7. That if furure operations of the Town of Southold require the removal and/or alterations
In the location of the work herein authorized, or If, In the opinion of the Board of Trustees, the
work shall cause unreasonable obstruction to free navigation, the said Permittee will he required,
upon due notice, to remove or alter this work or project herein stated without e%pI!DSes to the Town
of Southold.
8. ThaI the said Board will he notified by the Permittee 01 the completion of the work auth·
orized.
9. ThaI Ihe Permittee wiU obtain aU other permits and consents tbat may he required sup-
plemental to this permit which may be subject to revoke upon failure to obtain same.

Dear Mr. Gesiak:
The following action was taken by the Board of Town Trustees
during its regular meeting held on April 21, 1999 regarding the
above matter:
WHEREAS, LESZEK T. GESIAK applied to the Southold Town Trustees
for a permit under the provisions of the Wetland Ordinance of
the Town of southold, application dated March 31, 1999 and,
WHEREAS, said application was referred to the southold Town
Conservation Advisory Council for their findings and
recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on April 21, 1999, at which time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 37-18 of the southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,

NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees grant a Wetland Permit to
LEsZEK T. GESIAK to construct an 1150 s.f. second floor addition
and 128 s.f. second floor deck, to be built in the confines of
the existing footprint.
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct and complete project will expire two years
from the date it is signed. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

1999 the following recommendation was made:

RESOL VED to recommend to the Southold Town Board of Trustees APPROVAL of the
Wetland Permit Application for LESZEK T. GESIAK 53-5-11.2 to construct a 1150 sf second
