HomeMy WebLinkAboutCSEA AGREEMENT by and between CSEA, Town of Southold Unit, Suffolk County Local 852, Local 1000, AFSCME, AFL-CIO ("CSEA') and the Town of Southold ("Town") dated December 14, 2004. 1. The so-called Stewart Grievance, dated February 5, 2003, is hereby withdrawn, with prejudice. 2. The so-called Neudeck Grievance, dated February 3, 2003, is hereby withdrawn, with prejudice. The Highway Superintendent shall appoint Bruce Stewart to the position of Highway Labor Crew Leader, at top step, effective the work day following the actual retirement date of the incumbent in the Highway Labor Crew Leader position, which is now anticipated to be December 31, 2004. The parties agree that Neudeck is covered by Contract Section 8.2, including its requirement that the assigmnent of employees to overtime is done on a rotating basis, based upon seniority within job classification within each department, provided that the elnployee, in the opinion of the department head, is competent by reason of ability, training, experience and fitness to properly perform the duties of the position. The CSEA agrees that no grievances will be filed regarding the lack ora posting for, or lack of compliance with any other procedural requirements regarding, the Highway Labor Crew Leader position that will be filled on or about January 1, 2005, or about the selection of Stewart to fill that position. This Agreement represents the totality of the parties' agreements regarding the issues involved in the Stewart and Neudeck grievances. There are no other agreements, oral or otherwise. Even though it has entered into this Agreement, the Town continues to assert that the Highway Superintendent had the fight to take the action that led to the grievances being filed, and that nothing contained in this Agreement in any way should be construed as an admission that the Town violated the Town/CSEA contract. Likewise, even though it has entered into this Agreement, the CSEA continues to assert that the Highway Superintendent did not have the right to take the action that led to the grievances being filed, and that nothing contained in this Agreement in any way should be construed as an admission that the Town did not violate the Town./CSEA contract.
