Freshwater "wetlands" on the building lot are actually wet only
intermittently; the small area meets the technical definition of
a freshwater wetland because of some of the vegetation existing
there. The area will be protected during construction and it is
intended that it will survive unchanged. ~

We continue to encounter problems in obtaining the required approval from flae Suffolk
County Health Depar'anent. In ahat regard a significant delay resulted fi'om a neighbor's lack of
cooperation in providing information as to ~he locafiun of his well and septic system. In addi-
tion, the project which appeared to be near ~o~aoval by the Health D~p~,h.ent was handed
over to a new analyst~reviewer and we find ounselves back to where we were almost a year
ago.

Dear Sir:
We request a one-year extension on thc referenced permit. It is duc to expire on 10/27/96.
The reason for this req~t is that the Health Department has not yet approved thc project. The
application to the Health Department for approval to construct a private sewage disposal sys-
tem was submitted to them on April 12, 1995, and has been the submit of constant discussion
ever since. The matter is still unresolved.
We feel that an extension of one year will allow sufficient time to resolve the matter with the
Health Department and to then begin construction in the spring of 1997.

Dear Mr. Fitzgerald,
The following action was taken by the Board of Town Trustees
during its regular meeting held on October 27, 1994 regarding
the above matter:
WHEREAS, ANDREAS P~LIOURIS applied to the Southold Town
Trustees for a permit under the provisions of the Wetland
Ordinance of the Town of Southold, application dated September
27, 1994
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on October 27, 1994 at which time
all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed a~d are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approves the application of
ANDREAS PALIOURIS to construct a single-family dwelling,
within building envelope shown on survey dated March 17, 1993.
This permit subject to conditions that: 1) a continuous row of
hay bales shall be placed along the wetland side of construction
site, 2) re-vegetate any disturbed area, and 3) driveway be of
a pervious matter 30' from edge of wetlands.
Permit to construct project will expire two years from the date
it is signed. Fees must be paid, if applicable, and permit
issued within six months of the date of this notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

Dear Sir:
As you requested, here is a new signed and sealed survey show-
ing the proposed building envelope and the tentative locations
of the private sewage disposal system and the well.
These locations are tentative since the property owner to the
northwest(Jacoby) was uncooperative and would not disclose the
location of the well and septic system on that property. In ad-
dition, property owners opposite, across Private Road, could
not be questioned: one spoke no English and one was not home.

for reinforcing.
The Council recommends approval with the provision the applicant slope
the top away from the bluff to keep runoff from going over the top edge of the
bluff; the applicant plant a temporary cover of winter rye; and maintain a
buffer along the edge of the bluff.

fill (approximately 10 c.y.). To be constructed using 6" x 6" timbers.
The Council recommends approval provided the applicant plant beach grass
behind the existing bulkhead.

The Trustees are aware of the situation that exists concerning
the property described above: the owner has been cited under
the Town's Wetlands regulations.
On 3/16/94 I met with the Trustees at the property. Also
present was the contractor engaged to perform the necessary
work. Mr. Krupski placed stakes indicating the desired
boundary of the reworked depression in the earth.
The work has been performed and the site is available for
inspection by the Trustees. If an inspection is necessary to
permit the Trustees to advise the Court before the Court's
review of the case, I would appreciate it if this could be
arranged.

The Trustees inspected the wetland impacted by the above
referenced unauthorized operation on September 23, 1993 to
ascertain whether the restoration undertaken was sufficient. The
Board feels that there was insufficient fill removed from the
site of this violation.
It is our recommendation that Mr. Paliouras schedule to have
the Bay Constable or a Trustees(s) present on the site to direct
the final restoration so it is satisfactory to this office.

As you are aware, on September 2, 1992, Kent McCarthy issued a
violation complaint against Andres and Stacy Paliouras for conducting
activities in the wetlands without a Trustee permit in violation of Section
97-20 of the Town's Wetlands Ordinance. This charge has been pending in the
Justice Court since that time.
I have recently been contacted by Jay Schondebare, the attorney for
the defendant in this action, who has advised me that the defendant's have
restored the site to its natural condition. I would request, therefore, that
you confirm Mr. Schondebare's assertion by arranging for the Bay Constable
and/or the Trustees to inspect the site. Thereafter, depending upon the
result of the Town's inspection, advise me as to whether the Trustees are
seeking a fine in this matter and, if so, the amount of the fine necessary to
serve the interests of justice.

The $outhold Town Trustees visited the site of Stacy
Paliouras at the above reference property at 435 Private Rd
~26, Southold on October 15, 1992 and concur with the second
violation of the wetlands ordinance on site in that rocks were
placed within 75' of the freshwater wetland on the property.
The Trustees spoke with Mrs. Paliouras this date and have no
objection to her applying for a wetland permit wherein she
should accurately describe her proposed restoration plans.
Until this plan is received and approved she should not conduct
any activity within 75' of the wetland without the express
written permission of this Board.
The Trustees are concerned that a second violation has taken
place here and have no objection to the prosecution of these
violations at this time or after wetland restoration.

This date I met on site with Jim Fitzgerald of Proper-T
Service and placed 9 flags at the landward limit of the wetland
so that the boundary could be surveyed for use in the proposed
wetland application. The wetland consists of ~-F. Pepperbush,
Arrowwood, Shadbush, ~lueberry and similar shrub species. I
indicated to Mr. Fitzgerald that a more formal flagging by Mr.
Anderson would be proper if my determination was called into
question.

In response to the within Notice of Violation issued by Bay Constable Kent B. McCarthy
dated June 9, 1992, it is hereby respectfully requested that a hearing be granted to the owner
for purposes of rescinding said Notice.
First of all, it is beyond one's imagination as to what Bay Constable McCarthy was
doing on a Tuesday afternoon on a private dirt road, nowhere near the water, across from the
affordable houses on Soundview Avenue. It seems to be a total waste of time, effort and
money to have a highly paid Bay Constable riding up and down a private dirt road, checking
on violations of the Town code. Why is he not on the Bay where he is needed?
I represented the owner when he purchased the property in December, 1990 at which
Hme he obtained a new survey which does not reflect any wetlands or water of any nature. A
certificate of occupancy was issued in 1984 and in 1981 the Planning Board approved the sub-
division of the lots by Linda Kowalski, the present Secretary of the Zoning Board of Appeals.
Nowhere in any of the records does it reflect any fresh water or wetlands on the property.
I personally examined the property yesterday and it is dear that there is no fresh water
pond on the property. There is some dirty, stagnant, putrid water on the property in a Iow
ditch drainage area which could hardly fall under the definition of "wetlands" as defined in
Section 97-13 of the Code. I also represented Keith Gilbride, the adjacent neighbor, and if one
is familiar with the area, it would be known that there is a heavy concentration of day
resulting in poor drainage and an ac,cumulation of ground water in the area. An accumulation
of ground water is not wetlands and the Bay Constable should know the difference.

I would like to have a full and detailed disclosure as to why Constable McCarthy was
called upon to investigate this matter and why he issued a Notice of Violation, knowing full
well that the water on the property was merely ground water and not a flesh water wetland.
A copy of the tax map is enclosed, as well as the other documents referred to and it is
dear that the only fresh water pond around is Great Pond, to the north.
Under the circumstances, I am requesting that the Notice of Violation be resdnded
immediately or that a resolution be signed directing the issuance of a permit under Section 97-
20 and 97-22.
