Meeting of September 24, 1974
The Southold Town Board met at the office of Supervisor Albert M.
Martocc~ia,' 16 South Street, Greenport, New York, at 3:00 P.M.,
Tuesday, September 24, 1974, with the following present:
Supervisor Albert M. Martocchia
Councilman James H. Rich, Jr.
Councilman James Homan
Justice Martin' Suter
Justice Louis M. Demarest
Town Attorney Robert W. Tasker
Superintendent of Highways Raymond C. Dean
Town Clerk Albert W. Richmond
Absent: Justice Francis T. Doyen
Moved by Justice Suter, seconded by Councilman Rich, it was
RESOLVED that the Southold Town Board minutes of September 10, 1974
be approved as submitted.
Vote of the Town Board: Ayes: Supervisor Mar%occhia, Councilman
Rich, Councilman Homan, Justice Suter, Justice Demarest.
Moved by Justice Demarest, seconded by Councilman Homan, it was
RESOLVED that the next regular meetings of the Southold Town Board
will be held at 9:00 A.M., Friday, October 4, 1974 for the purpose
of presenting the Tentative 1975 ~udget, and 3:00 P.M., Tuesday,
October 8, 1974, at the office of Su~pervisor A~bert M. Martocchia,
16 South Street, Greenpo~t, New York .......
Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman

On motion of Councilman Rich, seconded by Councilman Homan, it was
RESOLVED that the report of the Southold Town Police Chief for the
month of August 1974 be accepted and placed on file.

Rich, Councilman Homart, Justice Suter, Justice Demarest.
Moved by Councilman Rich, seconded by Councilman Homan, it was
RESOLVED that a recess be called at 3:30 P.M. for the purpose of
holding a'wetland hearing on the application of Ralph C. Condit.

Moved by Councilman Homart, seconded by Councilman Rich,
WHEREAS Victor Ales has applied to the Town Board-for a single
trailer permit dated SePtember 9, 1974,
NOW, THEREPORE, BE IT RESOLVED that the application of Victor Ales
to locate a single trailer on his property at 8925 Nassau Point
Road, Cutchogue, New York be denied.
Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman
Rich, Councilman Homart, Justice Suter, Justice Demarest.
On motion of Councilman Homan, seconded by Councilman Rich, it was
RESOLVED that $20,000.00 be transferred from A1990.4 ContinGent
Account, General Fund to A35t0.2 Control of Animal's, Equipment,
General Fund.

Rich, Councilman Homan, Justice Suter, Justice Demarest.
Moved by Councilman ~toman,-seconded by Justice Suter, it was
RESOLVED that the South0ld ToWn Board accept the withdrawal by
Dr. Donald P. Brickley of his-wetland application no. 17. ~,

On motion of Justice Demarest, .seconded by CounciLman Rich,
WHEREAS, the New York State Department-of Transportation has
made known its-intention for the rebuilding of Mill Creek Bridge
under project titled - PIN 0041.26

RESOLVED, that the Town Board of the Town of Southold does hereby
authorize the New York State Department of Transportation in conformance
with Article 3, Section 4.2 of the New York State Highway Law to
utilize the following streets within the jurisdictional limits of
the Town of Southold as detours permitting two-way traffic during
the period of construction:
For eastbound traffic -
From the intersection of State Route 25 and Boisseau Avenue
northerly along Boisseau Avenue to the intersection of North Road,
County Road 27.
From the intersection of North Road, County Road 27, and
Albertson Raive southerly along Albertson Drive to Cassidy Lane
(now part of Albertson Drive) to State Route 25.
For westbound traffic follows the same route in the reverse
order.
The. entire eastbound traffic detour being-a total length of
7900± feet or t.5~ m~les and the wesqbound traffic detour being
the same, mn the Town of Southold, the County of Suffolk, ~and
BE IT FURTHER ~RESOLVED: That the State of New York will bear
the cost of maintaining the above-mentioned streets only during the
period of necessity they are to ~be used as detours. -

On motion of Justice Suter, seconded by Councilman Homan,
WHEREAS the Burton Potter Post ~185, American Legion, Greenpott,
New York has applied to the Town Clerk for an Amended Bingo License, and
WHEREAS the Town Board has examined the application, and after
investigation, duly made findings and determinations as required
by law,
NOW, THEREFORE, BE IT RESOLVED that the Supervisor be and he hereby
is authorized and directed to execute on behalf of the Town Board
the findings and determinations as Kequired by law, and it is further
RESOLVED that the Town Clerk be and he hereby is directed to issue
an Amended Bingo License to the Burton Potter Post ~185-, American
Legion, Greenport, New York.

On motion of Councilman Rich, seconded by Justice Demarest,
WHEREAS Louis Zaino and Armando Sardelli by application dated
June 5, 1974 petitioned the Town Board of the Town of Southold for
a change of zone on certain property situated at Peconic from "A"
Residential and Agricultural District to "B-i" General Bu~in ess
District, and
WHEREAS the said petition was referred to the Southold Town Planning
Board and Suffolk County Department of Planning for official
recommendation and report, and
WHEREAS the Town Board, pursuant to due notice, held a public
hearing thereon on the 27th day of August, 1974 at 8:00 P.M., at
which time all interested persons were given an opportunity to be heard,
NOW, THEREFORE, BE IT RESOLVED that the application of Louis Zai~o
and Armando Sardelli for a change of zone from "A" Residential and
AgricultUral Dfstrict to "B-i" General Business Distr~ct on property
s~tuated on the corner of Ma'in ($Sat~) Road~and Indian NeCk Lane,
Peconic, New York, be and hereby is denied.

WHEREAS a petition was received from Saint Peter's Lu~herah Church
requesting a Change of zone on certain property at Chapel Lane,
Greenport, New York, said petition for a change from ~'A? Residential
~d A~ricuttural District to "M-t" General Multiple Residence District,
NOW, THEREFORE, BE IT RESOLVED that the Town' Clerk of the Town of
Southold be and he hereby ~s directed to transmit this application
to the PlanNing Board ~n accordance with Article ~XV; Section 100-150
Of the. Zoning Ordinance of the Town of Southold.

Moved by Justice Demarest, secOnded by Councilman Rich,
WHEREAS Oscar Goldin has applied to the Town Board for a single
trailer renewal permit dated September 15, 1974,
NOW, THEREFORE, BE IT RESOLVED that the application of Oscar Goldin
to locate a single trailer on his property at Lot 69, Greenport
Driving Park, south side Linnet Street, Greenport, New York, be and
hereby is granted for a period of six (6) months.
Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman
Rich, Councilman Homan, Justice Suter, Justice Demarest.
On motion of Justice Suter, seconded by Councilman Homan, it was
RESOLVED that Supervisor Albert M. Martocchia be and he hereby is
authorized to appoi~ an Attendance Officer for the Town of Southold
when the vacancy occurs upon the resignation of Chester Melot, the
present Attendance Officer.

Moved by Councilman Homan, seconded by Justice Su~er,
WHEREAS Leander Glover Jr. has, by written application, applied
to this board for a renewal of his permit to excavate sand, gravel,
stone or other materials from premises located on the north side
of Middle Road, at Cutchogue, New York, and
~I~EREAS a public hearing was held on the original application on
July 13, 1971 and the Town Clerk issued a permit as authorized
by resolutions dated October 26, 1971, August 8, 1972 and September
11, 1973, subject to the terms and conditions set forth in said
resolutions,
NOW, THEREFORE, BE IT RESOLVED that the Town Clerk be and he hereby
is authorized and directed to issue a renewal permit to Said Leander
Glover Jr. for the excavation of sand, gravel, stone or other
materials from the above described premises for a term of one year,
subject to the same terms and conditions set forth in said resolutions
of October 26, 1971, August 8, 1972, and September ll, 1973, and
further subject to the condition that the following fees be paid
before the permit is issued:
~390.00 for the excavation of 19,500 cubic yards of fill under
permit authorized by the Southold Town Board resolution adopted
September 11, 1973,
$180.00 for the estimated excavation of 9,000 cubic yards of
fill under renewal permit ~ranted by resolution of the Southold
Town Board on September 24, 1974.

On motion of Justice Suter, seconded by Councilman Homan, it was
RESOLVED that the Town Clerk be and he hereby is instructed to
request the Long Island Lighting Company to install 7600 lum. merc.
lights on the 'following LILCO poles ~n Mattituck Estates, Mattituck,
New York: ~5 Azaela.Road, ~9~Blossom Bend, ~11 Cardinal Drive,
provided there is enough money in the 1974 budget to cover these
new lights.

Moved by Justice Demarest, seconded .by Justice Suter~ it was
RESOLVED that Supervisor Albert M.-Martocchia be and he her~eby is
authorized to advertise for bids for a replacement car for the
Police..Department.

On motion of Councilman Rich, seconded by Councilman Homan, it was
RESOLVED that a voucher in the amount of $75.00 submitted-,by the
Superintendent of Highways for picking up voting machines for the
October 1st election be and .hereby is ordered paid.
