Box 46 East Marion NYn 11939-0046 Re: FRANK & JANE LYNN SCTM #64-3-5 Dear Ms. Long, The following action was taken by the Board of Town Trustees during a Regular Meeting, held on March 22, 2000, regarding the above matter: WHEREAS, Trustees Ordinance 2000 and, FRANK & JANE LYNN, applied to the Southold Town for a permit under the provisions of the Wetland of the Town of Southold, application dated March 3, WHEREAS, said application was referred to the Southo1d Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on March 22, 2000, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standard set forth in Chapter 97-18 of the Southo1d Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, 1 - . RESOLVED, that the Board of Trustees approves the application of FRANK & JANE LYNN to construct a 4' X 90' fixed dock, a 3' X 14' ramp and a 6' X 20' float with 2 piles. Located: 2300 Hobart Road, Southold. BE IT FURTHER RESOLVED that this determination should not be considered a determination made for any other Department or Agency which may also have an application pending for the same or similar project. This permit does not authorize interference with any existing or proposed Federal project. 2. Limits to Federal Liability. In issuing this permit, the Federal Government does not assume any liability for the following: a. Damages to the permitted project or uses thereof as a result of other permitted or unpermitted activities or from natural causes. b. Damages to the permitted project or uses thereof as result of current or future activities undertaken by or on behalf of the United States in the public interest. c, Damages to persons, property, or to other permitted or unpermitted activities or structures caused by the activity authorized by this permit. d. Design or construction deficiencies associated with the permitted work. e. Damage claims associated with any future modification, suspension, or revocation of this permit. 3. Reliance on Applicant's Data: The determination of this office that issuance of this permit is not contrary to the public interest was made in reliance on the information you provided. 4. Reevaluation of Permit Decision: This office may reevaluate its decision on this permit at any time the circumstances warrant. Circumstances that could require a reevaluation include, but are not limited to, the following: a. You fail to comply with the terms and conditions of the permi t. b. The Southold Town Board of Trustees originally visited the site in March of 2000, using the Standards set forth in Chapter 97-28, the Andros Patent, and local shellfishing practices to review the original application. The length of the neighbor's docks, the navigability in the creeks, shellfish population and historic shellfish seeding are all factored into our decision to issue Permit #5139. At the applicant's request, the Board re-visited the site and the application on July 10th. We were fortunate to find the applicant at home to explain to him our concerns and the reasoning behind the issuing of his permit. The importance of safety of navigation and a town-seeded shellfish bed is not lost on this Board, especially when the applicant can still be allowed the same access to deep water as his neighbors. As discussed, the NYS DEC advised that our application is approveable if the dock is extended to 100 feet to obtain a water depth of 4 '. They have no objection to the reduction in height of the jetty. Based on my soundings, there is a depth of34" at the end of the 90' dock at alw and at the 100' mark, there is 50" at alw. As per the request of the board, I will have the dock staked at the 90' and 100' mark prior to the next field inspection set for July 12, 2000.
