Meeting reconvened at 4:00 P.M. On motion of Justice Suter, seconded by Councilman Rich, it was RESOLVED that the Southold Town Board accept letter of declination from Custodia Brandi cancelling his lease of the concession at the Southold Town Beach, Arshamomaque. Vote of the Tow~ Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Hogan, Justice Suter, Justice Demarest, Justice Doyen. Moved by Justice Suter, seconded by Councilman Homan, it was RESOLVED that the Southold Town Board accept the bid of Edward Bage in the amount of $500.00 for a three year agreement with the Town of Southold to operate the refreshment stand and other facilities at the Southold Town Beach adjacent to Long Island Sound at Arshamomaque. l ~ Vote of the Town Board: Ayes: Supervisor Martocch~a, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest, Justice Doyen. Moved by Justice Doyen, seconded by Justice Suter, it was RESOLVED that the Fishers Island Fire House be designated Town Hall of Fishers Island for the purpose of special voter registration on Saturdays from 12 Noon to 7:00 P.M. during June and July. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest, Justice Doyen. Moved by Councilman Homart, seconded by Councilman Rich, WHEREAS Evert S. Bergen applied to the Southold Town Board for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated February 26, 1974, and WHEREAS the said application was referred to the Southold Town Board of Town Trustees and the So~thold Town Conservation Advisory Council for their findings and recomme-~dations, and WHEREAS a public hearing was held by the Town Board with respect to said application on the 23rd day of April, 1974, at which time all interested persons were given an opportn~ity to be heard, NOW, THEREFORE, BE IT RESOLVED that Evert S. Bergen, 1630 Be~en Drive, Cu~chogue, New York be granted a permit under the provisions of the Southold Town Wetland Ordinance to construct a wo~d walkway to the waters edge, (Eugene Creek), across meadow, at 1630 Beebe Drive, Cutchogue, New York. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest, Justice Doyen. On motion of Councilman Homart, seconded by Justice Suter, it was RESOLVED that the Southold Town Board authorizes payment of $520.00 for the use of two buses, at $260.00 each, to transport the Mattituck Senior Citizens to Lakewood, New Jersey on May 22, 1974. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homart, Justice Suter, Justice Demarest, Justice Doyen. On motion of Justice Suter, seconded by Councilman Rich, it was RESOLVED that the Southold Town Board authorizes payment of $870.00 for the use of fou~ buses, at $217.50 each, to transport the Southold Senior Citizens to Bear Mon~tain Inn, Stony Point, New York on June 10, 1974. Vote of the Sown Beaird: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Hom~n, Justice Suter, Justice Demarsst, Justice Doyen. On motion of Justice Dema~est, seconded by Justice Suter, it was RESOLVED that Salvadore-Crimi, having completed hi~s probationar~ period as police patrolman, be and he hereby is permanently appointed police patrolman for. the Town-of~Southold effective June 1~ L974. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest, Justice Doyen. On motion,of Justice Doyen, ~seconded by ~oun.cilman ~oman, it was RESOLVED that Kenneth Edwards, Fishers Island, be and he hereby is appointed part-time Bay Constable for the Town of Southold ~t F. ishers Island at $800.00 per season, from May 25, 1974 through September 3, 1974, and he is to supply his own gas. Vote of the Town Board: Ayes: Supervisor Martocc~ia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest, Justice Doyen. Moved by Councilman Rich, seconded by Justice Demarest, it was - RESOLVED. that John Jablonski, Village Manor, Mattituck, and Joseph Frehnhofer, Jockey Creek Drive~ Southeld be-and they hereby ar~' appointed part-time Bay Constables .for the Town of Southold at. $700.00 per season, f~m July 1, 1974-,through September-3¥. 1974. Moved by Justice Suter,-.seconded by Justice Demarest,- it was RESOLVED that the Southotd Town Board authorizes payment, if such request is placed on a proper Town voucher, of $225.00 for the purchase of 250 arm patches for The Eastern~Long. Island Gymnastic Association, and such patches, to be given free to Southold Town residents only. Vote.-of the Town Board: Ayes:. On motion or-Justice Suter, seconded by Councilman Homan, WHEREAS Carl Fr~lix Jr. appTied to the,Town-Board for a single trailer renewal permit dated April~9, t974, ~E~, THEREFORE, BE IT ~ESOLVED that the application of Carl Frelix Jr. to locate a single~rai~er on-the p~opertyl of Herman Hubbard~ private road-off-north~ side. Main Road, Matt~ituck, New York-.be and hereby is granted for a period of six (6) months. On motion of Justice Suter, seconded by Councilman Rich, WHEREAS Freddie Lawson applied to the Town Board for a single.trailer renewal permit dated April 9, 1974, NOW, THEREFORE, BE IT RESOLVED that the application of Freddie Hawson to locate a single trailer on his own property on the south~ Side-of Sound Avenue, Mattituck, New York, be and hereby ~s granted for a period of six (6) months. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich Councilman Homan Justice Suter~, Justice Demarest Justice Doyenl Moved by Councilman Homan, seconded by Justice Demarest, WHEREAS Minnie Wilson applied to the Town Board for a single trailer renewal permit dated March 35, 1974, - NOW, THEREFORE, BE IT RESOLVED that the aPPLication of Minnie Wilson to locate a slngl~ trailer on. her own property on the west side ~f a private road off'the north Side Middle Road (CR 27), Cutchogue, New York, be and hereby ~s granted for a period of six (6) months. Vote of the Town Board: Ayes: ~pervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest, Justice Doyen. Moved by Justice Suter, seconded by Justice Demarest, 'it was RESOLVED that Supervisor Albert M. Martocchia be and he hereby is authorized to accept $1,059.75 as Southold Town's share of State aid under the State-aided Recreation for the Elderly Program. Moved by Justice Suter, seconded by Councilman Rich, WHEREAS at'a meeting of t~his Board held on the 7th day of May, t974, a resolution was duly adopted granting the application of Bruce A. Norris for a change of zone of premises at Mattitu¢~, Town of Sou~hold, New York, from "A" Residential and Agricultural Dis%rict to'~" Light Multiple Residence District, and -~EREAS the aforesaid resolution a~opted by this Board on May 7, 1974 inadvertently omitted to set forth therei~ the reasons for ~ejecting the Suffolk County Planning Commission's report with respect to Such application in accordance with the provisions of the Suffblk Cou-nty Charter, NOW, THEREFORE, ~ IS RESOLVED AS FOLLOWS:. The aforementioned resolution of th'is Board adopted on May .7, 1974 is hereby amended by adding thereto this Board's reasons for rejecting the Suffolk County Planning Commission-'s report disapproving the proposed change of zone, said reasons being as follows: 1. The Norris ~remises are.located south of New Suffolk Avenue which is south of New York Route 25. The Comprhhensive Development Plan of the Town of Southold recommends that major residential develop- ment should be directed to the areas south of Route 25. The rez0ning of the subject property to ~ight Multiple Residenc~ use therefor is in conformity with the Comprehensive Bevelopment Plan. 2. The Norris property is located southeast of and in the immediate vicinity Of the established retail shopping area of the hamlet 'of Mattituck. The comprehensive plan of the Town of Southold recommends that attached h~use developments of medium den-sity 'as proposed in the application be located in areas in the vicinity of established shopping centers. 3. The applicant has given assurances that a central water: supply system and a tertiary s~werage system will be installed on the. premises. The engineering report of Holzmacher, McLendon and Murrell submitted to the Board in conjunction with the application indicated that the water system to be installed will be so designed as to be able to provide a water supply not only for the property in question but also to adjoining areas which presently are experiencing problems in obtain- ing water by individual wells. The planned sewerage system will recharge renovated waste water thereby conserving the available water supply in the general area. Such a system will also reduce the contamination of the underground water supply, which would not be the case if the property were developed with individual homes with individual cesspools. IT IS FURTHER RESOLVED, t~at the Town Clerk transmit a copy of this resolution to the Suffolk County Planning Commission. Vote of the Town Board: Ayes: Councilman Rich, Councilman Homan, Justice Suter, Justice Demarest, Justice Doyen. Supervisor Martocchia - Not Voting. Mrs. ~ean Tiedke asked what progress had been made on Hummels Pond. Mrs. Loraine Terry inquired as to whether the Town is going ~o purchase Orient Point, or look into the possibility of the County of Suffolk purchasing it. Mrs. Gladys Csajko asked what progress is being made on the dog shelter. Mrs. Jean Tiedke presented each Board member with Environmental Iiterature. Mrs. Mabel Lytle asked what is being done about the To%n Hall, and if Peconic school was offered or considered. An unidentified man in the audience protested the passing of the Bruce Norris change of zone. Mrs. Ronnie Wacker asked what action is being taken by the Town Board regarding dumping of sludge from the Connecticut River into Long Island Sound. On motion of Justice Suter, seconded by Councilman Rich, it was RESOLVED that a recess be called at 4:20 P.M., and this Town Board meeting to reconvene at 8:00 P.M. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Surer, Justice Demarest, Justice Doyen. (At this time Justice Doyen returned to Fishers Island and-was not present for the remainder of the meeting.) Meeting reconvened at 9:00 P.M. Moved by Justice Demarest, seconded by Councilman Homan, ~t was RESOLVED that a public hearing will be held by the Southold Town Board at the Supervisor's Office, 16 South Street, Greenport, New York, at 3:30 P.M., June 18, 1974, in the matter of the application of Keith Harris for a permit under the provisions of the Wetlands Ordinance of the Town of Southold for the purpose of filling a portion of the rear yard area of this property at 265 Freeman Road, Mattituck, New York. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman ~ich, Councilman Homan, Justice Suter, Justice Demarest. On motion of Councilman Rich, seconded by Councilman Homan, it was RESOLVED 'that Highway Superintendent Raymond C. Dean be and he hereby is authorized to attend the Highway Superintendent~s Conference to be held June 12 and June 13, 1974 at Gurney's Inn, Montauk, New York, and be it further RESOLVED that the actual and necessary expenses to travel, meals and lodging incurred while attending said conference be a legal charge ~g~i~st the Town of Southold. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman ~ich, Councilman Homan, Justice Suter, Justice Demarest. On motion of Councilman Homan, seconded by Councilman Rich, WHEREAS, Howard L. Young and George L. Young, Jr. have heretofore submitted to this Board a proposed agreement wherein the said Howard L. Young and George L. Young, Jr. propose to grant to the Town of Southold a Scenic and/or Conservation Easement on ~property.owned by them and located-at Orient, New York, and WHEREAS, the Town attorney has approved said agreement, and WHEREAS, a public hearing was held by this Board with respect to the grant of such easement pursuant to Section 247 of the General Municipal Law, and WHEREAS, this Board believes that it is in the public interest to accept a grant of easement as proposed in said agreement, NOW, THEREFORE, BE IT RESOLVED that %his Board does hereby accept the grant of a Scenic and/or Conservation Easement ~ffecting the real property set forth in the aforesaid agreement of Howard L. Young and George L. Young, Jr. of the nature, character and extent and subject to the terms and conditions of said agreement, and IT IS FURTHER RESOLVED that the Supervisor be and he hereby is authorized and directed to execute said agreement on behalf of ~he Town of Southold and to cause said agreement to be recorded.in-the Suffolk County Clerk's Office. Vote of the Town Board: Ayes: Supervisor Martocchia, Coun~ilmah Rich, Councilman Homan, Justice Suter, Justice Demarest. On motion of Justice Demarest, seconded by CounciLman Rich, WHEREAS Hope T. Whitsit and others have heretofore submitted to this Board a proposed agreement wherein the said Hope T. Whitsit and others propose to gaant to the Town of Southold a' Scenic and/or Conservation Easement on property owned by ~hem and located at Orient, New York, and .~ WHEREAS, the town attorney has approved said a~reement, and W~EREAS, ~a public hearing was held by .this Board wi-th ~espect to the grant of such easement pursuant to Section ~247 of the~ General Municipal Law, and WHEREAS, this Board believes .-that it is. in the public interest to accept a grant of easement as proposed in .said agreement, NOW, TPIEREFORE, BE IT RESOLVED that this Board does hereby accept the grant of a Scenic and/or Conservation Easement ~ffecting the real property set forth in the aforesaid a~reement of Hope T.J Whitsit and others of the nature, character and extent and subject to the terms and conditions of said agreement, and IT IS FURTHER RESOLVED, that the supervisor be and he hereby is authorized and directed to execute said agreement on behalf of ~the Town of Southold and to-cause said agreement to.be recorded in~ the Suffolk County Clerk's Office. Terry proposes to grant to the Town of Southold a Scenic and/or Conservation Easement on property owned by him and.~located at.Orient, ~ew York,. and ~WHEREAS the town attorney has approved said a~reement, and -WHEREAS. a~ubLic hearing was h-eld by this Board with ~espect- to the:grant~ of such easement pursuant to Section 247 of. the ~ene~al Municipal Law, and WHEREAS~ -~his Board beLieves~that it .is in the public inte~estl~o accept a grant of easement as proposed.in said a~reement .... NOW, THEREFORE, BE IT RESOLVED that thi.s Board does.hereby, acc~ the grant of a Scenic and/o~ Conservation Easement ~£fecting the real property set ~ort~ ~i~n the aforem~i~reement of OrvilLe Terry of the nature, character and extent and subject to the terms and conditions of said agreement, and IT IS FURTHER RESOLVED, that the supervisor be and he hereby is authorized and directed to execute said a~reement on behalf of the Town of Southold and to cause said agreement to be recorded in the Suffolk County Clerk's Office. Moved by Justice Demarest, seconded by Councilman Hogan, WHEREAS the following local law being proposed Local Law No. 1 1974 was ~heretofore introduced at this meeting by a member of this Board, said .local law being as follows, to wit: LOCAL LAW NO. ~, 1974 A Local Law to amend Chapter 100 (Zoning) of the Code of the Town of Southold in relation to notice of change of zone; the keeping and housing of animals; site plan approval; the length of multiple dwellings; minimum floor area of dwelling units; detached or ground signs; display of merchandise; uses in B-1 Districts; expiration of Building permits; and front yard set back in C Districts. NOW, THEREFORE, BE IT RESOLVED that the Town Clerk of the Town of Southold be and he hereby is directed to transmit this Local Law No. 1, 1974 to the Planning Board of the Town of Southold for their recommendation and report.
