Dear Mr. Krupski and Members of the board:

I represented Mr. and Mrs. McDonough il the sale of their
property to Mr. and Mrs. Neimark, and I a~ familiar with the
property both as their attorney and neighbor. The Hoey family
subdivided this land, Mr. McDonough is part of Ithe Hoey family, and
the house was built by Mr. McDonough.
I spoke to Mr. McDonough with regard to a retaining wall along
the north easterly side of their property, hel advised me that at
the time the house was constructed in 1969 th~ retaining wall was
installed to prevent the erosion of the soil [into the Hippodrome
and wetlands.

I have lived on Town Harbor Lane since childhood and am v{ ry familiar with the
property on Hoey Lane now owned by Peninah and Harold N~imark. As a child I
frequently played at the house, which was then owned by the McDonoughs.
