Adoption of Meeting Minutes: · Adoption of minutes from November 9, 2004 MOTION made by Ray Blum, seconded by John Sepenoski, to accept minutes of the November 9, 2004 meeting. Motion carried 4/0. (Fred Lee abstained) The Members entered into EXECUTIVE SESSION. Applications: · DORSET FARMS (TPDR): [executive session] SCTM #: Location: Total Acreage: PDR Acreage: Zoned: CPF: 1000-100-4-8 4100 Oregon Rd (s/s), Mattituck +33.0 acres +31.0 acres A-C Yes Reviewed status of offer. [executive session] Reviewed environmental site assessment report. Melissa instructed to send copy of environmental site assessment summary to applicant and his attorney, Gail Wickham to deal with environmental issues revealed in said report if barn is to remain in reserved PDR area. Provided landowner agrees to the more restrictive federal language, LPC members agreed to increase price per acre and to schedule a public hearing. Closing to be held within six (6) months of resolution adopted electing to purchase development rights on this parcel. MOTION made by John Sepenoski, seconded by Eric Keil, to increase offer providing appraisal update supports the increased price per acre and conditional upon applicant accepting the federal deed language, dealing with environmental issues that ESA report prepared by Nelson, Pope & Voorhis, LLC revealed or to change the reserve area, and to close as soon as possible thereafter. Motion carried 6/0. END OF EXECUTIVE SESSION STICKNEY PROPERTY (TPDR): SCTM #: 1000-10-5-12.5 Location: East End Road, Fishers Island Total Acreage: +2.19 acres Zoned: R-120 CPF: Yes SCTM #: 1000-10-5-12.6 Location: East End Rd, Fishers Island Total Acreage: +2.93 acres Zoned: R-120 CPF: Yes Reviewed new application. LPC felt that Town would be inclined to proceed with preservation only if at a significant bargain sale. GRIPPA PROPERTY (TPDR): SCTM #: Location: Total Acreage: PDR Acreage: Zoned: CPF: 1000-121-1-2.2 1100 County Route 46, Mattituck +11.9 acres +8.5142 acres R-40 Yes Reviewed survey and Reserved Area. Survey has revealed that PDR area is smaller than anticipated acreage preservation. Survey depicting reserved area has been forwarded to applicants and their attorney for review. No response as yet. This transaction may close by the end of the year. LPC did not have any problems with survey reserve area as shown. · FLOWER HILL BUILDING CORP. SCTM #: Location: Total Acreage: PDR Acreage: Zoned: CPF: 1000-69-3-10.1 Ackerly Pond Rd, Southold +25.888 acres 20.71 acres A-C Yes Reviewed new application. LPC reserved any action on this application at this time since property within potential HALO District. Melissa Spiro instructed to bring this application to the attention of the Town Board for guidance from Town Board as to how to proceed. NJ MANAGEMENT PROPERTY (TPDR): SCTM #: Location: Total Acreage: PDR Acreage: Zoned: CPF: 1000-113-13-1.2 4735 Westphalia Rd, Mattituck +17.32 acres R-80 Yes Reviewed applicant's concept plan and request to re-activate application. (Eric Keil recused himself.) LPC members discussed last offer for Town's purchase of development rights on this parcel that was made in August 2003. MOTION made by Ray Blum, seconded by Fred Lee, to increase offer providing appraisal update supports the increased price per acre with no ag structure limitations other than those outlined in Town Code. Motion carried 5/0. Inquiries: · FISHERS ISLAND GARBAGE DISTRICT PROPERTY: SCTM #: 1000- 12-2-6.13 Location: Private Road, Fishers Island Total Acreage: +18.58 acres Zoned: R-120 CPF: Yes Inquiry made by Peter Burr for the Town to be involved, perhaps with Fishers Island Museum, in purchase of the capped landfill. Need more information such as 1) liability; 2) proof that property is a buildable lot; 3) appraisal; 4) how proposed plan is to work. · FISHERS ISLAND SCHOOL PROPERTY: SCTM #: 1000- 9-8-1 Location: Reservoir Road, Fishers Island Total Acreage: +1.99 acres Zoned: R-80 CPF: Yes No response to Land Preservation Department's inquiries regarding this property. Justice Evans and Peter Burr pursuing further information. SCHMITT PROPERTY (TPDR): SCTM # Location: Total Acreage: PDR Acreage: Zoned: CPF: 1000-95-3-8.1 5780 Oregon Rd, Mattituck +54.9 acres A-C Yes Discussed status of concept planning. No application submitted to Land Preservation Committee yet. Owner has met with Mark Terry, Melissa Spiro and Tim Caufield to discuss concept plans. Owner is trying to find proof that this lot was originally three lots. General: · Reviewed Melissa's status report. [executive session: status of offers] Informational: · Duffy PDR closing held 11/18/04 · Zoumas open space closing scheduled for 12/1/04 @ 10:30am · Sepenoski development rights closing scheduled for 12/1/04 @ 12noon · Melissa Spiro gave quick update on Town Board's discussions re: Septic Credit Program and informal TDR working group. Next Regular Meeting: The next regular meeting will be held on Tuesday, December 7, 2004, in Conference Room, at 7:00 p.m. Last meeting for the year 2004 will be held on Tuesday, December 21,2004 at 7:00 p.m. in the Conference Room.
