Meeting of April 9, 1974
The Southold Town Board met at the office of Supervisor Albert M.
Martocchia, 16 South Street, Greenport, New York, at 3:00 P.M.,
Tuesday, April 9, 1974, with the following present:
Deputy Supervisor Louis M. Demarest
Councilman James H. Rich, Jr.
Councilman James Homan
Justice Martin Suter
Highway Superinteddent Raymond C. Dean
Town Attorney Robert W. Tasker
Town Clerk Albert W. Richmond
Absent: Supervisor Albert M. Martocchia
Justice Francis T. Doyen
On motion of Councilman Homan, seconded by Councilman Rich, it was
RESOLVED that the minutes of the Town Board meeting of March 20, 1974
be approved as submitted.
Vote Of the Town Board: Ayes: Deputy Supervisor Demarest, Councilman
Rich, Councilman Homan, Justice Suter.
On motion of Councilman Homan, seconded by Councilman Rich, it was
RESOLVED that the next meeting of the Southold Town Board will be
held at 3:00 P.M., Tuesday, April 23, 1974 at the office of Supervisor
Albert M. Martocchia, 16 South Street, Greenport, New York.

On motion of Councilman Rich, seconded by Councilman Homan, it was
RESOLVED t'hat the reports of Supervisor Martocchia, Police, Justice
Suter, Town Clerk and Building Inspector for the month of'March'1974
be accepted and placed on file. ~.

~0n'moti0n of Justice Suter, seconded by Councilman Rich, it was
RESOLVED that Deputy Supervisor Demarest be and he hereby is
authorized to sign the necessary papers for Senate bill S-9796:
AN ACT - TO amend'chapter two hundred forty~six of the laws
of nineteen hundred sixteen, entitled "An Act to enable the towns
in the county of Suffolk to provide for the extermination of mosquitoes
and establishment of districts thereto", in relation to the amount
of the annual appropriation by the town of Southold for the Orient
mosquito district.

On motion-Justice Suter, seconded by Councilman Rich, it was
RESOLVED that Deputy Supervisor Demarest be and he hereby is
authorized to sign the necessary papers for Assembly bill No. 11529:
~ An act to amend chaPter two hundred forty-six'of the laws ~f
nineteen hundred sixteen, entitled' "An act to enable the towns in
the county of Suffolk to provide for theextermination of mosquitoes
and establfshment of districts therefor/" in relation to the amount
O'f the annual appropriation by the Town'of So~thold for the Orient
Mosquito District.
Vote of the Town Board: Ayes: Deputy Supervisor Demarest, Councilman
Rich, Councilman Homan, Justice Suter. ~
On motion of Councilman Homan, seconded by Councilman Rich, it w-as
RESOLVED that the Southold Town Board appro~s the action of the
Fishers Island Ferry District in raising the salary of Walter Griffin,
mail carrier, to $200.00 per month.
Vote of the Town Board: Ayes: Deputy Supervisor Dema'rest, Councilman
Rich, Councilman Homart, Justice Surer.
On motion of Councilman Homan, seconded by Councilman Rich, it was
RESOLVED that the Southold Town Board approves that lease between
· he Fishers Island Ferry District and Richard Grebe for the Fishers
Island Airport from the 1st day of April, 1974 and ending on the
3lsat ~day of March, 1979 at an annual rent of $2,500.00. (copyl on
file in the Town Clerk's Office.)

On motion of Councilman Rich, seconded by Councilman Homart, it was
RESOLVED that the Southold Town Board rescind the following motion
made on March 12, 1974:
"On motion of Justice Demarest, seconded by Councilman Rich, it was
RESOLVED that Edward Hindermann be appointed Housing
Inspector for the Town of Southold at his present salary
of $8,212.00 per year. Such appointed position to be
at the pleasure of the Town Board unless otherwise
provided for by law.
Vote of the Town Board: Ayes: Supervisor Martocchia,
Councilman Rich, Councilman Homan, Justice Suter, Justice
Demarest."

On motion of Councilman Rich, seconded by Justice Suter, it was
RESOLVED that Edward Hindermann be appointed Housing Inspector for
the Town of Southold at his present salary of $8,212.00 per year.
Such appointed position to be at the pleasure of the Town Board'
unless otherwise provided for by law.

Moved ~y Councilman Homan, seconded by Councilman Rich,
WHEREAS a petition was received from Werner L. Adel, Jr., requesting
a change of zone on eertain property at Mattituck, New York, said
petition for a change from "A" Residential and Agricultural District
to "C" Light Industrial District,
NOW, THEREFORE, BE IT RESOLVED that the Town Clerk of the T~n of
Southold be and he hereby is directed to transmit this application
to the Planning Board in accordance with Article XV, Section 100-150
(B) of the Zoning Ordinance of the Town of Southold.
Vote of the Town Board: Ayes: Deputy Supervisor Demarest, Councilman
Rich, Councilman Homart, JuStice Surer.
Moved by Justice Suter, seconded by Councilman Homan,
WHEREAS the Southold Town Planning Board and Suffolk County
Planning Department have prepared official reports and recommendations
on the application of Albert W. Albertson for a change of zone from
"A" Residentia'l and Agricultural District to'~" Light Industrial
District,
NOW, THEREFORE, BE IT RESOLVED that a public hearing will be held
by the Southold Town Board at 16 South Street, Greenport, Ne~:i~ork
on May 21, 1974 at 7:30 P.M. on the abovementioned petition, and
that the Town Clerk be and he hereby is authorized and directed to
cause notice of said hearing to be published in the official newspaper
pursuant to the requirements of law.

Rich, Councilman Homan, Justice Suter.
Moved by Councilman Homan, seConded by Justice Suter,
WHEREAS Sam Brown applied to the To~n Board for a s~ngle trailer~
renewal permit dated March 13, 1974,
NO~, THEREFORE, BE IT RESOLk~ED that the application of Sam Brown
to locate a single trailer on his property at Middle Road,
Cutchogue, New York, be and hereby is granted for a period of
six (6) months.
Vote of the Town Board: Ayes: Deputy Supervisor Demarest, Councilman
Rich, Councilman H~man,Justice Suter.
Moved by Councilman Rich, seconded by Justice Suter, it was
RESOLVED that a public hearing will be held by the Southold Town
Board at the Supervisor's Office, 16 South Street, Greenport, New
York, at 4:00 P.M., on the 23rd day of April 1974, in the matter of
the application of Keith Harris for a permit under the provisions
of the Wetlands Ordinance~ of the Town of Southold for the purpose
of filling in a portion of the rear yard area at 265 Freeman Road,
Mattituck, New York.
Vote of the Town Board: Ayes: Deputy Supervisor Demarest, Councilman
Rich, Councilman Homan, Justice Suter.
On motion of Councilman Rich, seconded by Councilman Homan, it was
RESOLVED that Superih~endent of Highways Dean be and he hereby is
authorized to advertise for bids for the sale of two used police
boat engines.
Vote of the Town Board: Ayes: Deputy Supervisor Demarest, Councilman
Rich, Councilman Homan, Justice Suter.
On motion of Justice Suter, seconded by Councilman Homan, it was
RESOLVED that a recess be called at 3:50 P.M. to reconvene at 4:30 P.M.

Moved by Councilman Homan, seconded by Justice Suter, it was
RESOLVED that General Bills in the amount of $1~,421.62; Fishers
Island Ferry District bills in the amount of $14,673.62; Highway
bills in the amount of $21,878.71; Special District bills in the
amount of $5,317.64; and Federal Revenue Sharing bills in the
amount of $8,800.76 be and the same are hereby ordered paid.
Excepting bills of Terrance K~isman for mileage, and payment of
a consultant.

Rich, Councilman Homan, Justice Suter.
On motion of Councilman Homan, seconded by Justice Suter,
WHEREAS, Howard L~ Young and George L. Young, Jr. of Orient, New
York, have submitted to this Board a proposed agreement involving
a parcel of land at Orient, New York owned by the said Howard L.
Young and George L. Young, Jr. upon which the said Howard L. Young
and George L. Young, Jr. propose to grant to the Town of Southold a
scenic and/or conservation easement, and
W~EREAS the Board has examined the proposed agreement and believes
that it is in the public interest to acquire the easement proposed
by the said Howard L. Young and George L. Young, Jr. effecting the
real property ~escribed in said agreement, and
WHEREAS, Section 247 of the General Municipal Law provides that
this Board shall hold a public hearing with respect to said grant
of easement,
NOW, THEREFORE, BE IT RESOLVED that a public hearing ~lheld by
this Board at the Supervisor's Office, 16 South Street, Greenport,
New York on the 7th day of May 1974, at 3:30 o'clock P.M. in the
matter of the grant of a scenic and/or conservation easement by
Howard L. Young and George L. Young, Jr. to the Town of Southold
in accordance with the aforesaid agreement presented to this Board,
and it is further
RESOLVED that the Town Clerk cause notice ~such hearing to be
published in accordance with law.
