Meeting of December 30, 1960 The Southold Town Board met at the office of the Supervisor, 16 Sou~h Street, Greenport, N.Y. on Friday, December 30, 1960. The meeting called to order at 1:30 P.M. by Just~e Clark with the following present: Councilman Demarest; Justices Tuthill, Clark and Edwards; Supt, of Highway Price; Town Attorney Tasker and Town Clerk Richmond. Moved by Justice Edwards~ seconded by Justice Tuthill: RESOLVED: That Henry Clark be and he hereby is designated to act as temp- orary chairman of this Town Board meeting in the absence of the Supervisor~ ~The foregoing resolution was duly put to a vote on roll call which resulted as follows: Ayes-Councilman Demarest; Justices Tuthill, Clark and Edwards. The Town Clerk then apprised the Town Board that Councilman Lester M. Albertson did at 11:00 A.M. on 'December 30, 1960, resign his office ~f COuncilman of the Town of Southold. The resignation of Councilman Lester M~ Albertson ~was read by the Clerk, which resignation had been filed in h~s office at 11:00 A.M., December 30, 1960. Patrick F. Gorman appeared before the Town Board as a representative the Southold Democ=atic Committee and read the following resolution and asked that the same be made a part of the minutes-of the Town Board. WHEREAS, as a result of the tragic and untimely death of Supervisor Henry H. Tuthill it becomes the duty of the members of the Town Board of the Town of Southold to select by appointment a qualified person to fill the existing vacancy in the office of Supervisor, and WHEREAS, ~he said Supervisor Tuthill was elected as t~ nominee of the DemocHatic party and the electorate of this town thereby evidenced its mandate that the supervisor should be a member of theDemocratic party~ and WHEREAS, this board, being mindful of the democratic processes and· sensitive to the desires of the people, feels that it should act in a statesman-like way and in accordance with the expressed wishes of the electorate, it is RESOLVED'that this board does request the Southold TOwn Democratic CO~m~ittee to suggest to it for its consideration the names of qualified members of the democratic party thought by'the commi~e~ctp~beysuitab!e for appointment to the office of supervisor. Moved by Councilman Demarest; seconded by'Justice.Edwards: WHER~S, a vacancy exists in the-office of Supervisor of the ToWn of Southold, Suffolk County, New York,~caused by the death of Henry H. Tuthill, who was elected to such office on the 3rd day of November., 1959 for a .term of two years from the 1st day of January, 1960 and WHEREAS, the Town Clerk of the Town of Southold has notified this Board that Councilman Lester M. Albertson has heretofore and on the 30th day pf December, 1960, resigned his office of councilman by delivering to the Town Clerk his resignation in writing addressed to the Town.Clerk, said resignation to take effect immediately, NC~, T~EREFORE, BE IT RESOLVED: That pursuant to the authority vested in the Town Board pursuant to the provisions of Section 64 of the Town Law, that Lester M. Albertson be and he hereby is appointed to the office of Supervisor of the Town of Southold to fill the vacancy existing in said office and that such appointment shall take effect immediately and the said Lester M. Albertson shall hold such office untilJanuary 1, 1962. The question of the adoption of the foregoing resolution was duly put to a vote on rell call which resulted as follows: Ayes: Councilman Demarest; Justices Tuthill, Clark and Edwards. The temporary chairman then called a recess at 1:~0 P.M. in order that the Town Clerk administer the oath of office to Lester M. Albertson and that Lester Mi Albertson file his~ official undertaking with the Town Bo~d. The Town Clerk thereupon administered the oath of office to Lester ~. Albertson and Lester M. Albertson thereupon presented his official undertaking to the Town Board. The temporary chairman then reconvened the Town Board meeting at 1:45 P.M. The following resolution was presented: Moved .by councilman Demarest; seconded .by Justice Edwards: RESOLVe: That Bond No. 73-$-1119, issued by the Aetna casualty and Surety Company in the sum of Seventy-five Thousand Dollars ($75,000.00) on behalf o4 Lester M. Albertson and Bond .~ 73-S-1118 issued by the Aetna casualty and Surety Company in the sum of Five Thousand Dollars ($5,000.00)on behalf of Lester M. Albertson. as custodian of Finances of the Fishers Island Ferry District be and the same is hereby approved as to its form, manner of execution and sufficiency of sureties therein. Vote of T~wn Board: Ayes-Councilman Demarest; Justices Tuthill, Clark and Edwards. Moved by Justice Tuthill; seconded by Councilman Demarest: W~E~EAS, this Board has~ learned with deep sorrow of the death of Henry H. Tuthill Supervisor of the Town of Southold,- and WHEREAS, &n his service to the people of the Town of Southold as Supervisor and~to the people of the County of Suffolk as a member of the Board of Supervisors of Suffolk County, Supervisor Tuthill has distinguished him- self:as a dedicated and conscientious public ~ervant, NOW, T~EREFORE, BE IT RESOLVED, that the Town Board of the Town of Sout~old hereby gives formal expression of its loss in the death of Supervisor Henry H. Tuthill, a man esteemed by his associates and respect- ed by all, and BE IT FURTHER RESOLVED, that when the Town Board adjourns this day, it do so out of respect to the memory of Supervisor Henry ~. Tuthill, and BE IT FURTHER RESOLVED, that a copy of this resolution be spread upon the minutes of this meeting and a copy be transmitted to the family of Supervisor Henry H. Tuthill that we may extend to them our sincere sympathy. Vote of Town Board: Ayes-Councilman Demarest; Justices Tuthill, Clark and EdWards. Moved by JUstice T~thill; seconded by Justice Edwards: RESOLVED: That Bond No. 73-S-1059, issued by the Aetna Casualty and Suretycompany in the sum of One Thousand Dollars ($1,000.'00) on behalf of Albert W. Richmond, be and the same is hereby approved as to its form, manner of execution and sufficiency of surety therein. Vote of Town Board: Ayes-~_u~cilman Demarest; Justices Tuthill, C~ark and Edwards. John Gada, be and the same is' hereby approved as to its form, manner of execution and sufficiency of sureties therein. Moved by Justice Edwards; seconded by Justice Tuthill: RESOLVED: That Bond No. 73-S-689, issued by the Aetna Casualty and -Surety Company in the sum of ($20,000.00) Twenty Thousand Dollars on behalf of Elizabeth McCloskey be and the same is hereby approved as to its form, manner of execution and sufficiency of sureties therein. Price, be and the same is hereby approved as to it~ form, manner of execution and sufficiency of surety therein. Vote of Town Board: Ayes-Councilman Demarest; Jsstices Tuthill, Clark and Edwards. The temporary chairman at 2:15 P.M. called a recess in order that the oath of office and official undertaking of Lester M. Albertson could be filed in the County Clerk's Office according to law. At 2:55 P.M. the Town Board was advised that the oath of Qffice and official undertaking of Lester M. Albertson were duly filed in the Suffolk County Cl~k's~. Office. The temporary chairman thereupon reconvened the Town Board.~ meeting at which time Lester M.'Albertson, the newly appointed SUpervisor presided. Moved by Justice clark; seconded by Justice Tuthill: RESOLVED: That Bond No.-73JS-690, issued by the Aetna Casualty amd Surety Company in the sum of Four Thousand' Dollars ($4,000.00). On behalf of E. Perry Edwards be and the same is hereby approved as to its form, manner o~ execution and sufficiency of surety therein. Vote of Town Board: Ayes-Supervisor Albertson; Councilman Demarest~ Justices Tuthill, Clark and Edwards. Moved by Councilman Demarest; seconded by JUstice Tuthitl: RESOLVED: That Bond No. 73-S-1005, issued by the Aetna Casualty and .- Surety-Company in the sum of One Thousand Dollars ($1,000.00) on behalf of Henry A. Clark be and the same is hereby, approved as to its form, manner of execution and sufficiency of surety therein. As noted above; filed estimates for 1960 are $2,311,716.00. Thisis a reduction of $245,162.00 from the figures of 1959. These figures do not include farm buildings, accessory buildings, interior alterations, remodeling and such other work as does not require permits under our regulations. I would estimate that overall our building within the Town of Southold for t~e year 1960 was fully as great as 1959, if not larger'. I~have met regularly with the Board of Appeals& Planning Board during the most of the year. I attended Eastern States Building Inspectors School, the Suffolk County Zoning Congention and two meetings of the New York State Building Officials Conference. During the year the Building Inspectors Association of Suffolk County was organized and a training school program prepared. At this time I am President 6f that organization and look forward to much valuable training and cooperation during its operations. I submit the following as-a supplemental report for the year 1960: Estimated Cos't 1. Permits issued for ~49 new dwellings $1,795,965.00 Again this year there were many complaints of wlls gone bad due to de- tergents and improper installations of private wells and cesspools, Again ! recommend a study of some sort of public water supply in the more densely built-up residential areas of the Town. Again I recommend serious thought be given to a building code of some sort for the Town and suggest that possibly a coim~ittee be appointed to study various existing codes and make a recommendation to the Town Board on this matter. At this time I wish to thank you for the appointment as Building Inspec- tor and for your cooperation during the past year. Mr. Serge Doyen, Jr. attending the Association of Towns meeting in New York City in February. Several members of the Board attendedthe Zoning Convention held in Juntington in December. Approximately 336 hearings have been held involving decisions by ~he Board of Appeals. Of these a few have been appeale~ and none, to da~e, have been reversed. Approximately an equal number of informal hearings have been held. In conclusion, it wo~ld seem to the Board of Appeals advisable to have more frequent joint meetings involving the Town Board, Board of Appeals and/or t~e Planning Board in order to discuss common problems. Gentlemen; The $outhold Town Planning Board wishes to report that they have hel~ 16 meetings this year,1960. We have met with the Town Board and the Board of Appeals on two occasions. We have met with the Riverhead Planning Board on one occasion, and wi~h the County Executive, H. Lee Dennison, members of the Board of Appeals and members of the Mattituck Park Com- mission-on one occasion. The Planning Board held three hearings on the question of approval of sub-division plots. All three were approved. During the past year there have been several recommendations made to the Southold Town Board relative to amendments to the ZOning OrdinanCe. Several ahve been passed. The Board has held approximately 50 informal discussions and action was taken in all cases. The planning Board has investigated and made recommendations to the Town Board on 16 change of zone applications, The Building Inspector collected and turned over to the Supervisor $375.00 in connection with these applications ~or change of zone. One cha~e of zone was made on the Town Board's own motion, therefore no fee was required. There have been six formal applications for subdivisions, and $363.00 in fees has been turned over to the Supervisor by the Building Inspector. In February ~rs. Judith Boken attended the annual Association of Towns meeting held in New York City as a representative of the Planning Board. On December 10, 1960, Messrs. Moisa, Grebe, Young, Unkelbach and VanTuyl attended the annual zoning Convention held in Huntington.
