Martocchia, 16 South Street, Greenport, New York, at 3:00 P.M., Friday, February 8, 1974, with the following present: Supervisor Albert M. Martocchia Councilman James H. Rich, Jr. Councilman James Homan Justice Martin Suter Justice Francis T. Doyen Town Attorney Robert W. Tasker Highway Superintendent Raymond C. Dean Town Clerk Albert W. Richmond Absen-t: Justice Louis M. Demarest Moved by Councilman Rich, seconded by Councilman Homan, it was RESOLVED that minutes of January 22, 1974 be and they hereby are approved. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Su~er, Justice Doyen. Moved by Justice Suter, seconded by Councilman Rich, it was RESOLVED that the next meeting of the Southold Town Board will be held at 3:00 P.M., Tuesday, February 26, 1974 at the office of Supervisor Albert M. Martocchia, 16 South Street, Greenport, New York. Vote Of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Doyen. Moved by Councilman Rich, seconded by Councilman Homan, it was RESOLVED that the reports of the Supervisor, Town Clerk, Justice Suter, Building Department and Assessors for the month of January 1974 be accepted and placed on fi~e. Vote of the Town Board: Ayes: "Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Doyen. Moved by Councilman Rich,~seconded by Justice Suter, it was RESOLVED that Judith T. Boken,' who has served 10 years as a permanent employee of the Town of Southold, be granted 4% longevity pay, effective February 1, 1974. Vote of the Town- Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Doyen. Moved by Councilman Rich, seconded by Justice Surer, it was RESOLVED that the So~thold Town Board accept AsseSsors Certificates of Erroneous Assessments on property assessed to Hugh F. Murray (two parcels appeared on Assessment Roll with same description and assessment. 'Duplicate Assessment), and Simo~e W. Swamm (aged exemption was put on this parcel in error.) Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice 'Suter, Justice Doyen. Moved by Counc'ilman Rich, seconded by Councflman Homan, it was RESOLVED that the Sour'hold Town Board discontinue their lease with the Long Island Railroad for the parking lot at the Southold Railroad Station. Vote of the Town Board: Ayes: Supervisor Mattocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Doyen. On motion of Justice Doyen, seconded by Councilman Rich, it was RESOLVED that the Southold Town Board approves the action of the Fishers Island Ferry District in appointing Richard S. Baker, Fishers Island, N~w York, a Commissioner of the Fishers Island Ferry District to fill the vacancy created by the death of Lawrence S. Baldwin. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homart, Justice Suter, Justice Doyen. Bids were opened at 2:00 P.M. for a three year contract for tax computer service. Two bids were received: Lockwood-Kessler-Bartlet, Inc. - $26,800.00; and Parity Systems - $21,600.00. On motion of Councilman Homan, seconded by Councilman Rich, it was RESOLVED that a three year contract for tax computer service be awarded% to Parity Systems at $21,600.00, lowest responsible bidder for tax computer service for the Town of Southold. Vote of the Town Board: Ayes: Supervisor Ma~tocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Doyen. Bids were opened at 3:00 P.M., February 1, 1974 for six marked police cars, with trade-in of five 1973 marked police cars and one 1972 marked police car. Two'bids were received: Greenport Ford-Mercury - $21,151.83, and William Pase, Inc. - $22,~12.60. On motion of Councilman Homan, seconded by Councilman Rich, it was RESOLVED that Greenport Ford-Mercury, Greenpor~, New York, lowest responsible bidder for six marked police cars be awarded the bid at $21,151.83. Trade-in of five 1973 marked police cars and one 1972 marked police car. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Doyen. Moved by Councilman Rich, seconded by Councilman Homan, WHEREAS Isidore P. Krupski has applied to the T°W~ Board for a single trailer renewal permit dated January 15, 1974, NOW, THEREFORE, BE IT RESOLVED that the application of Isidore P. Krupski to locate a single trailer on his property at the north side Main Ro~d, approximately 1000 ft. east of Bay Avenue, P~conic, be renewed for a period of ~ix (6) months. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Doyen. Moved by Councilman Rich, seconded by Councilman Homan, WHEREAS Herbert O. Cassidy has by written application applied to this board for a renewal of the Angelo G. Petrucci permit to excavate sand, gravel, stone or other materials from premises located south of Soundview Avenue, Southold, New York, bounded generally northerly by lands of Edwin A. Smith and Long Island Produce Co.; easterly by lands of Case and Kaplan; southerly by lands of Newell Estate and Sepenoski; and westerly by lands of Tisdale and Edwin A. Smith, and WHEREAS a public hearing was held on ~he original application of Angelo G. Petrucci (property now owned by Herbert O. Cassidy) on July 13, 1971 at which time all interested persons were given an opportunity to be heard, NOW, THEREFORE, BE IT RESOLVED that this Board does in accordance with Section V of the Excavation Ordinance of .the Town of Southold, find that (a) The proposed operations will not interfere with the surface water drainage plan of the area nor endanger any street, road or highway, (b) The circumstances of the location and terrain are reasonably adapted to rehabilitation to the end that the premises will not become desert or waste land following completion of operations, (c) The circumstances of the location and the terrain are such that conditions and safeguards may feasibly be imposed to assure that the premises will hot constitute 'an attractive nuisance or endanger the safety of children. (d) The use will not cause undue traffic hazards. (e) The use will-not cause undue noise or wind-blow dust or sand. (f) The use will not change the established character of the neighborhood or depress the value of other lands in such neighborhood. (g) The proposed operations are set back at least 20 feet from any. road, street, avenue or highway and that the excavation operations were in existence at the effective date of the a~oresaid excavation ordinance and that such proposed operations will not be extended beyond the present front, side or rear setback lines, and it is further RESOLVED that the Town Clerk be and he hereby is a~thorized and directed to issue a renewal permit to Herbert O. Cassidy for the excavation of sand, gravel, stone, or~ other materials from the above described premises for a term of one year, subject, however, to the following terms and conditions: 1. The removal of materials shall be confined to the shaded areas outlined in red on the map accompanying said original applica- tion, a copy ofwhich has been signed by the Supervisor and the applicant and filed with the Town Clerk. 2. The removal of materials from said areas shall not extend below fifteen (15) feet above sea level. 3. All removal operations shall be setback at least 10 feet from all property lines. 4. All slopes shall be maintained during and after operations at one foot vertical on one foot horizontal. 5. After operations hhve been completed, the excavated areas, as well as all other areas where prior excavation operations have been conducted on the premises, shall be leveled, regraded, all stumps, rocks and other debris removed and the ~ntire premises seeded with grass. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, JustiCe Doyen. Moved by Justice Suter, seconded by Councilman Homan, it was RESOLVED that the Southold Town Board approves the $25~000 bond as recommended by the Southold Town Planning Board for roads and other improvements in the subdivision known as Elijah"s Lane Estates, Section I, located at the west side of Elijah's Lane, Mattituck, New York, owned by Joseph Saland. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, C~uncilman Homan, Justice Suter, Justice Doyen. Moved by Councilman Rich, seconded by'Councilman Homan, it was RESOLVED that the Soutkold Town Board approves the $32~.000 bond as recommended by the Southold Town Planning Board for roads a~d other improvements in the subdivision known as Fairway Farms located on the west side of Cases Lahe, Cutchogu~, New York, owned by Fairway Farms, Inc. Vote of the Town Bo&rd: Ayes: Supervisor Martocch±a, Councilman Rich, Councilmah'Homan, Justice Surer, Justice Doyen. Moved by Justice Surer, seconded by Councilman Homan, WHEREAS Leeward Acres at Bayview Inc. have made application to the Town Board to dedicate certain highWays at Southold to be known as Leeward Drive and Topsail Drive, new roads at Leeward Acres Sub- division, more fully described in said petition, together with release executed by the owners thereof, and ~EREAS the Highway Superintendent has inspected the said highways and has advised the Town B~ard that said proposed highways comply in all respects with the specifications for the dedication cf highways in the Town of Southold~ ' - NOW, THEREFORE, BE IT RESOLVED that the Town Clerk' be and he hereby is authorized and directed to forthwith cause the dedication, release and deed to be recorded in the office of the Clerk of the County of Suffolk. Moved by Councilman Rich, seconded by Justice Suter, WHEREAS the Southold Town Planning Board and Suffolk County Planning Board have prepared official reports and recommendations on the application of William Wickham for a change of zone from ?A" Residential and Agricultural District to "B" Light Business District, NOW, THEREFORE, BE IT RESOLVED that a public hearing will be held by the Southold Town Board at Greenport, New York, 16 South Street, on March 12, 1974 at 7:30 P.M., on the abovementioned petition',' and that the Town Clerk be and he hereby is authorized and directed to cause notice of said hearing to be published in the official newspaper pursuan~ to the requirements of law. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice suter, Justice Doyen. On motion of Councilman Homan, seconded by Justice Suter, it was RESOLVED that Frank Cichano~icz, Jr. be and he hereby is appointed to the Southold Town Conservation Advisory Council for a period of two years, effective December 31, 1973, term ending December 31, 1975. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Doyen. Moved by Councilman Homart, seconded by Councilman Rich, it was RESOLVED that Terry Marnan be and she hereby is appointed to the Southold Town Conservation Advisory Council for a period of two years, effective February 1, 1974, term ending February 1, 1976. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Doyen. Moved by Councilman Homan, seconded by CounCilman Rich, it was RESOLVED that Mabel Lytle be and she hereby is appointed to the Board of Assessment Review for a period of five years, effective February 22, 1974, term ending February 22, 1979. Vote of the Town Board: Ayes: Supervisor Martocchia, Councilman Rich, Councilman Homan, Justice Suter, Justice Doyen. Moved by Justice Suter, seconded by Councilman Homan, WttEREAS Frederick Rees and Harold Reese have made application to the Town Board to dedicate certain highways at South©ld to be known as Harbor Lights Drive, Brigantine Drive, Anchor Lane, Windjammer Drive ...... ~---, Clipper Drive, more fully described in said petition, together with release executed by the owners thereof, add WHEREAS the Highway Superintendent has inspected the said highways and has advised the Town Board that said proposed highways Comply in all respects with the speCifications for the dedication of highways in the Town of Southold, NOW, THEREFORE, BE IT RESOLVED that the Town Clerk be and he hereby is authorized and directed to forthwith cause the dedication~ release and deed to be recorded in the office of the Clerk of the County of Suffolk. MOved by Councilman Homan, seconded by Councilman Rich, it was RESOLVED that the Superintendent of Highways of the Town of Southold be authorized to advertise for bids and to purchase from the lowest responsible bidder, the following, more or less, as may be needed: (a) 2,500 tons of 3/8" Blue Stone, to be delivered by truck to the Highway Department Yard, at Peconic, N.Y., and each truck must have a weight slip. Mrs. Jean Tiedke and Mrs. ~oraine Terry discussed the wet,land problem at Hummels Pond, Southold. There was a discussion relative to teenage centers and youth activitie~ Mrs. Loraine 'Terry suggested an extension of Mill ~Creek bridge for ~ ? fishing. Mrs. Gladys Csajko, President of the Council of Allied Associations of the North Fork Taxpayers Association, Inc. read a ~letter to the Town Boar d (copy of which is on file in the Town Clerk's Office), protesting the Town Board offering only one Town Hall site %o the voters at the Special Election to be held March 5, 1974. Lengthy discussion was held relative to the location and building of a new town hall by many interested ~itizens present at this meeting. Meeting adjourned at ~:05 P.M. Albert W. Richmond To~n Clerk
