The meeting was called to order at 1:30 P.M. with the following present: Supervisor Tuthill; Councilmen Albertson and Demarest; Justices Tuthill and Clark; Supt. of Highways Price; Town Attorney TaSker and Town ClerkRichmond. MoVed by Justice Clark: seconded by Councilman Demarest: RESOLVED: That the minutes of the meeting of September 13, 1960 be and they are hereby duly approved as read. Vote of TownBoard: Ayes-Supervisor Tuthill; Councilmen Albertson and Demarest; Justices Tuthill and Clark. Moved by Councilman Albertson; seconded by Justice Clark: RESOLVED: That the regular monthly meeting of the Town Board be held at the office of the Supervisor, 16 South Street, Greenport,N.Y. on Monday, Oct. 10, 1960, at 1:30 P.M. Vote of Town Board: Ayes-Supervisor Tuthill; Councilmen Albertson and Demarest; Justices ~uthill and Clark. Mr. William Krause appeared before the Board as a representative of the Auxiliary Police asking that the Town Board consider a car for their use on duty at church, etc. The Board would consider that matter at a later date. Moved by Councilman Albertson; seconded by Justice Tuthill: RESOLVED: That the report of Ralph P. Cox, Dog Warden, for the month of September be accepted by the Town Board and placed on file. Moved by Councilman Albertson; seconded by Councilman Demarest: ~HEREAS7 a petition was received from FRANK PUMILLO requesting a change Ofczone of certain property situated in Mattituck, N.Y. , more fully described in said petition by extending "B" B~siness District southerl~ to cover all of said parcel., NOW, THEREFORE, BE IT RESOLVED: That the Town Clerk of the Town of Southold be and he hereby is directed to transmit this petition to the Planning Board in accordance with the Section 901, Subdivision C of Article IX of the Building Zone Ordinance of the Town of Southold. Tuthill, Mattituck, N.Y. be and hereby is granted for year round o occupancy for a .two year period. EdWin S, Voorhis & Sons, Inc., consulting Engineers on City Planning urged that consideration be given them as the Town's Consultants on mat~ers of engineering and community planning. The Town Board decided to study the plan. Moved by Justice Clark; seconded by Councilman Albertson: RESOLVED: That the report of Howard M. Terry, Building Inspector, for ~he month of September be accepted by the Town Board and placed on file. At 2:00 P.M. in accordance with a motice published according to law, bids were opened on two radios~for the Police Department. Tuthitl, Supervisor, be and he hereby is directed to enter into a contract with Motorola Communications and Electronics, Inc. for the purchase of two Radios in accordance with bid submitted by the said Motorola Communications & Electronics, Inc. Vote of Town Board: Ayes-Supervisor Tuthill; Councilmen Albertson and Demarest; Justices Tuthill and Clark. The Town Board meeting was recessed at 2:30 for the he~ringgon the Boat Ordinance. At 2:30 P.M. the Supervisor opened the public hearing authorized pn~- suant to a resolution of this Board on the 13th day of September,~ 1960, on the following ordinance: Ordinance Regulating the Use of Boats within the Town of Southold. Moved by Justice Tuthill; seconded by Councilman Demarest: ~REAS, ~ the Town Board thought it advisable to have better fire protection in the boiler room at the Town clerk's Building, Southold, N.Y. RESOLVED: That Supervisor Henry H. Tuthill enter into contract and purchase and install two Automatic Ceiling Sprinkler type FireExtinguishers the sum not to exceed $200.00. Miner and John Kaelin, to change from "C" Industrial District to "A" Residential & Agricultural District their property on west'side of Youngs Avenue, Southold, N.Y. 3. Alexander T. NOW, THEREFORE, BE IT RESOLVED: That theg~outhold Town Building Zone Ordinance including the Southold Town~Building Zone Maps be ~mended by changing from "A'~ Residential and AGricultural District to "B'~ Business District the following described property: ALL that certain ~ract or parcel of land situated at Laurel, in the Town of Southold, Suffolk County, New York, and more particularly bounded and described as follows: 885 BEGi~F~ING at the intersection of the northwesterly line of Main (State) Road With the southwesterly line of Aldrich Lane and running thence south- westerly along said northwesterly line of Main (State) Road 750 feet to a point 50 feet southwesterly from a store building; thence westerly on a line about at right angles to said Road line, 200 feet to the boundary line between land of Mary E. Moved by Justice Clark; seconded by Councilman Demarest: RESOLVED: That the Southold Town Building Zone Ordinance be amended to read as follows: I. By amending Article II, Section 200, to read as follows: SECTION 200-USE DISTRICT REGULATIONS-- For the purpose of this Ordinance, the Town of Southold, outside of the incorporated villages, is hereby divided into four (4) classes of districts which shall be designated as follows; "A" RESIDENTIAL AND AGRICULTURAL DISTRICTS ~'M" MD-hTIPLE RESIDENCE DISTRICTS "B" BUSINESS DISTRICTS "C" INDUSTRIAL DISTRICTS II. By amending Article III, Section 300, Subdivision 9, to read as follows: 9.--The sale at retail2of farm, garden or nursery products produced or grown on the premises or of animals raised on the premises. (t) advertising sign, either single or double faced, not larger than four (4) feet by six (6) feet in size, advertising the sale of farm, g garden or nursery products produced or grown on the premises or of animals'~aised on the premises. IIIl By amending Article III, Section 300, Subdivision 10, to read as follows: 10--One (1) real estate sign, either single or double faced, not larger'than three (3) feet by four (4) feet in size, on any one (1) or more lots, advertising the sale or lease of only the premises on which it is maintained and set back not less than the required front yard distance and not less than ten (10) feet from each side line. V.'By amending Article IIIA, Section 360, Subdivision 2, to read as follows: - ~ ~ (2) On premises used for hotel, motel, boarding and tou~risthouse pnrposes, unless otherwise provided as a special exception by the Board of Appeals as hereinafter provided, one (1) adve~ti~ih~ sign, either single or double faced, not exceeding fifty (50) square feet in area, the lower edge of which shall be not less than four (4) fee% above the ground, and the u~per edge of which shall not exceed more than thirty-five (35) feet above the ground. Such sign shall ad- vertise only the business conducted on the premises, and shall be set back not less than five (5) feet from all street and property lines. VI. By amending Article IV, Section 400, Subdivision 7, to read.as follows: 7--Places of amusement when approved as a special exception by the Board of Appeals as hereinafter provided. VII', By amending Article IV, Section 400, Subdivision 9, to read as follows: 9--Public garages, motor vehicle service stations and park- ing lot areas for the storage of new or used motor vehicles for sale or hire, when approbed as a special exception by the Board of Appeals as hereinafter provided. After much discussion, the petition of George Atec from "A" Residential and Agricultural District to "C" Industrial District was held over.for a later date. Moved by Councilman Demarest; seconded by Justice T~thill: W~EREAS, the Town Board of the Town of Sou~old held a publichear~ing at the Supervisor's Office, 16 South STreet, Greenport, N.Y. on-Oct. 4, 1960, at 2:30 P.M. on said day on the question of the enactment~of an Ordinance entitled "AnOrdinance Regulating the Use of Boats Within the Town of Southold" at which time and place all interested persons were given opportunity to be heard, and WHEREAS, the Town Board of the Town of Southold deems it in the public interest that said proposed ordinance should be enacted, Nm, THEREFORE, BE IT RESOLV~and ORDAINED that the Town of Southold enact the following ordinance to'wit:- AN ORDINANCE REGULATING THE USE OF BOATS WITHIN THE TOW/{ OF ~3UT~OLD. Section 1. Short Title. This Ordinance shall be known as the "Boat Ordinance of the Town of Southold". Section 2. Areas Covered The following rules and regulations shall apply to all waters within the Town of~ SouthOld and 'to all waters bounding the T~wn of SouthQld_ to a distance of 1,500 feet from the shore; provided that they shall not appl~ to waters within or bounding an incorporated village of the Town to a distance of 1,500 ~eet from the shore. Section 3. definitions The term "boat'~ shall~mean and include .every vessel propelled in any manner, except vessels having a valid marine document issued by the Federal Bureau of Customs or any foreign government. Section 4. SaDitation The'~dumping~ of oil, refuse, garbage, sewage or waste is pr~ohibited except that toilets may be discharged in any areas not within~l,080 ' feet of any shore line. ~Ection 5. ~azards to Navigation (a) Any boat which be comes a menace to navigation or unseaworthy or sinks, grounds or otherwise becomes disabled or incapable of nau±gation shall be removed or restore~ to navigable condition by the registered owner upon notice.Tro~ the Southold Town Board or its designated agent which notice shall be either by personal service or registered mail addressed to the registered owner's last known address as given by him or as stated in.his certificate of registration. (b) If such boat is not removed or restored to navigable condition the said owner~n~week afterthe mailing of said notice, the~Southold Town Board or its ~esignated agent may direct the removal or destruction of the boat, and the cost of said removal including storage charges shall attach to and shall become a lien upon said boat, and said boat may be sold upon direction of the court at public auction to defray ~aid expenses, any surplus being returned tothe owner of record. The Town shall not be liable for any damage done to said boat during its removal, storage and sale. Section 6. Operation near Bathers · No boat propelled other than by hand shall cruise or be operat~d~ within 100 feet of an~ life lines or bathing float or i$ there be no life lines or bathing float, then within 100 feet of any publi¢~ or semi-public beach regularly used for bathing or swimming, except~that such boat may approach or depart perpendicularly to such beach at less than five miles per hour solely for the purpoae of commencing or ending the ride. Section 7. Water Skiers (a) No person shall operate a boat for towing a person on water skis-, a surf-board, or similar device unless there is in such boat or vessel a person other than the operator in a position to observe the progress c~ the person being towed. (b) No person shall ride on water skis, a surf-board, or similar device or use or operate a boat to tow a person thereon between the period from one hour after sunset to one hour before sunrise. 2;57 (c) No person sh&ll ride on water skis, a surf-board, or similar device or use or operate a boat to tow a person thereon within 150 feet of anypublic or semi-public bathing beach or public dock or within 50 feet of~ any swimmer or bather. Nor shall any such person engaged in such activities come within 300 feet of the shore line unless they approach or depart perpendicularly to the shore line and solely for t~e-purpose of commencing or ending the ride. SECTION 8. Operation of Boats or Vessels (a] The Town Board of the TOWn of Southold may by resolution limit the ~eed of boats in any waters in which this Ordinance applies and shall cause notice of such speed limit to be posted at appropriate places in the areas effected. Any person who shall operate a boat in such areas at a greatersspeed ~banf.t%e~speed specified in such notice shall be deemed to have violated thisOrdinance. ~b)~ Every person operating a boat shall at all times operate the same in a careful and prudent manner and at such a rate of speed as not to unreasonably inter~ere with the free and proper use of the waters or unreasonably endanger any person or property. Section 9. Mufflers No person shall operate a boat propelled wholly or partly by an engineoperated by the explosion of gas, gasolinm, naptha, or other sUbstance without having the exhaust from the engine run through a muffling device so constructed and used as to muffle the noise of the e~d~aust inca reasonable manner. Section 10. Aquatic Events Nothing herein contained shall prohibit the ~own Board of the Town of Southold from issuing special permits fDr aquatic events, boat races, or otherwise under proper supervision in limited areas for limited periods. Section 11. Penalties Any person who violates any provision of this Ordinance shall be guilty of an offense, and upon conviction shall be subject to a fine of not more than $100.00 or imprisonment for not more than six months or by both such fine and imprisonment. Section 12. Repeal of Conflicting Ordinances All ordinances or parts of ordinances inconsistent or conflicting with the provisions of this Ordinance are hereby repealed insofar as the~same affect this Ordinance; provided, however, that such repeal shall be only to the extent of such ~nconsistency and conflict, and in all other resoects this Ordinance shall be in addition to O~her ordinances ~gu~at~ingLa~d governing the subject matter covered by this Ordinance. Section 13. Severability If any section or provision or part thereof of this Ordinance shall be adjudged invalid such invalidity shall not affect the validity of this Ordinance as a whole or of any other section or provision thereof. Section 14. Effective Date This Ordinance sh~ll take effect immediately. BE IT FURTHER RESOLVED, that the Town Clerk cause the foregoing ordin- ance to be entered in the minutes of the Town Board, and cause a copy specifying the date of adoption thereof to be ~ntered in the ordinance book of the Town of Southold, and that said Clerk further cause~.a copy of said ordinance to be published omce in the Long Island Traveler- Mattituck Watchman, a newspaper published in the Town of Southold, and a copy thereof to be posted on the signboard maintained by the Town Clerk, and th~affidavits of such publication and posting be filed with the Town Clerk, and BE IT FURTHER RESOLVED, that the Town Clerk cause a copy of the forego- ing ordinance to be submitted to and approved ~n writing by the Conser- vation Commissioner of the State of New York, pursuant to the provisions of Section 130 of the Town Law. Moved by Jus~ ice clark; seconded by Justice Tuthill: WHEREAS, the Burton Potter Post ,~185 American Legion has applied to the Town Clerk of the Town of Southo!d for a Bingo License and WHEREAS, the Town Board has examined the application and af~ter invest-' igating the matter, duly made findings and determinations as require~.'~ by law, NOW, THEREFORE, BE IT RESOLVED that the Supervisor be and he here~by is authorized and directed to execute on behalf of this Board the findings and determinations required by law and it is further RESOLVED: That the Town Clerk be and he hereby is directed to issue a Bingo License to the Burton P~tter Post ~185 American L~egion. Wentworth Horton, former Supervisor of the Town of Southold,. and former Senator of the New York State Legislature, and WHEREAS, in his service to the people of the Town of Southold as Supervisor from January 1934 through 1948 and to the people of ~the State of New York as New York State Senator from 1946 to 1956, Senator.Horton distinguished himself as a thorough and conscientious public servant, RESOLVED: That the Town Board of the Town of Southold hereby gives'formal expression of its loss in the death of Senator Horton, a man esteemed by his associates and respected by all, and BE IT FURTB-ER RESOLVED. that when the Town Board adjourns this day, it do so out of respect to the memory of the Honorable S. Wentworth Hor ton, and BE' IT FURTHER RESOLVED, that a copy of ~a' is resolution be sDread upon the minutes of this meeting and ~a copy be transmitted to Mrs. Horton that we may extend to her and to the members of the family our sincere sympathy.
