HomeMy WebLinkAboutTB-07/05/1960The Southold Town Board met at the office of Supervisor Henry H. Tuthill at Greenport, on Tuesday, July 5, 1960. The meeting was call- ed to order at 7:30 P.M. with the following present: Supe=visor Tuthill; Councilmen 'Albertson and Demares=; Justices Tuthill and Clark; Supt. of Highways Price; Town Attorney Tasker and Town Clerk Richmond. At 7:30 P.M. the Supervisor opened the public hearing authorized pur- suant to a resolution of the Board adopted on the 21st day of June, 1960, on the application of Theodore & Mary Doroski for a change of zone from "A" Residential and Agricultural District to ~B" Business District of certain property situated at Cutchogue, N.Y. a~ describmd in said petition. The minutes of the hearing were recorded by Judith Boken. Moved by Councilman Albertson; seconded by Justice Clark: WHEREAS, Theodore & Mary Doroski by petition verified the 21st day of June, 1960, petitioned the Town Board for a change of zone of certain meal property described in said petition from "A" Residential and A~ricult~mal District to "B" Business District, and WHEREAS, the said petition was referred to the Planning Board for its official recommendation and report, and WHEREAS, the Town-Board pur.suant to due notice thereof, held a hearing on said petition on July 5, 1960, at which time all interested persons were given an opportunity to be heard, NOW, 'THEREFORE, BE IT RESOLVED: That the Southold Town Building Zone Ordinance including the Southold Town Building Zone Maps, be amended by changing from "A" R~side~ial and Agricultural District to Business District the following described property: ALL that certain tract or parcel of land situated at Cutchogue in the Town of Southold, Suffolk County, New York, and more particularly bounded and described as follows: Beginning at a point on the north- westerly line of the Main Road, which point is about 535 feet measured southwesterly along said northwesterly line from Cox's Lane, said point of beginning being the southwesterly corner of land of John PietroWicz and the southeasterly corner of land of Theodore Doroski, from said point of beginning running southwesterly along said north- westerly line of the Main Road, 207 feet, more or less, to land of Felix Doroski, thence northwesterly along said land of Felix Doroski (Being. along the existing "B" Business District) and continuing along land of Mary Doroski, 340 feet; thence northeasterly along said land of Mary Doroski, 185 feet, more or less, to land of John Pietrowicz; thence southeasterly along said land of John Pietrowicz, 340 feet to the point of beginning. Vote of Town Board: Ayes-Supervisor Tuthill; Councilmen Albertson and Demarest~ Justices Tuthill and Clark~ Moved by Justice Tuthill; seconded by Justice Clark: WHEREAS, EDWARD BURKE has applied to the Town Board for a single trailer permit dated June 20, 1960, NOW, THEREFORE, BE IT RESOLVED: That the application of Edward Burke to locate a single trailer on his property at East side of Bay Avenue Mattituck, New York, be and hereby is granted for year round occupancy for. a two year period. Vote of Town Board: Ayes-Supervisor Tuthill; Councilmen Albertson an d Demarest; Justices Tuthill and Clark. Moved by Councilman Albertson; seconded by Councilman Demarest: RESOLVED: That the application of ETHEL LISTING for a permit to locate a single trailer on her property at Sound Avenue, Peconic Shores, be and hereby is denied on grounds of insufficient lot area, and the fee of $5.00 which accompanied the application be returned. Vote of Town Board: Ayes-Supervisor Tuthill; Councilmen Albertson and Demarest; Justices Tuthill and Clark. Moved by Justice Tuthill: seconded by Jus~ce Clark: W~EREAS, Raymond Brown has applied to the-Town Board for a single trailer permit, by application Dated June 20, 1960, NOW, ~HEREFO~E, BE IT RESOLVED: That the application of Raymond Bmown to locate a single trailer on his property at west side Private Road ofi Grand Avenue, Mattituck, N.Y.~be and ~ereby is granted ~or year round occupancy zor a two year period, on condition that t~e grounds be Kept in an orderly manner. Moved by Councilman Albertson; seconded by Justice Clark: CAPITAL NOTE RESOLUTION DATED JULY 5, 1960 A RESOLUTION AUTHORIZING THE ISSUANCE OF A CAPITAL NOTE OF THE TOWN OF SOUTHOLD IN THE AMOUNT OF $3,800.00, TO PAY THE COST OF THE ACQUIS ITI~' OF LAND FOR USE AS A PUBLIC' PARKING PLACE IN AND FOR THE TOWN OF SOUTHOLD, SUFFOLK COUNTY, NEW YORK. WHEREAS, the Town Board of ~ne Town of Southold, Suffolk County, New York, by a resolution thereof duly adopted on the 7th day of June, 1960, authorized the acquisition of the land hereinafter described, for use by the Town of Southold as a public parking place at a maximum cost of $3,800%00, to be paid for by the issuance of capital notes of said Town, pursuant to the Local FiRance Law, NOW, THEREFORE, BE IT RESOLVED: Section 1. The specific object or purpose for which obligations are to be issued pursuant to this resolution is to finance the cost of the acquisition of the following described land to be used by the Town of Southold as a public parking place in and for the Town of Southold, to wit: ALL that certain tract, piece or parcel of land, situate, lying and being at Southold, in the Town of Southold, Suffolk County, New York bounded and described as follows: BEGINNING at a monument on the southerly line of Main Road about 334 feet westerly along said southerly line from Mechanic Stree~ said point of beginning being the northwesterly corner of land of the South- old ParkDistrict; from s~ ~oint of beginning running along said land of ~he Southold Park District, South 29 degrees 05 minUte~ 30 seconds East 134.3 feet to a monument and land now or formerly of Reidar Carstensen; thence along said land of Carstensen, South 60 degrees 36 minutes 30 seconds West 77.9 feet to a monument on.the easterly line of a 20 foot right-of-way leading to land now or formerly of Bridge; thence along said easterly line of said 20 foot right-of-way, North 29 degrees 23 minutes 30 seconds West 33.4 feet to an.iron .bolt, and land now or formerly of Margery D, Burns; thence along said land of Bur~s, two courses as follows: (1) North 60 degrees 00 minutes East 16.0 feet; thence (2)-North 29 degrees ~23 minutes 30 seconds West 100.0 feet to said southerly line of Main Road; thence along said southerly line of Main Road, North 60 degrees 00 minutes East 62.6 feet to the point or place of beginning. Se~ct.ion 2. The estimated maximum cost of the aforesaid object or pur- pose is $3,800.00. Section 3. The plan of financing the aforesaid object or purpose is by the issuance of a $3,800.00 capital note, which is hereby author- ized to be issued pursuant to the provisions of the Local Finance Law. Section 4. It is hereby determined that sub-diviSion 21(a) of paragraph a Qf Section 11.00 of the Local Finance Law applies to such object or purpose, and that the period of probable usefulness thereof is 30 yrs. Section 5. The faith and credit of the Town of Southold, Suffolk County, New.York, are hereby irrevocably pledged to the payment of the principal of and interest on such note. An amount sufficient to pay the principal and interest on such capital note shall be included in the annual budget and~levied as a part of the taxes for the fiscal year in which the same matnres. Section 6. It is hereby determined that' no down payment is necessary in connection with the aforesaid object or purpose. Section 7. Subject to the provisions of the Local Finance Law, the power t~ sell such capital note is hereby delegated to the Supervisor, the chief fiscal officer. Such note shall be of such terms,~form and contents, and sh~ll be sold in such manner, as may be prescribed by the Supervisor, consistent with the provisions of the Local Finance Law. Section 8. The validity of such note may be contested only if: (1) Such note is authorized for ~n object or purpose for which said Town of Southold is not authorized to expend money, or (2) The provisions of law which should be complied with at the date of publication of this resolution are not substantially complied with, and an action, suit or proceeding contesting such validity is commenced within twenty days after the date of such publication, or (3) Such note is authorized in violation of the provisions of the constitution. Section 9. This resolution which takes effect immediately, shall be published in full in the Long Island Tr~veler-Mattituck Watchman, Southold, New York, together with a notice of the Town Clerk in Sub- stantially the form provided in Section 81.00 of the Local Finance Law.
