The Southold town Board met at the office of Supervisor Henry H.
Tuthill at Greenport, on Tuesday, May 10, 1960, The meeting was,_
called to order at 1:30 P.M. with the following present: Supervisor
Tuthill; Councilmen Albertson and Demarest; Justices~Tuthill' and
Clark; Supt. of Highways Price and Town Attorney Tasker.

WHEREAS, the Town Board has learned with deep sorrow of the death
of A. Halsey Brown, an assessor of the Town of Southold, and
WHEREAS, A. Halsey Brown has served the Town faithfully as an
assessor for many years,
NOW, THEREFORE, BE IT RESOLVED that in recognition of the long
and untiring service of A. Halsey Brown as a member of the Board
of Asseseors of the Town of Southold, the Town Board of the Town
of Southold hereby expresses/its sorrOw at the loss of a good
personal friend as well as a valuable Town Official.
BE IT FURTHER RESOLVED: That~hen the Town Board adjourns this
day, it do so out of respect to the memory.of A. Halsey Brown.
BE IT FURTHER RESOLVED that a copy of ~his resolution be made a
part of the official minutes of the Town Board of the Town of
Southold and that a copy be transmitted to Mrs. Brown that the
Town Board may extend to her ~nd~%~ the members of the family an
expression of its sincere sympathy.

WHEREAS, there exists a vacancy in the office of Town Assessor
caused by the death of A. Halsey Brown,
NOW, THEREFORE, BE IT RESOLVED: That Edna A. Brown of East Marion,
N.Y., be and she hereby is appointed assessor of said Town to fill
the vacancy existing in such office of assessor. Such appointment
is ~ffective immediately and the said Edna A. Brown shall hold such
office until January 1, 1961.

A RESOLUTION AUTHORIZING THE ISSUANCE AND SALE OF
DEFERRED PAYMENT NOTES OF THE TOWN OF SOUTHOLD,
SUFFOLK COUNTY, NEW YORK IN THE AMOUNT OF $10,000.
TO PAY A PART OF THE COST OF PURCHASING A TRUCK CRANE.
BE IT RESOLVED: by the Town ~oard of the Town of Southold, Suffolk
County, New York, as follows:

Section 1. The ~pecific object'or purpose for which obligations are to
be issued pursuant to this reSOlution is to finance a part of the cost
of purchasing a new truck cra~e~for the To~n of Southold, Suffolk
County, New York,
SECTION ~2~~ The estimated maximum cost of such truck crane is $21,960.

(a) $6,460. is to be provided by mact~inery traded-in pursuant
to section 142, subdivision 5 of the Highway Law of the
value of $6,460.
(b) By current funds in the amount of $5,500. to be paid

(c) The balance of the cost is to be provided by the issuance
of a deferred payment note in the mmount of $I0,000. pursuant-to
this~reSolution.
SECTION 3. It is hereby determined that subdivision 28 of paragraph
a of Section 11.00 of :the Local Finance Law applies to such object or
purpose, and that the period of probable usefulness thereof is five years.
SECTION 41 The faith and credit of the Town of ~outhold, Suffolk
County, New York, are hereby irrevocably pledgea to the payment of the
principal of and interest on such note and an amount sufficient to
pay not less than twenty per centum (2~) of the aggregate principal
amoun~ 6f such note, together ~ith~the i~terest thereon, shall be in-
cluded inthe ne~t annual budget of said Town.
SECTION 5. It is hereby determined that no down t~aym~nttis necessary
in connection with the aforesaid object or purpose.
SECTION 6. Subject to the provisions of the Local Finance Law, the
power to sell such deferred payment note is hereby delegated to the
Supervisor, the chief fiscal officer, Such note shall be of such terma,
form and contents, and shall be sold in such manner, as may be pre-
scribed by the Supervisor, consistent with the provisions of the Local
Finance Law.
SECTION 7~ The validity of such note may be contested only if~
(1) Such note is authorized for an object or purpose for which
said Town of Southold is not authorized to expend money, or
(2) The provisions of law which should be complied with at the
date of publication of this resolution are not substantially
complied with, and an action, suit or preceeding contesting such valid-
ity is commenced within twenty days after the date of such publication, or
(3) Such note is authorized in violation of the provisions of
the constitution.
SECTION 8. This resolution which takes effect immediately, shall be
published in full in the Long Island Traveler,Mattituck Watchman,
Southold,-New York, together with a notice of the Town Clerk in sub-
stantially the form provided in Section 81.00 of the Local Finance Law.

The resolution having received at least a two-thirds vote of the members
of'theTown B~d, was declared by the Supervisor to be duly adopted.

RESOLVED: That the report of Ralph P. Cox, Dog Warden, for the month
of April, be accepted by the Town Board and placed on file.

RESOLVED: That effective as of May 10, 1960, Judith T. Boken, Senior
Stenographer to the Board of Appeals, Planning Board and Building
Inspector,. be and hereby is employed on a permanent basis, and be it

RESOLVED: That the compensation for such services be fixed at $4200.00
per year, paYable in regular momthly installments.

Burton-Potter Post, Greenport, the sum not to exceed $100~00, said
sum to be paid upon presentation of vouchers in said amount by said
Committee.

W~EREAS, W. Harry Lister, as president of Boatman's Harbor Inn;~
applied to the Town Board for some financial assistance in dredging
the entrance of Wickham Creek, now, therefore, be it
RESOLVED: That Henry H. Tuthill, Supervisor, be and he hereby is'
authorized on behalf of the Town of Southold to contribute a sum
not to exceed $300.00 toward the cost of dredging the entrance ~of
Wickham Creek at Fleets Neck, Cutchogue, Town of Southold, N.Y.

WHEREAS, a pet~t~on~w~as received from Helene J. Schmidt requesting~
a change of zone of certain Property described in said petition-from
"A" Residential and A~ricultural District ~ "M" Multiple Residence

NOW; T~EREFORE, BE IT RESOLVED: That the Town Clerk of the ~own of
Southold be and he is hereby directed to transmit this application
to the Planning Board in accordance with'Section 901, Subdivision C
of Article IX of the Building Zone Ordinance of Town of Southold, .:

NOW, T~EREFORE, BE IT RESOLVED: That Supervisor ~enry H. Tuthill be
and he hereby is authorized and directed to return to Ernest G.
Radford the sum of $25.00 which accompanied the petition.

W~REAS, the Town Superintendent of ~ighways has requested that he
be authorized to rent a roller for the repair of Town ~ighway~
NOW, T~REFORE, BE IT RESOLVED: That the Town Supt. of Highways be
and he hereby is authorized to rent a roller to be used for the repair
and improvement of town h~ghways at an hourly rate of $2.00 such
rental, however, shall be subject to the approval of the County Supt.
of Highways.

BE IT FURTHER RESOLVED: That the expense thereof be paid by the
Supervisor, upon written order of the Town Supt., out of moneys
received by him for the repair and improvement of highways.

RESOLVED: That Justice Henry Clark be and hereby is authorized
to enter into a contract with Paul Corrazzini to black top launch-
in~a~p at Sterling Creek in Greenport, New York, the sum not
to excee~ $200.00.

RESOLVED: That General Bills in the amount of $6,935.70; Lighting
District Bills in the amount of $2,226.17; Fishers Island Ferry
District Bills in the amount of $9,699.57 be and the same are
hereby ordered paid.

WHEREAS, the United States of America has requested that the Town
Board of the Town of Southold authorize it to use a certain pDrtion
of the Fishers Island Airport property for the purpose of establish-
ing a field strength station thereon, and
WHEREAS, the Town Board has determined that such proposed use by
the United States of AMerica will not interfere with the use
of said airport and airpprt property by the Town of Southotd,
NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of
Southold hereby grants to the United States of America the right
and privilege to install a six inch by six inch concrete marker
set flush with the grade all as indicated on a certain map entitled
"Proposed Location of Field Strength Station, Fishers Island, Ne w
York, PW.SKNo.200, dated Noven~mer 2, 1959" and to use a working
space confined to a fifteen foot radius ~hout said marker for the
purpose of establishing and operating the aforesaid field strength
station, together with the right of ingress and egress to and from
said Station for an indefinite period of time subject however to
revocation at the option and discretion of the Town of Southold
upon thirty days notice to the United States of America.
BE IT FURTHER RESOLVED that the Supervisor of the Town of Southold
be and he hereby is authorized and directed to execute and deliver
a permit to the United States .of America containing the terms and
conditions as herein provided.

WHEREAS, there has been confusion as to the intent of paragraph 2
of Information Sheet-Building Zone Ordinance, Town of Southold,
N_Y., dated April 29, 1957, relative to Southold"Building Ordinance
RESOLVED: That in order to eliminate any doubt as to the meaning
of said paragraph, that paragraph 2 of said information sheet be
amended to read as follows:
"~f you intend erecting a house or building, or altering your
present structure, you will require a building permit. However,
any alterations inside your present structure which do not affect
the ground floor area or ground use area do not require a building
permit. Acces~'ory buildings, including all types of farm buildings
except, migrant camps, do not require a permit, provided that all
use, height, and yard requirements have been complied with.

WHEREAS, the Board of Appeals and the Planning Board of the Town of
Southold have recommended thaTthe Building Zone Ordinance ~of the
Town of Southold be amended as hereinafter set forth, and
WHEREAS, a joint meeting of the Planning Board, the BOard of Appeals
and the Town Board was held on the 25th day of April, 1960, at-which
time the amendments hereinafter set forth were examined and studied,
and WHEREAS, the ~o~nnB~ard deems it in the best interest of.the Town
of Southold that the following amendments to the Southold Town' Buiid-
lng Zone Ordinance be enacted,
NOW, THEREFORE, BE IT RESOLVED: That the Town Board On it~wnmotion
amend the Southold Town Building Zone Ordinance as follows, tO-wit:-
I. By amending Article II, Section 200, to read as.follows:
SECTION ~O~--USE DISTRICT REGULATIONS --For the purpose Of
this Ordinance, the Town of Southold, outside of the incorporated
villages, is hereby divided into four (4) classes of dist~cts which
shall be designated as follows:
"A" RESIDENTIAL ANDAGRICULTURALDISTRICTS ~
"M" MULTIPLE RESIDENCE DISTRICTS
"B" BUSINESS DISTRICTS
"C" INDUSTRIAL DISTRICTS
II. By amending Article III, Section 300, subdivision 9, to
read as follows:
9--The sale at retail!of farm, garden or nursery products
produced on the premises or of-animals rai~ed on the premises.
One (1) advertising sign, either single or double faced, not larger
than four (4) feet by six (6) feet in size, advertising the sale of
farm, garden~or nursery products produced or grown on the premises
or of animals raised on the premises.
III. By amending Article III, Section 300, subdivision 10,
to read as follows:
10.--(1) real estate sign, either single or double faced,
not larger than three (35 feet by four (4) feet in size on any one
(1) or more lots, advertising the sale or lease of only ~he premises
on which it is maintained and set back not less than the required 'front
yard distance and not less than ten (i0) feet from each side line.
IV. By amending Article IIIA, Smction 350, by adding thereto
a new subdivision to be Subdivision lA to read as follows: 1 A--Two (2) Family Dwellings.
V. B~yamending Article IIIA, Section 360, subdivision 2,;
to read as follows:
(2)On premises used for hotel, motel, boarding and tourist
house purposes, unless otherwise provided as a specialexception by
the Board of Appeals as hereinafter provided, one (1) advertising ~ign,
either single or double faced, not exceeding fifty (50) square' feet
in area, the lower edge of which shall be not less than four (4) feet
above the ground, and the upper edge of which s~all not exceedmore
than thirty-fi~e (35) feet above the ground. Such sign shall advem-
tise only the business conducted on the premises, and shall be Bet
bac$ not less than five (5) feet from all street and property lines.
VI. By amending Article IV, Section 400, subdivision 7, to
read as follows:
7--Places of amusement when approved as a special exception
by a Board of Appeals as hereinafeer provided. '~
VII. By amending Article IV, Section 400, subdivision 9,
to read as follows:
9--Public garages, motor vehicle service stations and park-
ing lot/ areas for the storage of new or used motor vehicles for
sale or hire, when approved as a special exception by the Board-'of
Appeals as hereinafter provided. ~
BE IT FURTHER RESOLVED, that the Town Clerk be and he hereby is author-
ized and directed to instruct the Southold Town Planning Board in writ-
ing to prepare an official report pursuant to the provisions of Article
IX of the Building Zone Ordinance of the Town of Southotd and that
the Town Clerk transmit to the said Planning Board a copy of this
resolution for said purpose.

RESOLVED: That the Town Clerk be and he hereby is directed to
request the Long I~land Lighting Company to install one (1)
400 watt mercury vapor aerial street light north of Love Lane
nea~ the Mattituck Beach in Mattituck $1 Lighting District, as
per sketch of April 22, 1960.

A letter was received from Florence Mo~at~ Chairman of the
Co~t~uunity Service Committee, asking that trees be replaced
where Dutch Elm trees have been removed due to disease. The
Town Board stated it would l~k into the matter.
Frank Robinson and William Cronk appeared before the Town Board
asking something be done with junkyards and that jun~ dealers
licenses be enforced.
