281 MEETING OF APRIL 12, 1960. The $outhold Town Board met at the office of Supervisor Henry H. Tuthill at Greenport, on Tuesday, April 12, .1960. The meeting was called to order at 1:30 P.M. with the following present: Supervisor Tuthill; Councilman Albertson; Justices Tuthill .andf~Clark; Supt. of Highways Price; Town Attorney Tasker and Town Clerk Richmond. Moved by Justice Clark; seconded by Justice Tuthill: RESOLVED: That the minutes of the meeting of March 22, 1960, be and they.hereby are duly approved as read. Vote of Town BOard: Ayes-Supervisor Tuthill; Councilman Albertson; Justices Tuthill and Clark. -Moved by Councilman Albertsg~ seconded by Justice Clark: RESOLVED: That the regul~n~ing of the Town Board be held at the office of the SuperviSor at 16 South Street Greenport, N.Y. on Monday, April 18, 1960, at 7~30 P.M.. The insurance agents are invited to this meeting. Vote Of Town Board: Ayes-Supervisor Tuthill; Councilman Albertson; Justices Tuthill and Clark. Moved by Councilman Albertson; seconded by Justice Clark: RESOLVED: That the report of Ralph P. Cox, Dog Warden, for the month of March be accepted by the Town Board and placed on file. Vote of Town Board: Ayes-Supervisor Tuthill; Councilman Albertson; JuStices Tuthill and clark. At 2:00 P.M. the Supervisor opened the public hearing authorized pursuant to a resolution of this Board adopted on the 24th day od March, 1960, on the following petitions: (1) Grace Nickles for a change of zone from "A" Residential and Agricultural District to "B" Business on certain real property situate on south.side of Main Road, South~ld, N.Y. (2) Stanley Sledzieski for a change of zone from "A" Residential and Agricultural District to "B" Business District on certain, prop- erty£on East side of Cox Neck Lane, Mattituck, N.Y. and (3) the original motion of the Town Board to place in "B" District all the property acquired from the United States of America (Fort H.G.Wright) at Fishers Island, N.Y. Minutes of these hearings were taken by Judith Boken. Chauncey Hulse, C~airman of North Fork Advertisement Promotion Committee for Chamber of Commerce in Southold Town appreared before the Board asking for funds to carry on their work. No action was taken at this meeting. The Board received a letter from Burton-Potter Post %185 Greenport American Legion, asking for a contribution to defray expenses at a convention to be held in Greenport, June 10th. and llth, 1960, Their membership is about 6000They state it would bring b~iness and good will to the Town. Lloyd Hamilton came before the B~d suggesting property owners who adjoin property to be zoned in the Town of Southold be notified by letter. After discussion it was decided to carry on the same as before, by advertising in the local paper designated by the Board- The Long Island Traveler-Mattituck Watchman. Thomas Jurzenia came ~efore the Board suggesting that the Town investigate the possibility of obtaining bay beach and property in Greenport for public park, and if dredged in back of beach a marina could be made. Mrs. Dorothy Worth came before the Board to ask the possibility of Peconic Inlet being opened to a fair depth. Moved by Justice Clark; seconded by Justice Tuthill: WHEREAS, The Burton Potter Post $185, Greenport, has applied to the Town Clerk for a Bingo License and WHEREAS, The Town Board has examined the application and after in- vestigating the matter, duly made findings and determinations as required by law, NOW, THEREFORE~ BE IT RESOLVED: That the Supervisor be and he~her~- by isauthorized and directed to execute on behalf of this Board the findings and determinations, required by law, and it is further RESOLVED: That the Town Clerk be and he hereby is directed to issue a Bingo License to the Burton Potter Post $185. Vote of Town Board: Ayes-Supervisor Tuthill; Councilman Albertson; Justices Tuthill and Clark. Moved by Justice Clark; seconded by Councilman Albertson: RESOLVED: That George A. McMann-be retained as Special Town Attorney to represent the Town in the matter of the claim of Francis /4cDonnell and Edward McDonnell against the Town of Southold and Superintendent of Highways Harold Price. Moved by Justice Clark; seconded by Justice Tuthilt: RESOLVED: That the Police Report for the month of March be accepted by the Town Board and placed on file. Moved by Councilman Albertson; seconded by Justice Clark: RESOLVED: That SUPe=visor Tuthill be and hereby is authorized t6 purchase one Westinghouse Air Conditinner for the Supervisr's Office 16 South Street, Greenport, the sum not to exceed $200.00. Moved by Councilman Albertson; seconded by Justice Clark: RESOLVED: That Gen~al Bills in ~the amount of $5~657.12; Lighting District Bills in the amount of $3,728.20; Fishers Island Ferry District Bills in the amount of $8,103.07 be and the same are here- by ordered paid. Moved by Councilman Albertson; seconded by Justice Clark: WHEREAS, Grace Nickles, by petition verified on the 22nd dayof March, 1960, petitioned the Town 'Board for a change of zone of certain property described in said petition from "A" Residential and Agricultural District to "B" Business District and WHEREAS, the said petition was referred to the Planning Board for its official recommendation and report, and WHEREAS, the Planning Board has filed ~ts official report with the Town Board, and WHEREAS, THE Town Board, pursuant to due notice'thereof, held a hearing on said petition on April 12, 1960, at which time all interest- ed persons were given an opportunity to be heard, NOW, THEREFORE, BE IT RESOLVED: That the Southold Town Building Zone Ordinance, including the Southold Town Building Zone Map, be amended by changing from "A" Residential and Agricultural District to"B" Business District the following described propertY: ALk~that certain tract ot parcel of land situated at southold, in the Town of Southold, Suffolk County, New York, and more particularly bounded and described as follows: Beginning at a point on the southerly line of the Main Road about 380feet easterly along said soUtherly line from Town Harbor Lane, said point of beginning being the northeasterly corner of land, of L.P. Wilkinson and others; from said point of beginning running easterly along said southerly line of the Main Road, 441 feet, more or less, to land of Patricia Curcuru; thence southerly along said land of Curcuru, 204 feet,'more or less; thence westerly alongland of Grace R. Nickles parallel with said southerly line of theMain Road and at all points 200 feet southerly therefrom, 410 feet, ~more or less, to land of Overton; thence, northerly along said land of Overton and along said land of Wilkinson and ~.~ others , 206 feet, more or less, to the point of beginning. Moved by Councilman Albertson; seconded by Justice Clark: RESOLVED: ~hat Councilman Albertson contact Latham Dredging Company to remove sand from under Goose Creek Bridge, the cost not to exceed $20o.oo. Cox be raised to $2700.00 as of APril 1~ 1960. Vote of Town Board: Ayes- Supervisor Tuthill; Councilman Albertson; Justices Tuthill and Clark. At 2:00 o'clock P.M. in accordance with a notice published accord- ing ~to law, bids were opened for the operation of the concession stand and other facilities at the Southold Town Beach, located on Long Island Sound at Arshamomaque, in the Town of Southold. The following bids' were submitted: Merwin Gruschkin ..... $1200---accompanied by Treasu~er's Check of $500. Carlos DeJesus & Sanford Thornhill $600.00. Moved by Justice Clark; seconded by Councilman Albertson: RESOLVED: That this Bosrd does hereby find Gruschkin the highest bidder and awards the contract to him and that the Supervisor be and he hereby is authorized and directed to ~nter into a contract with the said Merwin Gruschkin pursuant to the time of the pro- posed contract prepared by the ~9~D::~grney· Vote of Town Bo~d: Ayes-Supervisor Tuthill; Councilman Albertson; Justices Tuthill and Clark. Moved by Justice Clark; seconded by Councilman Albertson: RESOLVED: That Henry Moisa be and he hereby~is reappointed a member of the Southold Planning Board to serve a five year term from the 1st of May, 1960 to April 30, 1965. Moved by Councilman Albertson; seconded by Justice Clark: RESOLVED: That~gU~tRosenberg be and he hereby is reappointed a member of the Southold Board of Appeals to serve a five year term from May 1, 1960 to April 19, 1965. Moved by Councilman Albertson; seconded by Justice Tuthill: RESOLVED: in accordance with the provisions of Section 147 of the Highway Law, the Supt. of Highways of the Town of Southold be authorized with the approval of the Supt. of Public Works of -Suffolk County to enter upon the private lands of Stmnley Sled- zieski to reopen an existing ditch for the free passage of water from the Highway to the creek. Moved by Justice Tuthill; seconded by Justice Clark; WHEREAS, Freddie Lawson has applied to the Town Board for a single Trailer Permit, by application dated April 1, 1960, NOW, THEREFORE, BE IT RESOLVED: That the application of Freddie Lawson to locate a single trailer on premises of Irene Ford, s/s Sound Avenue, Mattituck, N.Y., as shown on said application, be and l~reby is granted fDr year round occupancy for a one year period. Vote of Town Board: Ayes-Supervisor Tuthill; Councilman Athertson; Justices Tuthill and Clark. A letter was received by'the Southold Town Board from Robert Walden, requesting a release from the Southold Town Police in order to transfer to the Greenport ~illage Police Department. Chief Otto Anrig stated that possibly Walden would remain on the Southold Town PoliceForce~f he were allowed tO perform,. outside duty. Matter was held over u~til next meeting.
