HomeMy WebLinkAboutTB-02/16/1960MEETING OF FEBRUARY 16, 1960. The Southold Town Board met at the office of theSupervisor, Henry H. Tuthill, at Greenport, on Tuesday, February 16, 1960. The meeting was called to order at 1:30 P.M. with the following present: Supervisor Tuthill, Councilmen Albertson and Demarest; Justices Tuthill and Clark;' Supt. of Highways Price; Town Attorney Tasker and Town Clerk Richmond. The Board sat at once as a committee on audit to examine claims against the Town. Moved by Councilman Albertson; seconded by Justice Clark: RESOLVED: That the minutes of the meeting of January 26, 1960 be and they hereby are duly approved as read. Moved by Councilman Albertson; seconded by Justice Clark: WHEREAS, The Southold American Legion, Griswold-Terry-Glover Post %803 has applied to the Town Eler~ for a Bingo License and WHEREAS, The Town Board has~xa~ined the application and after invest- igating the matter, duly made findings and determinations, as re- quired by law, NOW, THEREFORE, BE IT RESOLVED: That the Supervisor be and he hereby is authorized and directed to execute on behalf of this Board, the findings and determinations required by law, and it is further RESOLVED: That the Town Clerk be and he hereby is directed to issue a Bingo License to the S~uthold American Legion Griswold-Terry-Glover Post %803. At 2 'o'clock P.M., the Supervisor opened the public hearing auth- orized, pursuant to a resolution of. this Board adopted on the 26th day of January, 1960, on a proposal by the Town Board on its own motion to amend the Building Zone Ordinance and Building Zone Map~ by changing ~rom "A" Residential and Agricultural District to "C" Industrial District certain property at Mattituck, New York, as described in said resolutiou . The minutes of the hearing were recorded by Judith Boken. Moved by Justice Tuthill; seconded by Councilman Demarest: WHEREAS, the Town Board by a resolution thereof duly adopted at a meeting held on the 5th day of January, 1960, proposed an amendment of the Southold Town Building Zone Ordinance and Building Zone Map by changing from "A" Residential and Agricultural District to "C" Industrial District certain real property located along the westerly shore of Mattituck Creek at Mattituck, N.Y. and more fully described in said resolution adopted by this Board on the 5th day of Jan., 1960, and WHEREAS, the Town Board did ~n writing instruct the Planning Board to prepare an ~fficial report defining the conditions describ~ in said proposal and determine the area so effected with its recomm- endations, and WHEREAS, the Planning. Board has filed £ts official report containing its recommendation~ith the Town Board, and WHEREAS, the Town Board on the 16th day of February, 1960, held a Public hearing on said proposal pursuant to due notice thereof, NOW, THEREFORE, BE IT RESOLVED: that the Southold Town Build~ Zone Ordinance including the Building Zone Map be amended as follows: By changing from "A" R sidentail' and Agricultural District to Industrial District, t~e following described property, to wit: ALL that certain tract, piece or parcel of land, situate, lying a~d being at Mattituck, N.Y., in the Town of Southold, Suffolk County, generally bounded and described as follows: 267 Beginning at a point on the northerly line of Naugles Drive at the southeasterly corner of the existing "C" Industrial Zone and running thence along said "C" Industrial Zone northeziy about 200 feet, then easterly about 400 feet, then northerly about 200 feet to Mattituck Creek; thence easterly along said Mattituck Creek about 250 feet to the northwesterly corner of the existing "B" Business Zone; thence along said existing "B" Business Zone southerly about 310 feet, then westerly about 60 feet, then southerly about 431 feet to the northerly line of said Naugles Drive; thence westerly~a!ong said line of Naugles Drive about 650. feet to the point of beginning. All as shown on a certain map entitled "Part of Stanley Naugles Property, Mattituck, NY." prepared by Otto W. VanTuyl, Greenport, N.Y., dated January 31, 1949 and revised January 4, 1960. Robert Seh, a member of the Mattituck Shopping Centre Association in Mattituck, N.Y. appeared before the Town Board with a letter from the business men with fifteen names attached to discuss the following: 1. Repair sidewalks on Love Lane. - ' 2. Blacktop Love Lane and Pike Street 3. Correct drainage on Love Lane. After discussion, it was decided that Harold Price, Supt. of Highways, would investigate the Town's responsibilities and Super- visor Tuthill said he would contact the County concer~ing the ~ounty property. Charles S. Witherspoon appeared before the Town Board on behalf of his outdoor advertising business and urged the Town Board to amend the zoning Ordinance as it pertains to the size and location of advertising signs. Mr. Witherspoon presented several proposed amendments which were referred to the planning Board for further study. Moved by Justice Clark; seconded by Justice Tuthill: RESOLVED: That the Supt. of Highways of the Town of Southotd be and he hereby is authorized to advertise for bids and purchase from the lowest responsible bidder 400,000 gals of Asphalt Road material or as much thereof as may be needed for the repair of Town Highways, 20,000 gals., or as much %hereof as may be needed to be delivered to Fishers Island for the repair of Town Highways from March 1st, 1960 to December 31st, 1960. Moved by Councilman Albertson; seconded by Councilman Demarest: RESOLVED: That Supt. of Highways of the Town of ~Quthold be and he hereby is authorized to purchase one (1) second handAPeel Bucket, from Municipal Machinery Co., Coram, L.I. for the sum of seventy- five dollars ($75.00). Mov~d~y Councilman Albertson; seconded by Justice Clark: DEFERRED PAYMEN~T NOTE RESOLUTION DATED FEBRUARY 16, 1960 A RESOLUTION AUTHORIZING THE ISSUANCE OF A DEFERRED PAYMENT NOTE OF THE TOWN OF SOUTHOLD IN THE AMOUNT OF $3,800.00, TO PAY THE COST OF THE ACQUISITION OF LAND FOR USE AS A PUBLIC PARI~NG PLACE iN AND FOR THE TOWN OF SOUTHOLD, SUFFOLK COUNTY, NEW YORK. ~HEREAS, the Town Board of the Tow~ of Southold, Suffolk County, New York, by a resolution thereof duly adopted on the 13th day of ~anuary, 1960, authorized the acquisition of the land ~ereinafter described, for use by the Town of Southold as a public parking place at a maximum cost of $3,800.00, to be paid for by the issuance of deferred payment notes, of said T~wn, pursuant to the Local Finance Law, NOW, T~EREFORE, BE IT RESOLVED: Section 1. The specific object or purposefor which obligations are to be issued pursuant to this resolution is to finance the cost of the acquisition of the following described land to be used by the T~wn of S~uthold as a public parking place in and for the Town ~f South©ld to wit:- ALL that ~ertain tract, piece er parcel of land, situate, lying and being at 'Southold, in the Town of Southold, Suffolk County, New York, bounded and described as follows: Beginning at a monument on the southerly line of Main Road 9bout 334 feet westerly along said southerly line from Mechanic S ~eet, said point of beginning being the northwesterly corner of land of the Southold Park District; from said point of beginning runnings. along said land of the Southold Park District, South 29© 05' 30" East 134.3 feet to a monument and land now or formerly of Reidar Carstensen; thence along said land of Carstensen, South 60© 36' 30" West 77.9 feet to a menument on the east.erly line of a 20 foot right- or-way leading to land now or formerly of Bridge; thence along said easterly line of said 20 foot right-of-way, North 29© 23' 30" West 33.4 feet to an iron bolt and land now or formerly of Margery D. Burns; thence along said land of Burns, two courses as follows: (1) North 60 degrees 00 minutes East 16.0 feet; thence (2) North 29 degrees 23 minutes 30 seconds West 100.0 feet to said southerly line of Main Road; thence along said southerly line of~~ Main Road, North 60 degrees 00 minutes East 62.6 feet to the point or place of beginning. Secti~n~':2. The estimated maximum cost of the aforesaid object or purpose is $3,800.00. Section 3. The plan of financing the aforesaid object or purpose is by the ~ss~e: of a $3,800.00 deferred payme~ ~note, which is hereby authorized to be issued pursuant to the provisions ~of the Local Finance Law. Section 4. It is hereby determined that sub-division 21(a) of paragraph a of Section 11.00 of the Local Finance Law applies to such object or purpose, and that the period of probable usefulness thereof is 30 years. Section 5. The faith and credit of the Town of Southold, Suffolk Cou3aty, New York, are hereby irrevocably pledged to the payment of the principal of and interest on such note and an amount sufficient to pay not less than twenty per centum (2~) of the aggregate prin- cipal amou~ut of such note, together with the interest Shereon, shall be included in the next annual budget of said Town. Section 6. It is hereby determined that no down payment is necessary in connection with the aforesaid object or purpose. Section 7. Subject to the provisions gf the Local Finance Law, the power to sell such deferred payment note is hereby delegated~to the Supervisor, the chief fiscal officer. Such note shall be of such terms, form and contents, and shall be sold in such manner, as may be prescribed by the Supervisor,consistent with the provi~sions of the Local Finance Law. Section 8. The validity of such note may be contested only if: (1) Such note is authorized for an object or purpose for whiCh said Town of Southold is not authorized to expend mone~? or (2) The provisions Of law which should be comp~ed with at the date of publication of this resolution are not substantially complied with, and an action, suit or proceeding contesting such validity is com- menced within twenty days after the date~of such publication, or (3) Such note is authorized in violation of the provisions of the constitution. Section 9. This resolution which takes effect immediately, shall be published in full in the Long Island Traveler, Mattituck Watchman, Southold, New York, together with a notice of the Town Clerk in substantially the form provided in Section 81.00 of the Local Finance Law. Moved by Councilman Albertson; seconded by Justice Clark: RESOLVED: That Bond $789737, issued by the Travelers Indemnity Company in the name of Wilfred C. Sinclair in the sum of $5,000.00 be and the same is hereby approved as to its form, manner of execution and sufficiency of sureties therein. Moved by Councilman Albertson; seconded by Justice Clark: RESOLVED: That Supervisor Tuthill be and he hereby is authorized anddirected to enter into a mechanical service agreement covering the service and repair of one Smith~Co~/~el 2A Typewriter with McCabe's Central Store for a period from Feb. 1, 1960 to Feb. 1, 1961 for the sum of $16.20. Moved by Councilman Demarest; seconded by Justice Tuthill: RESOLVED: That the Town Board hereby authorizes the Board of Comm- issioners of the Fishers Island Ferry District to employ Carl Christensen as Junior Clerk for said district, and that the said Carl Christensen be paid the sum of $ 1.25 per hour , said sum to be a ccharge against the Fishers Island Ferry District. Moved by Councilman ~lbertson; seconded by Justi2e Clark: WHEREAS, the Board of Commissioners of Fishers Island Ferry District desire to increase the annual cpmpensation paid to Ernest John Bowles, Purser, from $3,800.00 to $4200.00, NOW, THEREFORE, BE IT RESOLVED: That the Board of Commissioners of the FiEhers Island Ferry District is hereby authQrized to pay Ernest John Bowles, employed as Purser on ~e Mystic Isle ferry boat, an annual s~lary of $4200.00 to be effective January 15, 1960. The following letter was received from John Wic~am relative to Golden Nematode: Southold Town Board Gentlemen: This is to certify ~hat the following action was taken by the $outhold Town Planning Board at its meeting on February 1, 1960. In the matter of the proposed pregram for the eradication of Golden Nematode, the Planning Board strongly recommends that the Town Board of the Town of Southold take immediate ateps to make available funds for the eradication and control of this pest. We believe that the positive approach to this problem offers more hope, but also at the present ~ime we appear to havean unique opportunitY of cooperating with state and federal agencies in a new plan, namely treatment by fumigation of land not now infested, but "operationally exposed" Very truly yours, John Wickham, Chairman Southold Planning B©ard Moved by Councilman Albertson; seconded by Justice Tuthill: WHEREAS, the Southold Town Planning Board has prepared an official report and recommendation upon the petition of GEORGE BAILEY for a change of zone from '~A" Residential and Agricultural District to "B!' Business District on certain real property situate in Cutchogue, and described in said petition, NOW, THEREFORE, BE IT RESOLVED: That a public hearing will be held by the Southold Town Board at the Supervisor's Office at Greenport, on the 8th day of March, 1960, at 2 P.M. on the above mentioned petition, and that the Town Clerk be and he hereby is authorized and directed to cause a notice of said hearing to be published in the Long Island Traveler-Mattituck Watchman pursuant to the require- ments of law..
