In the Matter of the Petition of: DECISION Theodore Laoudis For a Variance to the New York State PETITION NO. 2002-1001 Uniform Fire Prevention &Building Code ---------------------------------------------------- Upon the application of Theodore Laoudis,filed pursuant to 19 NYCRR 450 on August 16,2002,and upon all other papers in this matter,the Department makes the following determination: NATURE OF GRIEVANCE AND RELIEF SOUGHT The petition pertains to a combustible walkway,accessory and adjacent to a two-story,Al(one family) occupancy,of type 5(wood frame)construction, located at 405 Kimberly Lane,Southold,Town of Southold,County of Suffolk,State of New York. The petitioner is seeking relief from: 9 NYCRR 716.4(b), which requires that porches,verandas and balconies of combustible construction shall be not less than three feet distant at any point from a lot line. [The petitioner requests that the walkway be maintained less than 3 feet from a lot line.] FINDINGS OF FACT 1. The portion of the walkway which is the subject of this petition is an unenclosed structure consisting of slate roof on top of 1'/2 inches tongue and groove decking supported by,18 inches diameter heavy timber logs,fastened to 3 feet x 3 feet x 5 feet high concrete and stone veneer piers. 2. The walkway is located to the south of the property and is nearest to the south interior property line. The authority having local jurisdiction considers that the walkway is subject to the provisions of 9 NYCRR 716.4(b). 3. A plot plan dated March 14, 2002 shows the north portion of the walkway as being on the north interior lot line,for a distance of approximately 14 feet. 4. if the walkway were not to be used as a platform for activity that would allow an open flame to be brought on or near to it,the threat of exterior fire spread would be reduced. / r Petition No.2002-1001 Page 2 5. The applicant,applied for and received a variance on May 2,2002 from the Town of Southold, Board of Appeals with the proviso that" In the event the owners(applicants) of either/both parcels 20.204 and 20.32 decide to convey either lot,structures within the code restricted area,15 feet of the side property line, must be removed or cut back,to meet this minimum 15 feet side yard setback." 6. The applicant prefers to conform to the code by keeping the two parcels as separate lots in order to provide for one dwellings use on each of the two lots,for a total of two dwellings on 3 plus acres. CONCLUSIONS OF LAW Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would produce a negligible additional health, safety and security benefit to the occupants of the building. DETERMINATION WHEREFORE IT IS DETERMINED that the application for a variance from 9 NYCRR 716.4(b),to permit a combustible walkway to have no minimum distance separation. as described herein, be and is hereby PROPOSED TO BE GRANTED with the following conditions: 1. That the walkway shall not be used as a platform for any activity that would allow an open flame to be brought on or near to it. 2. That the Board of Appeals decision be adhered to,should the parcels be sold. 3. That the structure meets all other applicable sections of the Uniform code. This DECISION is issued under 19 NYCRR 450.6. Unless obiected to by the petitioner in a writing received by the Department the decision shall become FINAL after fifteen days of receipt of the decision by the parties. This decision is limited to the specific building and application before it,as contained within the petition, and should not be interpreted to give implied approval of any general plans or specifications presented in support of this application.
