Therefore, in accordance with the current Tidal Wetlands Land Use Regulations (6NYCRR Part 661) no permit is required under the Tidal Wetlands Act. Please be advised, however, that no construction, sedimentation, or disturbance of any kind may take place seaward of the tidal wetlands jurisdictional boundary, as indicated above, without a permit. It is your responsibility to ensure that all necessary precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction which may result from your project. Such precautions may include maintaining adequate work area between the tidal wetland jurisdictional boundary and your project (i. e. a 15 ' to 20 ' wide construction area) or erecting a temporary fence, barrier, or hay bale berm. The petitioner is seeking relief from: 19 NYCRR Part 1220, The Residential Code of New York State, Section R312.2, which requires that the width of each landing shall not be less than the stairway or door served. Every landing shall have a minimum dimension of 36 inches measured in the direction of travel. [The petitioner requests a landing dimension measured in the direction of travel less than required.] 19 NYCRR Part 1220, The Residential Code of New York State, Section R314.2, which requires that the maximum riser height be 8-1/4 inches and the minimum tread depth shall be 9 inches. [The petitioner requests a riser height greater than allowed.] FINDINGS OF FACT 1. The first story of the subject building is to be raised approximately two feet to extend the height of the basement to approximately eight feet. In doing so, a new stair between the basement and first story is to be constructed.. 2. The original house is approximately 100 years old. To minimize costs and to maintain the existing architectural features, the petitioner wishes to place the new stairs within the space of the original stair. With the proposed location of the new stairs and the proximity of the existing rooms and spaces on the first story, there is only approximately 6 feet 10 inches to allow for the run of the stairway. If the riser height is allowed to be 8 15/16 inches, instead of the required 8'/.inches, one riser and one tread could be eliminated, and the stair would fit in the allowable space without having to disrupt the existing rooms and spaces, and would be provided with the required headroom. The local code enforcement official has been consulted in this matter and does not object to the granting of a routine variance under the provisions of 19 NYCRR 1205. CONCLUSIONS OF LAW Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would produce a negligible additional health, safety and security benefit to the occupants of the building.
