MEETING OF OCTOBER 22, 1959.
WAIVER OF NOTICE OF TOWN BOARD MEETING
WE, the undersigned, being members of the Town Board of the
Townof $outhold, Suffolk County, New York, do hereby sever-
ally waive notice of the time, place, and purpose of the meet-
ing of the Town Board to be held at Greenport, in the Town of
Southold, New York, on Thursday, Oct. 22, 1959, and do hereby
consent that the same be held on said date for the transaction
of any business which may properly come before said meeting.

The Southold Town Board met at the office of Supervisor Norman
E. Klipp, Greenport, on Thursday, October 22, 1959. The meeting
was called to order at 1:30 P.M. with the following present:
Supervisor Klipp; Councilmen Albertson and Demarest; Justices
Tuthill and Clark; Supt. of Highways Price; Town Attorney Tasker
and Town Clerk Booth.
Moved by Justice Clark; seconded by Justice Tuthill:
RESOLVED: The minutes of the meeting of October -6, 1959,
be and hereby are duly approved as read.
Vote of Town Board: Ayes-Supervisor Klipp; Councilmen Albertson
and Demarest; Justices Tuthill and Clark.
Moved by Councilman Albertson; seconded by Justice Tuthill:
RESOLVED: That the regular menthly audit meeting of the Town
Board will be held at the office of Supervisor Norman E. Klipp
at Greenport, on Thursday, November 5, 1959, at 1:30 P.M.
Vote of Town Board: Ayes-Supervisor Klipp; Councilmen Albertson
and Demarest; Justices Tuthill and Clark.
Moved by Justice Clark; seconded by Justice Tuthill:
RESOLVED: That Bond No. SM178218-4, issued by the American
Motorists Insurance Company on behalf of James J. Fitzpatrick
in the sum of Five Hundred Dollars ($500.00) be and the same
is hereby approved as to its form, manner of execution and
sufficiency of sureties therein.

Moved by Justice Clark; seconded by Conncilman Demarest:
WHEREAS, the Commissioners of the Fishers Island Ferry District
wish to enter into a bareboat charter for use of the MV Yankee
with the Interstate Navigation Company for a period commencing
at 7:00 A.M. on October 14th, 1959, and ending on October 16th
1959, at a lump sum payment of $400.00 to cover the first two
days charter, and if the charterer shall elect to continue,
thS'e~at~er thereafter, he shall pay the owner at the rate
of $175.00 per day for each additional day or part thereof,
NOW, THEREFORE, BE IT RESOLVED: That the Southold Town
Board approves of the action of the Commissioners of the
Fishers Island Ferry District on entering into the contract
as above stated with the Interstate Navigation Company.

WHEREAS, four separate proceedings have been commenced against
the Board of Assessors of the Town of South0td for the review
of the assessments upon real pDoperty by the following parties:
Arthur L. R. Francisco and Helen T. FranciscQ; Frank C.
Henderson;~ L. Barron Hill rand George E. La'ham andBDwight
Latham, be it
RESOLVED: That Edward T. Costello, Esq. of the Town of South-
old be and he hereby is retained to undertake the defense
of said proceedings on behalf of the respondents, Board of
Assessors.
Vote of Town Board: Ayes-Supervisor Klipp; Councilmen Albertson
and Demarest; Justices Tuthill and Clark.
The inventory of machinery, tools, implements and equipment
owned by the Town of Southold and used for highway purposes
was delivered to the Town Clerk by the Supt. of Highways
for filing.
Moved by Councilman Alber~tson; seconded by Justice Clark:
RESOLVED: That the Supervisor be and he is hereby authorized
to sign the revised plans and specifications for the proposed
dredging operations in Town Harbor, together with an agree-
ment on behalf of the Town of Southold assuring the County
of Suffolk sufficient easements and spoil areas in connection
therewith and also saving harmless the County of Suffolk
from any claims and damages resulting from said dredging
operation.

RESOLVED: That the Supervisor be and he is hereby authorized
to sign the necessary plans and specifications for the pro-
posed dredging operations in ~oose Creek, together with an
agreement on behalf of the Town of Southold assuring the
County of Suffolk suffieient easements and spoil areas in
connection therewith and also saving harmless the County of
Suffolk from any claims and.damages resulting from said
dredging operation.

ORDER EXTENDING
FISHERS ISLAND
FIRE DISTRICT
BOUNDARIES
The Town Board of the Town of Southold, Suffolk County, New
York, having by resolution thereby duly~adoptdd on the llth
day of August, 1959, upon its own motion, determined to hold:
a public hearing in the matter of the extension of the existing
Fire District at Fishers Island, in the Town of Southold,
Suffolk County, New York, known as the Fishers Island Fire
District, by annexing thereto the territory hereinafter
described;amd a ~ublic hearing, pursuant to due notice thereof,
having been held on the 25th day of August, 1959, at the school
building of the Union Free School District No. 4 at Fishers
Island, in the Town of Southold, Suffolk County, New York,
at which time and place said Town Board considered said matter
and heard all persons interested therein; and said Town Board
having by resolution duly adopted on the 31st day of August,
1959, following the said hearing and upon the evidence given,
thereat, duly determined athat all the property and property
owners within ~he proposed extension of said district are
benefi~ed thereby; that ~11 the property and property owners
benefited are included within the limits of the proposed
extenSion of said district, and that it is in the public
interest to grant in whol~ the relief sought and duly resolved
to'extend such fire district to embrace the additional
territory hereinafter described, subject, however, to the
approval of the State Comptroller; and within ten days after
the adoption of said resolution, the Town Clerk of the Town
of Southold having caused to be filed a certified copy of
such resolution, in duplicate, in the office of the State
Department of Audit and Control at Albany, New York, together
with an application in due form and duly executed in duplicate,
for permission to extend such district; and the State Comp-
troller having made an order in duplicate, under the date of
6th day of October, 1959, granting permission for the extension
of such district, one copy thereof having heretofore been
filed in the office of the State Department of Audit and
Control at Albany, New York, and the other copy thereof
having been filed in the Office of the Town Clerk of this Town
on the 8th day of October, 1959; and the said Town Clerk
having presented such order to the Town Board at the next
meeting thereof, to wit, at a meeting held at the above
captioned time and place;
Now, on motion of Conncilman Albertson, seconded by Council-
man Demamest, it is
ORDERED, that the said existing fire district known as the
Fishers Island Fire District be and it hereby is extended
to embrace the territory described in and containing the
following boundaries, to wit:
ALL that certain tract, piece or parcel of land, situate on
Fishers Island, in the Town of Southold, County of Suffolk,
State of New York, bounded and described as follows:
BEGINNI~G at the intersection of the southwesterly line of
Beach Avenue with the southeasterly line of Equestrian Avenue,
said ~oint being located 618.25 feet North and 3873.92 feet
West of U. S. Coast & Geodetic Triangulation Station "PROS";
from said point of beginning running along said line of Beach
Avenue, 8 courses, as follows:
(1) South 47 degrees 07 minutes 40 seconds East 514.09 feet; thence
(2) South 84 ~egrees 21 minutes 15 seconds East 345.39 feet: thence
(3) South 78 degrees 31 minutes I0 seconds East 281.33 feet; thence
(4) South 81 degrees 28 minutes East 447.94 feet; thence
(5) South 67 degrees 38 minutes East 342.57 feet; thence
(6) North 77 degrees 17 minutes ~ast 202.32 feet; thence
(7) North 26 degrees 02 minutes 30 seconds East 131.81 feet; thence
(8) North 25 degrees 36 minutes 50 seonnds West 32.38 feet
to land now or formerly of Hay Harbor Realty Corp.; ~hence
along said land of Hay Harbor Realty and across the westerly end
of a .50 foot right of way leading to land now or formerly
of the United States of America, South 39 degrees 45 minutes
10 seconds East 226.28 feet; thence still along said land of
Hay Harbor Realty, 3 courses as follows:

(2) South 76 degrees 00 minutes West 386 feet; thence
(3) South 13 degrees 20 minutes East 107 feet, more or less, to
the shore of Block Island Sound; thence in a general westerly
direction along the shore line of said Block Island Sound and
then in a general northerly direction along ehe shore line of
Fishers Island Sound, about 12,200 feet to land now or formerly
of the Estate of S. A. Salvage; thence along said land now or
formerly of the ~state of S. A. Salvage, 2 courses as follows:
(1) South 46 degrees 58 minutes East 408 feet, more or less;thence
(2) South 35 degrees 24 minutes East 424.0 feet to land nowc~or
formerly of Wilmerding; thence along said land of Wilmerding,
3 courses, as follows:
(1) South 32 degrees 36 minutes West.465.9 feet; thence
(2) South 26 degrees 57 minutes East 405 feet, more or less; thence
(3) North 62 degrees 26 minutes East 687.22 feet to the wester.ly
line of said Equestrian Avenue; thence along said line of
Equestrian Avenue, 9 courses, as follows:
(1) South 31 degrees 18 minutes East 188.41 feet; thence
(2) North 62 degrees 26 minutes East 1.61 feet; thence
(3) South 27 degrees 34 minutes East 25.0 feet; thence
(4) South 76 degrees 02 minutes 30 seconds East 105.07 feet; thence
(5) South 49 degrees 33 minutes 15 seconds East 202.44 feet; thence
(6) South 80 degrees 36 minutes 30 seconds East 127.50 feet;thence
(7) South 56 degrees 10 minutes 50 seconds East 113.37 feet; thence

be and he hereby is authorized and directed to cause a certified
copy of the resolution of this board adopted on the 31st day of
A~gust, 1959, as aforesaid, and a certified copy of this Order,
to be duly recorded in the office of the Clerk of the County of
Suffolk, New York, and it is
FURTHER ORDERED, that the Town Clerk of the Town of Southold be
and he hereby is authorized and directed, within ten days after
the adoption of this Order, to cause a certified copy thereof to
be filed in the office of the State Department of Audit and Control
at Albany, New York.
