The meeting was called to order at 1:30 P.M. with the following present: Supervisor Klipp; Councilmen Albertson;and Demarest; Justices Tuthill and Clark; Supt. of Highways Price; Town Attorney Tasker and Town Clerk Booth. Moved by Justice Clark; seconded by Councilman Demarest: RESOLVED: That the minutes of the meetin~ of July 7~be and here- by are duly approved as readl Vote of Town Board: Ayes-Supervisor Klipp; Councilmen Albertson and Demarest; Justices Tuthill and Clark. Moved by Jusitce Clark; seconded by Councilman Demarest: RESOLVED: That the minutes of the meetin of July 13 be and here- by are duly approved as read. Vote of Town Board: Ayes-Supervisor Klipp; Councilman Albertson and Demarest; Justices Tuthill and Clark. Moved by Justice Clark; seconded by Councilman Demarest: RESOLVED: That the regularmonthly audit meeting of this Board will be he~ at the office of Supervisor Norman E. Klipp at Greenport, on Tuesday, August 11, 1959, at 1:30 P.M. Vote of Town Board: Ayes-Supervisor Klipp; Councilmen Albertson and Demarest; Justices Tu~hill and Clark. Moved by Justice Tuthill; seconded by Councilman Demarest: WHEREAS, an application was made to the Southold Town Board under date of July 2, 1959, by ARTHLrR C, BUCK for permission to establish and operate a Tourist Court (Camp Cottages) located on Luthers Road in Matti%uck, N.Y. and WHEREAS, it is required by the Southold Town Ordinance providing for the regulation of Tourists Camps, house trailers, or;similar establishments, that a public hearing be held on the matter, and WHEREAS, a public hearing was held at the Supervisor's Office in Greenport, on Tuesday, July 28, 1959, at 2 o'clock P.M. and all persons attending such public ~earing given ample opportunity to apeak in favor of or in opposition tothe application, the hearing was duly closed at 2:15 P.M. and the application wa~beld for further deliberation of the Board; NOW, THEREFORE, BE IT RESOLVED: That the Town Board does hereby grant permission to ARTHUR C. BUCK to establish and operate a Tourist Court (Camp Cottages) on the above mentioned site. Vote of Town Board: Ayes-Supervsior Klipp ; Councilmen Albertson and Demarest; Justices Tuthill and Clark. Moved by Justice Clark; seconded by Councilman Demarest: RESOLVED: That Bond No. SM178188-4 issued by the American Motorists Insurance Company, on behalf of HARRY W. SMITH in the sum of Five Hundred Dollars ($500.00) be and the same is hereby approved as to its form, manner of execution and sufficiency of sureties therein. Moved by Councilman Albertson; seconded by Councilman Demarest: WHEREAS, a petition was received from HENRY G. WENZEL, JR. relative to changeo of zone, NOW, THEREFORE BE IT RESOLVED: That the Town Clerk of the Town of Southold be and he herel~y is directed to transmit this application to the Planning Board in accordance with Section 901, Subdi~. C. of Article lX of the Building Zone Ordinance of the Town of~outhold. Vote of Town Board: Ayes-Supervisor Ktipp; CounCilmen Albertson and Demarest; Justices~Tuthill and Clark. Moved by Justice Clark; seconded by Justice Tuthill: WHEREAS, a petition was received from JOHN J. FLEMING relative to change of zone, NOW, THEREFORE, BE IT RESOLVED: That the Town Clerk of the Town of Southold 9e and he hereby is directed to transmit this applic- ation to the Planning Board in accordance with Section 901, Subdiv. c of Article 1X of the Building Zone Ordinance of the Town of Southold. Vote of Town Board: Ayes-Supervisor Klipp; Councilmen Albertson and Dmmarest; Justices Tuthill and Clark. Moved by Justice Tuthill; seconded by Councilman Albertson: RESOLVED: That the Town Clerk be and he hereby is directed to re- quest the Long Island Lighting Company to install two (2) 400 ~ aerial street lights in the Mattituek No. 1 Lighting District, said lights to be placed on Poles No. 405 and No. 406 i~ front of the Mattituck Theatre on Route 25. Vote of Town Board: Ayes-Supervisor Klipp; Councilmen Albertson and Demarest; Justices Tuthill and Clark. Movedby Councilman Albertson; seconded by Councilman Demarest: WHEREAS, SOUTHOLD REALTY CORPORATION, RALPH G. REED, JR., PRESIDENT, has made application to the Town Board fDr the establishment of an Open Development Area pursuant to the provisions of Section 280-A of the Town Law, and WHEREAS, the Town Board has heretofore referred the matter to the Planning Board for itsaadvice and recommendation, and WHEREAS, the Planning Board has recommended that the application of SOUTHOLD REALTY CORPORATION be granted, NOW, THEREFORE, BE IT RESOLVED: that the Town Board of the Town of Southold does hereby establish an Open Development Area over the property of SOUTHOLD REALTY CORPORATION as shown forth on the map attached to the application. Vote of Town Board: Ayes-Supervisor Klipp; Councilmen Albertson and D~rest; Justices Tuthill and Clark. WILLIAM GUNTHER & SON appeared~before the Board presenting a copy of a letter which he stated that he presented to the Town Board at the public hearing on the proposed Building Zone Ordinance on August 31, 1956. He stated that he had been in the Town Clerk's Office and the Building Inspector's Office b~ut could not find any record of this letter on file. In the letter were several objections to the proposed Building Zone Ordinance. One was about his proposed boatyard and fishing station which he stated had been in operation sicne 1935, and was in the Residential and Agricultural District. The Supervise stated to him that the fishing station could be continued if it was in ?operation before zoning went into effect. Adjournment was at 3:30 P.M. Ralph P. Booth Town Clerk
