MEETING OF JULY 7, 1959.
The Southold Town Board met at the office of Supervisor Norman
E. Klipp at Greenport, on Tuesday, July 7, 1959. The meeting
was called to order at-1:30 P.M. With the following present:
Supervis°r Klipp; Councilmen Albertson and Demarest;'Justices
Tuthill and Clark, Supt. of Highways Price; Town Att0rney
Tasker and Town Clerk Booth.
The Board sat at once as a committee on Audit to examine claims
against the Town concluding the audit work at 1:50 P.M.
Moved by Councilman Dema~est; seconded by Councilman Albertson:
RESOLVED: That the minutes of the meeting of June 16, 1959, be
and hereby are duly approved as read.
Vote of Town Board: Ayes-Supervisor Klipp; Councilmen Albertson
and Demarest; Justices Tuthill and Clark.
Moved by Justice Clark; seconded by Justice Tuthill:
RESOLVED: That the regular monthly meeting of the Town Board
will be held at the office of Supervisor Norman E. Klipp at
Greenport, on Tuesday, July 28, 1959, at 1:30 P.M.

and Demarest; Justices Tuthill and Clark.
Moved by Councilman Albertson; seconded by Justice Clark:
RESOLVED: That FRANK S. DAWSON of New Suffolk, be and he hereby
is appointed, subject to the- written approval of the District
Superintendent of Schools, Attendance Supervisor of all schools~
throughout the Town except such schools as are otherwise pro-
vided for by Section 3213 of the Education LaW and
BE IT FURTHER RESOLVED: That such Attendance Supervisor shall
be removable at the pleasure of the District Superintendent of
Schools, and
BE IT FURTHER RESOLVED:C. That the compensation of such Ateendance
SUPervi'sor be fixed at $1200.00 per year, payable in regular
monthly installments, he to pay his oown expenses, and
BE IT FURTHER RESOLVED: That the Town Clerk be and he hereby
is instructed to notify Frank S. Dawson and the District
~'Superintendent of Schools of the appointment.

WHEREAS, an application was received from RALPH G. REED, JR.
as President of Southold Realty Corporation for an Open Develop-
ment Area, under the provisions of Section 280A of the Town Law
NOW, THEREFORE, BE IT RESOLVED: That the Town Clerk of the Town
of Southold he and he hereby is directed to transmit this
application to the Planning Board in accordance with Section 901
Subdivision C of Article 1X of the Building Zone Ordinance of
the Town of Southold.

WHEREAS, an application was received from WILLIAM WICKHAM, relative
to a change of zone,
NOW, THEREFORE, BE IT RESOLVED: That the Town Clerk of the Town
of Southold be and he hereby is directed to transmit this
application to the Planning Board ~n accordance with Section 901
SubdivisiOn C of Article lX of the Building Zone Ordinance of
the Town of Southold.

WHEREAS, The $outhold American Legion Griswold Terry Glover Post
~803 has applied to the TOWn Clerk for a Bingo License, and
WHEREAS, TheTown Board examined the applicationand as a-result
of the findings and determinations, granted the license
NOW, THEREFORE, BE IT RESOLVED: That the Town Clerk be and he~
hereby is directed to issue a Bingo License to the Southold American
Legion Griswold Terry Glover Post ~803.

RESOLVED: That the application of HAROLD L. CROWELL for a permit
to locate a single automobile trailer on his property at Mattituck, be
and hereby is denied and the fee of $5.00 which accompanied the
application be returned.

WHEREAS, ARTHUR C. BUCK has applied to the. Town Board for a permit
to establish, maintain or operate a Cottage Colony on certain real
property situate at Mattituck,
NOW, THEREFORE, BE IT RESOLVED: fThat a public hearing will be
held by the Southold Town Board at the Supervisor Office in
Greenport, on Tuesday, Ju~h~28, 1959, at 2:00 o'clock P.M. on the
above mentioned application. ~

RESOLVED: That Supervisor Norman E. Klipp be authorized to enter
into an agreement with the Commissioners of the Cutchogue Fire
District to lease a certain'parcel of ~nd situate across the
street from the Fire Department Building at Cutchogue for public
parking purpose.

WHEREAS, a communication was received from the BRUSHES CREEK
PROPERTY OWNERS ASSOCIATION INC. reqUesting some financial assist-
ance from the Town Board in opening the mouth of Brushes Creek,
RESOLVED: That the request be granted to the BrUsheS Creek Proeprty
Owners Association Inc. for financial assistance in dredging the
entrance to Brushes Creek at Laurel, Town of SoUthold, N.Y. The
Town Board will contribute a sum up to but not to exceed the sum
of $.300.00.

RESOLVED: That upon the reqUest of the Commissioners of the
Fishers Island Ferry District, the Southold Town Board approves
of the appointment of HARRY L. GUEST as Watchman, to act in the
capacity of attendant at the Fishers Island Airport, and be it
further RESOLVED: That the compemsation for such position shall
be ~350.00 per month, payable monthly and be it further
RESOLVED: that this appointment take effect as of June 26, 1959.

RESOLVED: That upon request of the Commissioners of the Fishers
Island Ferry District, the Southold Town Board approves of the
appointment of KENNETH KIERSTEIN as Watchman for the purpose of
acting as porter and auto parking attendant at the District Pier
New London, Connecticut, for a period from June 12, 1959 through
SeDtember 9, 1959, on a six-day a week basis, and be' it further
RESOBYED: That the compensation for such position shall be $50.

The Public hearing on the petition of ROBERT H. PRESTON and
LAGRANT CHAPMAN for a change of zone from "A" Residential and
,Agricultur&l District to "B" Business District was opened by
the Supervisor at 2:00 P.M~ the minutes of this hearing were
recorded by George T. Lederle.
A communication was received from the North Fork Volunteer Fireman's
Association_stating that there now exists en extreme fire hazard
where new developments for home and business construction are
being erected upon land which must first be cleared of trees and
etc. which is left in large quantities-upon the lots to become
dry'and cause danger from fire. The Association requests the
Town Board of the several Townships covered by this association
to make such laws and ordinances so that all such debris be removed.
The Supervisor was instructed to take the matter up with the
Town officials of Riverhead and Shelter Island.

WHEREAS, Elizabeth Olsen is the owner o f certain real property
including a bathing beach and parking field adjacent to Peconic Bay
at 'New Suffolk, in the Town of Southold, Suffolk County, New York,
which said property is generally bounded northerly by Jackson Street;
easterly by First Street; southerly by Peconic Bay, and westerlY
by Second Street, and
WHEREAS, the said Elizabeth Olsen has offered to lease to the Town
of Southold all of said described property except such portions
thereof u~on which are located three dwelling houses, a restaurant
building, and a refreshment stand and/or building for a term of'
three mOnths from July 1, 1959 to October 1, 1959, for the total
rent of Three Hundred ($300.00) Dollars, upon the condition that
the said Elizabeth Olsen be ~iven the right to operate th~ refreshment
stand located upon said premises, ~
NOW, THEREFORE, BE IT RESOLVED, that the T~n of Southold lease
from the said Elizabeth Olsen the followin~ described real property:
ALL that certain tract, piece or parcel of
land, situate, lying and being at New SuffOlk
in the Town of Southold, County of Suffolk
and State of New York, generallY bounded and ''
described as follows: Northerly by Jackson Street,
225 feet, more or less; easterly by First Street
250 feet, more or less; southerly by Peconic Bay
225 feet, more or less; and westerly by Second
Street, 200 feet, more or less.
Excepting from the demises premgises the following:
(a) That portion of said premises at the north-
west corner thereof upon which is erected two
dwelling buildings, said parcel having a frontage
of 100 feet, more or less, on JacKson Street,
and 90 feet, more or less, on Second Street.
(b) That portion of said premises at the north-
east corner thereof upon which is erected a
dwelling house and a restaurant, said parcel
having a frontage on Jackson Street, of 55 feet
more or less, and a frontage on First Street
of 220 feet, more .or less.
(c) The cottage and/or refreshment building
located on the southerly portion of the demised
premises, and
BE IT FURTHER RESOLVED: that the Town of southold lease said premises
upon the following terms and conditions:
(a) That the term of said lease shall be for the period of
three months to commence on the first day of July, 1959, and to end
on the first day of October, 1959:
(b) That the total rent shall be Three Hundred ($300.00)
Dollars, to be paid upon the execution of the lease as hereinafter
provided;
(c) That the said Elizabeth OlSen shall pay all real property
taxes assessed on said property during the term of said lease~
rd) That the said Elizabeth Olsen covenant and agree to keep
the demised premises clean and free from l~tter during the term of
the lease;
(e) That the said Elizabeth Olsen be given the righf to
operate the refreshment stand located on the prmmises during the term
of the lease, and
IT .IS FURTHER RESOLVED, that the Southold Town Supervisor be and he
hereby is authorized and directed to execute any and all leases and
other documents required to affect such purposes.

WHEREAS, DANTE A. LORTI has heretofore by application to the
Town Board requested that certain property described in said
application be changed from "A" Residential and Agricultural
District to "B" Business District, and
WHEREAS, by resolution of the Board, said application was
referred to the Planning Board for its recommendation and official'
report, and
WHEREAS, the Planning Board by its official report dated
June 24, 1959, recommended that the entire Block within which
said property is located be rezoned to "B" Business District,
and
WHEREAS, the Town Board has studied said application and is of
the opinion ~hat the property bounded North by land of John
Malinowski, Easterly by Second Street, Southerly by Main Street
and Westerly by Third Street be changed from "A" Residential
and Agricultumall District to "M" Multiple Residence District.
NOW, THERFORE, BE IT RESOLVED: That the Town Board on its
own motion change from "A" Residential and Agric. District
to "M" Multiple Residence District the following described

BE IT FURTHER RESOLVED: That the Town Clerk transmit a copy
of this resolution to the Planning Board for its official
recommendation and report pursuant to the provisions of
Article lX, Section 901 of the Southold Town Building Zone
Ordinance.

WHEREAS, COSTAS STARS has made application to the Town Board
for the establishment of an Open Development Area pursuant to
the provisions of Section 280-A of the Town Law, and
WHEREAS, the Town Board has heretofore referred the matter to
the Planning Board for its advice and recommendation, and
WHEREAS,the Planning Board has recommended that the application
of COSTAS STARS be granted,
NOW, THEREFORE, BE IT RESOLVED: that the Town Board of the
Town of Southold does hereby establish an OPEN DEVELOPMENT
AREA over the property of COSTAS STARS as propos~d~J't~yout~b{
a part of land of Costas Stars surveyed by Otto W. VanTuyl &
Son on June 16, 1959.

WHEREAS, THE Town Board of the Town of Southold by resolution
duly adopted on the 26th day of May, 1959, did agree to lease
to the United States Navy Department, certain property located
in 'the Fort H. G.' Wright area of Fishers Island, said property
being fully described in said resolution, and
~HEREAS, the-consideration for said lease was the sum ~ one
($t.00) Dollar, and
WHEREAS, the Town Board now desires to waive the payment of
this sum
NOW, THEREFORE, BE IT RESOLVED, that the payment of the sum of
One ($1.00)Dollar by the United States Navy Department to the
Town of Southold as rent for the leasing of property at Fort
H. G, Wright as described in a resolution a~opted by the Town
Board of the Town of Southold be and the same hereby is waived~

WHEREAS, the Griswold-Terry-Glover Post No. 803, Department of
New York - American Legion, Inc. of South61d, New York has
offered to lease a pmrtion of its premises at Southold to the
Town of Southold for public parking p%%rposes,
NOW, THEREFORE, BE IT RESOLVED: That the Town of Southold does
hereby lease from the said Griswotd-Terry-Glover Post No. 803
the following described property:
ALL that certain tract, piece or parce~ of land, situate,~ lying
and being at Southold, in the Town of outhold, County of Suffolk
and State of New York, generally bounded and described as follows:
BEGI~NING at a point formed by the intersection of the southerly
line of Tucker Lane with the easterly line of Griswold Road,
from'said point of beginning, running thence easterly along
said southerly line of Tucker Lane, a distance of 111 feet more
or less; thence southerly at right angles to said southerly line
of Tucker Lane, a distance of tl8?feet, more or less; thence
westerly at right angles to said last described course, a distance
of 115 feet, more or less, to the easterly line of said Griswold
Road; thence northerly along said easterly line of Griswold Road,
a distance of 100 feet, more or less, to the point or place of
beginning.
TOGETHER with the driveways and service drive leading from the
above described premises in a generally easterly direction to
Tucker Lane and Main Road.
BE IT FURTHER RESOLVED, that said lease~run for a te~m of five
years from the 1st day of July, 1959, and that the total rent
for the use of said premises shall be the sum of Five ($5.00)
Dollars to be paid as follows: One ($1.00) Dollar upon the
execution of the lease as hereafter provided, and the further
sumof One ($1.00) Dollar on the 1st day of July in each and
every year during the term of said lease, and
BE IT FURTHER RESOLVED: that the Supervisor of the Town of
Southold be and he hereby is authorized k~ and directed to execute
any and all leases or other documentR~to effect said purposes.

WHEREAS, a petition was heretofore filed with the Town Board
of the Town of Southold by ROBERT H. PRESTON and LaGRA~T CHAPMAN
requesting a change, modification and amendment of the building'
Zone Ordinance including the Building Zone Maps made a part
thereof by changing from "A" Residential and Agricultural District
to "B" Business District the property described in said petition, and
WHEREAS, saidpetition was duly referred to the Planning Board
for its investigation, recommendation and report, and its report
having been filed with the Town Board, and thereafter, a public
hearing in relation to said petition having been duly held
the Town Board on the 7th day of July, 1959, and due d~i~e~tion
having been had thereon
NOW, THEREFORE, BE IT RESOLVED that the relief demanded in said
petition be, and it hereby is granted.
