MEETING OF MAY 18, 1959.
The Southold Town Trustees met with the Southold Town Bc~rd, on
Monday, May 18, 1959, to discuss the Southold Town Ordinance
regulating the mooring of boats and the placing of obstructions
'in and on Town waters and public lands~ The meeting was called
to order at 7;15 P.M. with the following present: Supervisor
Klipp; Councilman Albertson; Justices Tuthill and Clark; Town
Attorney Tasker and Town Clerk Booth. Also thefOllowing members
of the Town Trustees: Emmons Dean, John McNulty, Philip Weiler,
and Frank Dawson.
Moved by Justice Clark; seconded by Justice Tuthill:
WHEREAS, the Town Board of the Town of Southold held a public
hearing at the Supervisor's Office, 16 South Street Greenport,
New York, on April 7, 1959, at 2 'o'clock P.M. on said day on
the question of the enactment of an ordinance entitled"
'~SOUTHOLD TOWN ORDINANCE REGULATING THE PLACING OF OBSTRUCTIONS
IN A~D ON TOWN WATERS AND PUBLIC LAND AND THE REMOVAL OF SAND,
GRAVEL OR OTHER MATERIALS FROM LANDS UNDER TOWN WATERS"
at which time and place all interested persons were givenj
opportunity to be heard,
WHEREAS, the Town Board of the Town of Southold deems it in the
public interest that said proposed ordinance should be enacted,
NOW, THEREFORE, BE IT RESOLVED AND ORDAINED, that the Town
Board of the Town of Southotd enact the following ordinance to wit:-
SOUTHOLD TOWN ORDINANCE REGULATING
THE PLACING OF OBSTRUCTIONS IN AND ON
TOWN WATERS AND PUBLIC LAI~DS, AND THE
REMOVAL OF SAND, GRAVEL OR OTHER
MATERIALS FROM LANDS UNDER.TOWNWATERS.
Section i. ~o person shall place any piles~ stakes, buoys, pi'ers,
docks, bulkheads or other objects in or on any Town waters or
public lands under or adjacent to Town Waters in the Town of
Southold, nor shall any person remove any sand, gravel or other
materials from lands under Town waters in the Town of Southold,
without first obtaining a permit therefor fD~m.the Board of
Trustees of the Town of Southold.
Section ~. No person shall moor, anchor or place any boat on any
public lands at the end of any Town Highway in the Town of South-
old in an area established by the Board of Trustees of the Town
of Southold as a restricted area.
Section 3. ~ne Board of Trustees of the Town of Southold is hereby
authorized and empowered.
(a) To issue reVocable permits for the placingof piles,
stakes, buoys, docks or other objects in or on any Townlwaters
or public lands under or adjacent to Town Waters, and for the
removal of sand, gravel or other materials from lands inder Town
waters, provided that the same do not obstruct or interfere with
navigation or the public use of said waters or lands.
(b) To establish and designate restricted areas at the
end of Town Highways in the Town of ~outhold where&n the mooring,
anchoring or placing of boats shall be prohibited.
(c) Te establish uniform fees for the issuance of permits
required by this ordinance.
SECTION 4. Any violation of the provisions of this ordinance
shall constitute an offinse and shall be punishable by a fine of
not more than $50.00.
SECTION 5. This ordinance shall take effect immediately.
The question of the adoption of the foregoing ordinance was duly
put to a vote which resulted as follows:

The resolution was thereupon declared duly adopted.

RESOLVED: That the Supervisor be and he tm~reby is authorized to
sign the necessary plans, and specifications for the proposed
dredging operations in Richmond Creek, together with an agreement
on behalf of the Town of Southold, assuring the County of Suffolk
sufficient easements and spoil areas in connection therewith and
also saving harmless the County of Suffolk from any claims and
damages resulting from said dredging operation.

WHEREAS, the present RECREATIONAL PROJECT with the New York State
Youth Commission will expire on June 30, 1959 and
W~EREAS, it is the desire of the Southold Town Board to apply
for a renewal of this project, Now, therefore be it
RESOLVED: That Norman E. Klipp; Supervisor, be and he hereby is,
directed to make application for a renewal of the RECREATIONAL
PROJECT for the period from July 1, 1~59 to June 30, 1~60.
