The meeting was called to order at 1:30 P.M. wit~ the following present: Supervisor Klipp; Councilmen Albertson and Demarest; Justices Tuthill and Clark; Supt. of Highways Price; Town Attorney Tasker and Town Clerk BO6th. The Board sat at once as~ a' committee on Audit to examine claims against the Town concluding the audit work at 1:50 P.M. Moved by Justice Clark; seconded b~ Councilman Albertson: RESOLVED: That the minutes of the meeting of April 21 he,and hereby are duly approved as read. Vote of Town Board: Ayes-Supervisor Klipp; Councilmen Albertson and and Demarest; Justices Tuthill and Clark. Moved by Councilman Albertson; seconded by Justice Tuthill: RESOLVED: That the regular monthly meeting of the Town Board will be held at the office of Supervisor Norman E. Klipp at Greenport, .on Tuesday, May 26, 1959, at 1:30 P.M. Vote of Town Board: Ayes-Supervisor Klipp; Councilmen Albertson and Demarest; Justices Tuthill and Clark. Moved by Councilman Albertson; seconded by Justice Clark: WHEREAS, ANNA CAIN obtaine~ a building permit, intending to purchase a house and move it on a lot on Deep Hole Drive in Mattituck, and WHEREAS, the contract to purchase said house has been cancelled, NOW, THEREFORE, BE IT RESOLVED: That Supervisor Norman E. Klipp be and he hereby is directed to return khe fee of $10.00 which accomp- amied the application. Vote of Town Board: Ayes-Supervise Klipp; Councilman Albertson; Justices Tuthill and Clar~/ Noes-Councilman Demarest. Moved b~ Justice Tuthill; seconded by Councilman Albertson: WHEREAS, GEORGE F. GRATHWOHL obtained a variance in accordance wi~h the zoning ordinance, on hi~ property in New Suffolk, and WHEREAS, ~r. Grathwohl is dedicating this property to the Town of Southold NOW, THEREFORE, BE IT RESOLVED: That Supervisor Norman E. Klipp be and he hereby is directed to return the fee of $15.00 which accomp- anied the application for a variance. Moved by Councilman Albertson; seconded by Coucnilman Demarest: WHEREAS, an application was received from ROGER F. KETCHAM, relative to changeof zone NOW, THEREFORE, BE IT RESOLVED: That the Town Clerk of the Town of Southold be and he hereby is directed to transmit this application to the Planning Board in accordance with Section 901 subdivision C of Article lX of the Building Zone Ordinance of the Town of Southold. Moved by Councilman Demarest; seconded by Councilman Albertson: WHEREAS, an application was received from EDWARD NIDDS for an Open Development Area under the prouisions of Section 280A of the Town Law, NOW, THEREFORE, BE IT RESOLVED: That the Town Clerk of the Town of Southold be and he is hereby directed to transmit this application to the Planning Board in accordance with Section 901 Subdivision C of Article lX of the Building Zone Ordinance of the Town of Scuthold. Moved by Jgstice Clark; seconded by Justice Tuthill: WHEREAS, the Southold Town Planning Board has prepared an official report and recommendation upon the petition of JOHN and ALEXANDRA DROSSOS for a change of zone from "A" Residential and Agricultural District to "B" Business District, on certain real property situate at Arshamomaque, in the Town of ~oU~hold, NOW, T~EREFORE, BE'IT RESOLVED: That a public hearing will be held by the'Southold Town Board at the Supervisor's Office in Greenport, on Tuesday, May 26, 1959, at 2:00 o'clock P.M. for a change of zone on-the aforesaid property. Vote of Town Board: Ayes-Supervisor Klipp; Councilmen Albertson and Demarest; Justices Tuthill and clark. Moved by Justice Clark; seconded by Councilman Albertson: WHEREAS, the Southold Town Planning Board~has prepared an official report and recommendation upon the petition of GENEVIEVE NAUGLES for a change of zone fr°m "A" Residential and Agricultural District to "B" Business District on certain real property situate at Mattit- uck, in the Town of Southold,N.Y. NOW, THERFORE BE IT RESOLVED: That a public hearing will be held by the Southold Town Board at the Supervisor's Office in Greenport, on Tuesday, May 26, 1959, at 2:00 o'clock P.M. for a change of zone on the aforesaid property. Moved by Councilman Demarest; seconded by Justice Tuthill: WHEREAS, it has been called to the attention of the Town Board that several violations of the Trailer Camp Ordinance exists on the Trailer Court sight of JONATHON T. OVERTON, on TerryLane, Southold, RESOLVED: That the Supervisor be and he hereby is instructed to call Mr. Overton's attention to the fact that it is required that all provisions of the ordinance be complied with, and be it further RESOLVED:' That failure to comply with the Trailer Camp Ordinance will be grounds for revocation of Mr. Overton's Trailer Camp Permit. Moved by Councilman Demarest; seconded by Justice Clark: RESOLVED: That the report of Howard M. Terry, Building Inspector, for the month of April be accepted by the TOWn Board and placed on file. Moved by Councilman Demarest; seconded by Councilman Albertson: RESOLVED: That the application of MARGARET V. COUTTS for a permit to locate a single automobile trailer on her property at Mattituck be and hereby is denied and that the fee of $5.00 which accompanied the application be returned. Vote of Town Board: Ayes-Supervisor K!ipp; Councilmen Albertson and Demarest; Justices Tuthill and Clark. Moved by Councilman Albertson; seconded by Justice Clark: RESOLVED: That Supervisor Norman E. Klipp be and he hereby is authorized to enter into a lease with PLARRISOlq M. DEMAREST, SR. for a tract of vacant land situated and being at Orient, Town of Southold, N.Y. bounded as follows: North by Narrow River Road; East by land now or formally of John Brown; South by Hallock's Bay; West by land now or formally of the Estate of George E. Edwards for use of a tow parking area and boat landing for a term commencing the first day of May, 1959, and ending April 30, ~ 1960, in the amount of $25.00 per year. Moved by Councilman Albertson; seconded by Justice Clark: RESOLVED: That One Hundred Doll~ ($100.00)be and hereby is allocated to commemorate the New York State year of History. Moved by Justice Tuthill; seconded by Justice Clark: RESOLVED: That the Town spend a sum no= to exceed $700.00 from the publicity fund, which sum shallbe paid to the Southold Town Chamber~f Commerce upon the presentation of a certified voucher from the official of said Chambers of Commerce. HARRY LISTER, aB president of BOATMEN"S HARBOR, INC. applied to the Town Board for some financial assistance in dr. edging the entrance to Wickham's Creek, NOW, THEREFORE. BE IT RESOLVED: That Norman E. Klipp, Supervisor, be and he hereby is authorized to contribute a sum not to exceed $475.00 twwards the cost of dredging the entrance to Wickham's Creek at Fleet's Neck, Cutchogue, Town of Southold, N.Y. KNAPP, as President of t~W~NNEWETA POND .ASSOCIATION applied to the Town Board for some financial assistance in dredging the Wunneweta Pond Inlet, NOW, THEREFORE, BE IT RESOLVED: That Norman E. Klipp; Supervisor, be and he hereby is authorized to contribute a sum not to exceed $300.00 towards the cost of dredging the Wunneweta Pond Inlet at Nassau-Point, Cutchogue, Town of Southold,-N.Y. Vote of Town Board: Ayes-Supervis= Klipp; Councilmen Albertson and Demarest; Justices Tuthill and Clark. Moved by Councilman Albertson; seconded by Justice Clark: RESOLVED: That the report of the Auxiliary Police for the month of April be accepted by the Town Board and placed on file. Moved by Councilman Atbertson; seconded by Councilman Demarest: RESOLVED: That the Police Report for the month of April be accepted by the Town Board and placed on file. Moved by Councilman Demarest; seconded by Justice Clark; RESOLVED: That General Bills in the amount ~f $4,468.05; Lighting District Bills in the amount of $1,590.60; Fishers Island Ferry District Bills in'the amount of $9,005.84, be and the same are hereby ordered paid. Moved by Councilman Demarest; seconded by Justice Tuthill: RESOLVED: That Harold Price, Supt. of Highways, of the Town of Southold, be and he hereby is authorized to advertise for and purchase from the lowest bidder, the following: One used rubber tired wheeltype tractor 9-24, 4-ply rear tires 500 x 15, 4-ply front tires, starter and lights, built in hydraulic system power take-off, fenders, 4 speed transmission, with road speed not less than 23 miles per hour, power steering, equipped with Anderson Hydraulic driven mower especially designed for highway use with 5 feet cutter bar, or equal. At 2:00 o'clock P.M. the hearing was resumed on the application of THOMAS and OSCAR MOLIN for a change of zone fro~ "A" Resid- ential and Agricultural District to "M" Multiple Residence District. The minutes of this hearing were recordea by George T. Lederle. Moved by Councilman Albertson; seconded by Councilman Demarest: WHEREAS, a petition was heretofore filed with the Town Board of the Town of Southold by THOMAS and OSCAR MOLIN requesting a change, modification and amendment of the Building Zone Ordinance including the Building Zone Maps made a part thereof by changing from "A" Resident&&l District to "M~ Multiple Residence District the property described in said petition, and WHEREAS, said petition was dulyreferred to the Planning Board for its investigation, recommendation and report, and its report having been filed with the Town Board, and thereafter, a public hearing in relation to said petition having been duly jeld by the Town Board on the 5th day of May, 1959, and dum deliberation having been had thereon NOW, THEREFORE, BE IT RESOLVED: That the relief demanded in said petition be, and it hereby is granted. Moved by Justice Tuthill; seconded by Justice Clark: RESOLVED: That the Town Clerk be and he hereby is directed to request the Long Island Lighting Company to remove one 100 cp aerial street light,~ on pole No. 137 and install one 60 cp aerial street light on said pole in front of the Parochial School on Route 25 in the Cutchogue-Mew Suffolk Lighting District. AMENDMENT NO. 27 NOTICE IS HEREBY GIVEN that after a public hearing held pursuant to the requirements of law, the Building zone Ordinance (including the Building Zone Map) of the Town of Southold, Suffolk County, New york, was duly amended at a regular meeting of the Southold Town Board held on May 5, 1959, as follows: By changing from "A" Residential and Agricultural District to "M" Multiple Residence District the following described property: Ail that certain tract or parcel of land situate neat ~reenport in the Town of Southold, County of Suffolk and State of New York, and more particularly described as follows: BEGINNING at a point on the northerly line of North Road at the southeasterly corner of land now or formerly of Shannon; from said point of beginning running along said land now or formerly of Shannon North 570 feet more or less to the waters of Long Island Sound; thence easterly along the shore of Long~ Island Sound 200 feet more or less to land now or formerly of D. H. Horton; thence along land last mentioned South 469 feet ~ more or less to the northerly line of North Road; thence along the northerly line of North Road West 320 feet more Or less to the point or place of beginning. The Southold Town Trustees met with the Southold Town Bc~rd, on Monday, May 18, 1959, to discuss the Southold Town Ordinance regulating the mooring of boats and the placing of obstructions 'in and on Town waters and public lands~ The meeting was called to order at 7;15 P.M. with the following present: Supervisor Klipp; Councilman Albertson; Justices Tuthill and Clark; Town Attorney Tasker and Town Clerk Booth. Also the following members of the Town Trustees: Emmons Dean, John McNulty, Philip Weiler, and Frank Dawson. Moved by Justice Clark; seconded by Justice Tuthill: WHEREAS, the Town Board of the Town of Southold held a public hearing at the Supervisor's Office, 16 South Street Greenport, New York, on April 7, 1959, at 2 'o'clock P.M. on said day on the question of the enactment of an ordinance entitled" "SOUTHOI~ TOWN ORDINANCE REGULATING THE PLACING OF OBSTRUCTIONS IN A~D ON TOWN WATERS AND PUBLIC LAND AND THE REMOVAL OF SAND, GRAVEL OR OTHER MATERIALS FROM LANDS UNDER TOWN WATERS" at which time and place all interested persons were given5 opportunity to be heard, WHEREAS, the Town Board of the Town of Southold deems it in the public interest that said proposed ordinance should be enacted, NOW, THEREFORE, BE IT RESOLVED AND ORDAINED, that the Town Board of the Town of Southotd enact the following ordinance to wit:- SOUTHOT~ TOWN ORDINANCE REGULATING THE PLACING OF OBSTRUCTIONS IN AND ON TOWN WATERS AND PUBLIC LANDS, AND THE REMOVAL OF SAND, GRAVEL OR OTHER MATERIALS FROM LANDS UNDER.TOWNWATERS. Section 1. ~o person shall place any piles~ stakes, buoys, piers, docks, bulkheads or other objects in or on any Town waters or public lands under or adjacent to Town Waters in the Town of Southold, nor shall any person remove any sand, gravel or other materials from lands under Town ~waters in the Town of Southold, without first obtaining a permit therefor fD~m.the Board of Trustees of the Town of Southold. Section 2. No person shall moor, anchor or place any boat on any public lands at the end of any Town Highway in the Town of South- old in an area established by the Board of Trustees of the Town of Southold as a restricted area.
