Klipp at Greenport, on Tuesday, April 7, 1959, The meeting was called to order at 1:30 P.M. with the following present: Supervisor Klipp; Councilmen Albertson and Demarest; 'Justices Tuthill a~d Clark; Supt. of Highwa~ Price; Town Attorney Tasker and Town Clerk Booth. The Board sat at once as a committee on audit to examine .claims against the Town, concluding'the audit work at 1:50 P.M. ~- Moved by Justice Clark; seconded by Councilman Demarest: RESOLVED: That the minutes of 'the meeting of March 24th be and hereby are duly approved as read. ~ Vote of Town Board: Ayes-Supervisor Klipp; Councilmen Albertson and DemarSst; JUstices Tuthitl a~d Clark. Moved by Justice Tuthill; seconded by Justice Clark: RESOLVED: That the regular monthly meeting 6~ this Board will be held at the office Of Supervisor Norman E. Klipp at Greenport, on Tuesday, April 21, 1959, at 1:30 P.M. Vote of Town Board: Ayes-Supervisor~Klipp; Councilmen Albertson and Demarest; Justices Tuthill and Clark. Moved by Justice Tuthill; seconded by Councilman Demarest: WHEREAS, an application was received from JOHN and ALEXANDRA DROSSOS, relative to change of zone, NOW, THEREFORE, BE IT RESOLVED: That the ~own Clerk of the Town 6f Southold be and he hereby is directed to transmit this application to the Planning Board in accordance with Section 901, Subdivision C of Article lX of the Building Zone Ordinance of the Town of Southold. Vote of Town Board: Ayes-Supervisor Klipp; Councilmen Albertson and Demarest; Justices Tuthill and Clark. Moved by Councilman Albertson; seconded by Councilman Demarest: RESOLVRD: That the report of RALPH P. COX, Dog Warden, from the 16th of March, through the 31st of MArch be accepted by the Town Board and placed on file. Vote of Town Board: Ayes-Supervisor Klipp; Councilmen Albertson and Demarest; Justices Tuthill and Clark. Moved by Councilman Albertson; Seconded by Councilman Demarest: RESOLVED: That the ~Town Clerk be and he hereby is directed to request the Long Island Lighting Company 2o remove sixteen (16) street lights and install 30-400 W.M.V.O.H. aerial street lights in the Southold Lighting District as per the survey of March 25, 1959. Vote of Town Board: Ayes-Supervisor Klipp; Councilmen Albertson; and Demarest; Justices Tuthill and Clark. Moved by Justice Tuthilll seconded by Justice Clark: RESOLVED: That the Town Clerk be and he hereby is directed to request the Long Island Lighting Company to remove sixteen (16) street lights ~nd install nineteen (19) 400 W.M.V.O.H. aerial street ligh~ in the Mattituck No. 1 Lighting District as per survey of April 1, 1959. Vote of Town Board: Ayes-Supervisor Klipp; Councilmen Albertson and Demarest; Justices Tuthill and Clark. Moved by Justice Clark; seconded by Justice Tuthill: RESOLVED: That General Bills in the amount of $9,945.55; Light- ing District 'Bills in the amount of $1,696.62; Fishers Island Ferry.District Bills in the amount of $8,287.21 be and the the same are hereby ordered paid. Vote of Town Board: Ayes-Supervisor Klipp; ~ouncilmen Albertson and Demarest; Justices Tuthilt ~d Clark. Mo~ed~by councilman Albertson; seconded by Justice Clark: RESOLVED: That Supervisor Norman E. Klipp be authorized to purchase one used pickup truck, not to exceed the sum of $900.00 for the use of the Dog Warden. Vote of. Town Board: Ayes-Supervisor Klipp; Councilmen Albertson and Demarest; Justices Tuthill and Clark. Moved by Councilman Albertson; seconded by Justice Clark: WHEREAS, the two-year term of CHARLES GRIGONIS of Southotd as member of the Board of Appeals expires on April 22, 1959, and WHEREAS, in the past, as a member of the Board of Appeals, Charles Grigonis has rendered the Town a most valuable service, now therefore be it RESOLVED: That CHARLES GRIGONIS be and hereby is appointed as a member of the Southold Town Board of Appeals for a term of five years, commencing April 23, 1959, and ending on April 22, 1964. Vote of Town Board: Ayes-Supervisor Klipp; Councilmen Albertson and Demarest; Justices Tuthill and Clark. Moved by Justice Clark; seconded by Councilman Albertson; RESOLVED: That the report of HOWARD M. TERRY, Building Inspector, for the month of March be accepted by the Town Board and placed on file. Vote of Town Board: Ayes-Supervior Klipp; Councilmen Albertson and Demarest; Justices Tuthill and Clark. Moved by Councilman Albertson; seconded by Justice Clark: RESOLVED: That the Police Report for~ the month of March be accepted by the Town Board and placed on file. The public hearing in the matter of the adoption~an ordinance regulating the mooring of boats and the placing of obstructions in and on Town waters and public lands was opened by the Supervisor at 2:00 P.M. The minutes of this hearing were recorded by George T. Lederle. j ~ Moved by Justice Henry A. Clark; seconded by Councilma~ Louis M. Demarest: BE IT RESOLVED: that the Supervisor be and he is hereby authorized to sign an agreement on behalf of the Town of Southold for the% proposed second extension of the dredging operations in Sterling Basin, Greenport, Town of $outhold, assuring the County of Suffolk sufficient easements and spoil areas in connection therewith and also saving harmless the County of Suffolk from any claims and damages resulting from said dredging operations. Vote of Town Board: Ayes-Supervisor Klipp; Councilmen Albertson and Demarest; Justices Tuthill and Clark. Moved by Justice Clark; seconded by Councilman Demarest: WHEREAS, the Town Board of the Town of Southold by resolution duly adopted on the 7th day of September, 1954, authorized the ,acquisition from the United States Government of an airport or landing field known as "Elizabeth Field" and appurtenances at Fishers Island in the Town of Southold, Suffolk County, New York, and WHEREAS, the Town of Southold thereafter duly made application to the General Services Administration of the United States Govern- ment for the acquisition of aaid prppertyby application dated September 9, 1954, which said application was thereafter amended and revised by a further resolution of the Town Board of the Town of Southold duly adopted on the 9th day of December, 1958, and WHEREAS, by the terms of~said application as amended and reVised, the Town of Southold is required to-furnish to the.General~Services Administration, appropriate evidence in the form of a license, permit or other agreement, authorizing the Department ~f Navy to'use Ba Battery Station 215 (F-l) and.IA), together with the right of' access thereto ober existing roads, and the right to maintain, operate, repair, replace or remove a cable right-of-way, NOW, THEREFORE, BE IT RESOLVED: that the Town of Southold does -hereby agree to lease to the United States Department of Navy, certain property located in the Fort Wright area on Fishers~I~iand, New York, j known and designated as Battery Station 215, which Battery ~tation is described as follows: BEGINNING at an iron pipe marker which is North 61 degrees 21 minutes West a distance of 199.7 feet from the Coast and Geod- etic marker "Battery 215, 1943", located in the Southwest corner of Fishers Island, New York; thence North 76 degrees 35 minutes East a distance of 273.3 feet to an iron pipe ~marker, which is 4.6 feetnortheasterly from a manhold; thence South 13 degrees 25 minutes East; a distance of 287 feet, more or less, to the mean low water tin~ of the South shore of Fishers Island; thence meandering along said shore line in a southwesterly direction a distance of 282 feet, more or less, thence North 13 degrees 25 minutes West a distance of 261.5 feet, more or tess, to the point of geginning; all bearings being magnetic and the parcel contain- ing a calculated area of 2.035 acres. Said parcel being generally bounded on the North, East and West hyland now or formerly of' the United States Government, and bounded on the South by the waters of Block Island Sound. Together with the right of access thereto over existing roads and the right to maintain, operate, repair, replace or remove a cable right-of-wa~ as shown on Proper- ty Survey, Battery 215, dated October 24, 1955, and Y & D Drawing No. 768151 dated January 31, 1957, for a term of Ninety-nine (99) years, at a total rent of One ($1.00) Dollar for said term, to commence on the date that title to said premises is acquired by the Town of Southold. Said lease to provide that no poles, masts or other structures of any type shall be erected on Battery 215 without prior apProval of the Civil Aeronautics Administration. BE IT FURTHER RESOLVED, that the Southold Town Supervisor be~ and he hereby is authorized and directed to execute any and all leases and other documents required to effect such purpose. Moved by councilman Atbertson; seconded by Councilman Demarest: BUDGET NOTE RESOLUTION DATED APRIL 7, 1959, AUTHORIZING THE ISSUANCE OF A BUDGET NOTE OF THE TOWN OF SOUTHOLD, SUFFOLK COUNTY, NEW YORK, IN THE AMOUNT OF $5,000.00 FOR HOME RELIEF. BE IT RESOLVED this 7th day of April, 1959, by the Town Board of the Town of Southold, Suffolk County, New York, as follows: 155 Section 1. That, pursuant to the provisions of Subdivision 2 of ~Pa~agraph a 'and Paragraph e of Section 29, and Section 108 pf the Local Finance Law, Section 93 of the. Social Welfare Law and Section 114 of the Town Law, for the purpose of paying the cost of home relief expenditures for which insufficient pro- vision was rode in the annual budget for the year 1959, there is hereby appropriated as a supplemental appropriation for home relief, the sum of $5,000.00, and there ~s hereby authorized to be issued, a budget note of t_he Town of outhold in the principal amount of $5~000.00 which is the maximum-cost of such object or purpose, whik~h note shall mature on April 7, 1960. Section 2. That, subject to the provisions of the Local Finance Law, the power to sell said budget note is hereby delegated to the Supervisor, the ~hief fiscal officer. Such note shall be of such terms, form and content, and shall be sold in such manner, as may be prescribed by said Supervisor, consistant, however, with the proviSions of said Local Finance Law of the State of New York, and shall be executed in the name of the Town of Southold by its Supervisor and seal of said Town shall be attached thereto. Section 3. That said note shall be sold at private sale by the Town Supervisor at a price of not less than par value and accrued interest, if any, and upon due execution and sale of aaid note, the ~ame shall be delivered to the purchaser upon payment by him tothe Town Supervisor oft~he purchase price in cash; and the receipt of such Supervisor shall be a full acq~ittance to such purchaser who shall not be obliged to see to the application of the purchase money. Section 4. The full faith and credit of the Town of Southold New York are pledged to %he punctual payment of principal and interest on said note. Section 5.
