ROBINSON, TRUSTEE, has made application to the Town Board for the establishment of an OPEN DEVELOPMENT AREA pursuant to the provisions of Section 280-A'of the Town Law, and WHEREAS, THE TownBoard has heretofore referred the 'matter to the Planning Board for its advice and recommendation, and WHEREAS, the Planning Board has recommended that the application of N. S. ROBINSON, TRUSTEE be granted, NOW, THEREF©RE, BE IT RESOLVED: That the Town Board of the Town of Southold does hereby establish an OPEN DEVELOPMENT AREA over the property of N.S. ROBINSON, TRUSTEE as shown~forth on the map attached to the application. Adjournment was at 6:15 P.M. Ralph P. Booth TQwn Clerk 147 M~ETING 0F MARCH 20, 1959 A special meeting of the Southold Town Board was held at the office'of Supervisor Norman E. Klipp at Breenport, on Friday, March 20, 1959. The meeting was called to order at 7:30 P.M. with the following present: Supervisor Klipp; Councilmen Albertson and Demarest; Justices Tuthill and Clark; Town Attorney Tasker and Town Clerk Booth. Moved by Councilman Albertson; seconded by Justice' Clark: WHEREAS, an application was made t6 the Southold Town Board under date of December 30, 1958 by Bessie Lee Hodges for permission to establish a Tourist Court (Camp Cottages) on her property on SeventhStreet, Greenport, Town of Southold, N.Y. and WHEREAS, it is required by the Southold Town Ordinance providing for the regulation'of Tourists Camps, house trailersCamps, house trailers or similar establishments, that a public hearing be held on the matter, and WHEREAS, a public hearing was held at Village Hall in Greenport, om'Tuesday, January 20, 1959, at 2 o'clock P.M. and all persons attending such public hearing given ample opportunity to speak in favor of or in opposition to the application, the hearing was duly closed at 3:30 P.M. and the application was held for further deliberation of the Town Board. WHEREAS, all requirements have been complied with in accordance with the Ordinance, NOW, THEREFORE, BE IT RESOLVED: the the Town Board of the Town of Southold does hereby grant permission to Bessie Lee Hodges to establish and operate a Tourist Court (Camp Cottages) on the ~b0ve mentioned site. Vote of Town Board: ayes-Supervisor Klipp; Coucnilmen Albertson and Demarest~ Justices Tuthill and Clark. Moved by JuStice Clark; seconded by Justice Tuthill: W~EREAS, JAMES and ALICE DeVIRES has applied t~the Town Board for a single automobile trailer permit, k NOW, THEREFORE, BE IT RESOLVED, that the application of JAMES ~nd ALICE DeVIRES to locate a single automobile trailer on their property at DeDp Hole Drive, a~ Mattituck, N.Y. be and hereby is granted, vbte of Town Board: Ayes-Supervisor Klipp; Coucnilman Albertson; Justices ~uthill and Clark Noes-Councilman Demarest. Moved by Coucnilman Atbertson~ seconded by Justice Tuthill: RESOLVED: That the Supervisor be and he is hereby authorized to sign an agreement on behalf of the Town of Southold for the proposed extension ~f the dredg~Bg operations in Sterling Basin, Greenport, Town of outhold, assuring the County of Suffolk sufficient easement~ and spoil areas in connection therewith and also saving harmless the County of Suffolk fDom any claims~ and damages resultSng from said dredging operations, Vote of Town Board Ayes-Supervisor Klipp; Councilmen'Albertson and Demarest; Justices Tuthill and Clark. Moved by CoQncilman Albertson; seconded by Justice Tuthill: WHEREAS, appublic hearing was held by the Town Board of the Town of Southold on August 12, 1958, in the matter of the adoption of an ordinance entitled "Southold Town Ordinance regulating the mooring of boats and the placing-of obstructions in and on town waters and public land", and WHEREAS, certain changes and modifications were suggeB~ed by persons attending said hearing, and WHEREAS, the Town Board and the Town Trustees of theTown of Southold at several meetings gave further study to the various provisions of said prop~s~dnerdinances, and WHEREAS, it is the determination of the Town BOard that certain provisions of said proposed ordinance shoUld be changed and that a public hearing should be held on the question of the adoption of s&id ordinance, as amended, NOW, THEREFORE, BE IT RESOLVED: that a public hearing be held by the Town Boa~of the own of Southold at the Supervisor's Office 16 South Street Greenport] New York in said town, on the 7th~- day Df April. 1959, at 2:00 o'clock P.M. of said day ~pon the question of the adoption of the following ordinance, to wit:- SOUTHOLD .TOWN ORDINANCE REGULATING THE PLACING OF OBSTRUCTIONS IN AND ON TOWN WATERS AND ~UBLIC LANDS, AND T~E REMOVAL OF SAND, GRAVEL OR OTHER MATERIALS FROM LANDS UNDER TOWN WATERS SeCtion 1. No person shall place any pile~, stakes, buoys, pie~ docks, bulkheads or other objects in or on any Town waters or public lands under or adjacent to Town waters in the Town of Southold, nor shall any person remove any sand, gravel or other materials from lands under Town waters in the Town of Southo~d, without first obtaining a permit therefor from the Board of Trustees of the Town of Southold. Section 2. No person shall moor, anchor or palce any boat on any p~blic lands at the end of any. Town Highway in the Town of Southold in an area established by the Board of Trustees o~the Town of Southold as a restricted area. Section 3. The Board of Trustees of the Town of Southold is hereby authorized and empowered. (a) To issue revocable permits for the placing of piles, stakes, buoys, docks or other objects in or en any Town waters 'or public oands under or adjacent ~o Town waters, and for the removal of sand, gravel or ~ther materials from lands under Town waters, provided that ~he same do not obstruct or inte~ere with navigation or the public use of said waters .or lands. ~.~ (b) To establish and designate restricted areas at the end of~ Town Highways in the Town of Southold whrerin the mooring, anchor- ing or placing of boats shall be prohibited. (c) To establish uniform fees for'the issuance of permits required by this ordinance. 149 Section 4. Any violation of the provisions of this ordinance shall constitute an offense and shall'be punishable by a fine of not more than $'50.00. Section 5. This ordinance shall take effect immediately. BEIT'~FURTHER RESOLVED: That the Town C~erk cause a notice of said hearing specifying the time when and the p&ace where Such hearing will be held and containing a copy of the proposed ordinance to be published in the Suffolk Times, the official newspaper of said Town to be published onee at least 10 days prior to the day specified for such hearing. ~0~e of Town Board: Ayes-Supervisor Klipp; Councilmen Albertson and Demarest; Justices Tuthill and Clark. Moved by Councilman Albertson; seconded by Justice aTuthill: WHEREAS, the Town Board of the Town of Southold on the 28th day of July, 1958, duly adopted an ordinance entitled "An Ordinance Permitting Bingo in the Town of Southold, SUffolk County, New York"., after a public hearing duly held and ~EREAS, Section 478 of the General Municipal Law provides that such ordinance shall not become effective until it shall have been approved by a majority of the qualified electors of the Town voting on a proposition therefor submitted at a general or special election held within said Town, NOW, THEREFORE, BE IT RESOLVED that a special election be held in said Town on the 14th day of April. i959, with the polls to be open between the hours of 2 o'clock P.M. and 8 o'clock P.M.E.S.T.; that the voting place at which the qualified voters of Election District No.1 in said Town shall voee shall be the Fishers Island FirehoUse, Fishers Island, New York, and the voting place at which ~the qualified voters of all other election districts ~n said town shall~vote shall be the Town Clerk's Office, Main Road, Southold, Suffolk County, New York; that such election shall be for the purpose of voting upon the following proposition, to wit: Shall Bingo be permitted within the territorial limits of the Town.of Southotd, in accordance with the provisions of Article 1, Section 9, of the Constitution of the State of New York as amended; the provisions of Article t4-G of the General Municipal Law, Article 19-B of the Executive Law, the Rules and Regulations of the State ~ottery ContrOl Commission and in accordance with the provisions of an Ordinance duly adopted by the Town Board on the 28th day of July, 1958, entitled "An Ordinance Permitting Bingo in the Town of Southold, Suffolk County, New York". BE IT FURTHER RESOLVED: that the Town Clerk cause a notice of said special election, specifying the time when and the place where such election will be held, the hours during which the p~lls will remain open and setting forth in full the proposition to be voted upon to be published in The Suffolk Times, the official newspaper of said Town in the issue thereof to be published on or about the 27th day of March, 1959, and that the Town Clerk cause copies of such to he posted in five conspicuous places in said Town at least 10 days prior to suc~ election. The question of the adoption of the foregoing resolution was duly put to a vote on roll call, which resulted as follows: Ayes-Supervisor Klipp; Councilmen Albertso~ and Demarest; Justice ~uthill and Justice ~n~ Clark.
