Klipp at Greenport, on Monday, February 2, 1959. The meeting was called to order at 1:30 P.M' with the following present: Supervisor Klipp; councilmen Albertson and Demarest; Justices Tuthill and Clark;~own Attorney Tasker and Town Clerk Booth. The following re~olution was offered by Councilman Albertson; seconded by Councilman Demarest, and on roll call was unan- imously adopted. DEFERRED PAYMENT NOTE RESOLUTION DATED FEBRUARY 2, 1959 A RESOLUTION AUTHORIZING THE PURCHASE OF REAL ESTATE IN THE TOWN OF SOUTHOLD, SUFFOLK COUNTY, NEW YORK, TO BE USED FOR PUBLIC BATHING BEACH AND RECREATIONAL AREAS FOR SAID TOWN AT A MAXIMUM ESTIMATED COST OF $20,000., AND AUTHORIZING 'THE ISSUANCE OF A $20,000 DEFERRED PAYMENT NOTE OF SAID TOWN TO PAY THE COST THEREOF. BE IT RESOLVED, by the Town Board of the Town of S0uthold, Suffolk County, New York~ as follows: Section 1. The Town Board of the Town of Southold, Suffolk County, New York, is hereby authorized to purchase real estate to be used for public bathing and recreational areas in and for s&id Town at an estimated maximum cost of $20,000., of which the sum of $8,000. is the maximum estimated cost of the land hereinafter described as Parcel 1, and the sum of $12,000. is the maximum estimated cost of the land hereinafter.described as Parcel 2. Said parcels of real estate being generally described as follows: PARCEL 1: ALL that tract or parcel of land situate~~ lying and being ~'ar the Village of Greenport, in the ToWn of Southold, County of 'Surf= olk and State of New York, and bounded and described as follows:-' BEGINNING at a point on the northerly line of Manhanset Avenue, 8.77.18 feet easterly along said northerly line from Angler's ROad;~ said point of beginning being the intersection of the center line of Gull Pond Inlet with said northerly line and being also the south- easterly corner of land now or formerly of'Schaub; from said point, of beginning running northeasterly along said center li~e of Gull Pond Inlet, being a~ong said land now or fOrmerly of-- Schaub and along land now or formerly of Mastrosimone, about - 500 feet to a point North 24 degrees 21 minutes"50 seconds East 475.06 feet from said paint of beginning; thence through said Gull Pond Inlet and along land now or formerly of Charles Corn- ibert South 62 degrees 41 minutes East 30.0 feet; thence still along land now or formerly of Cornibert, South 53 ~degrees 35 minutes East 233.0 feet to ordinary high water mark of Gardiner's Bay; thence a~ong said-high Water mark, South 19 degrees 57 minutes 30 seconds West 314.99 feet to Said northerly line of Manha~set Avenue; thence along said northerly line of Manhanset Avenue, North 87 degrees 05 minutes West 303.0 feet to the point of beginning. Containing about two and one--half acres of beach and meadow. PARCEL 11. ALL that tract or parcel of land situate, lying and being at Southold, in the Town of Southold, County of Suffolk, and State of New York and bounded ~nddescribed asfollows: BEGINNING at a point on the northerly line of North Parish Drive, 72.0 feet easterly along said-northerly line from ~he easterly line of North Road to Bayview; from said point of beginning running along land now or formerly of F. Harold ~Sayre, two co~ses as follows: (1) North 14 degrees 05 minutes 10 seconds East 178171 feet; thence (2) North 82-degrees 30 minutes 20 seconds West 160.13 feet to said easterly line of North Road 'to Bayview; thence along said easterly line, North 14 degrees 25 minutes 20 seconds West 53.35 feet to the northerly line of said North Road to Bayview; thence along said northerly line, two courses, as follows: (1) North 82 degrees 30 minutes 20 seconds West 272~61 feet to a monument; thence (2~ North 79 degrees 35 minutes 20 seconds West 15 feet, more or less, to ordinary high water mark of Goose Creek;-thence northerly along'said high water mark, 150 feet, more or less~ to ordinary high water mark of Peconic Bay; thence easterly along said highwater mark of Peconic Bay, 500 feet, more or less, thence along other land now or formerly' of Harold Sayre, South 14 degrees 05 minutes 10 seconds West 330 feet, more or less~ to said northerlyline of North Parish Drive: thence along said northerly line of North Parish Drive~' North 75 degrees 54 minutes 50 seconds West 50.0 feet to the point of beginning. Section 2. The plan of financing the~aforesaid object or purpose is by the issuance of a $20,000. deferred payment note, which is hereby-' authorized to be issued Pursuant to the provisions of the Finance Law. ' Section 3. It is hereby determined that sub=division 21 (a) of paragraph a gf Section 11.00 of the Local Finance Law applies to such object or purpose, and that the period of probable usefulness thereof is thirty years. Section 4. The faith and credit of the Town of Southold, Suffolk County, New 189 York are hereby irrevocably pledged to the payment of the principal of and interest on such note and an amount sufficient to pay not less than twentyper centum (2~') of the aggregate principal amount of such note, together with the interest thereon, Shall be included in the next annual budget of s~id 3Town. Section 5. It is hereby determined that no down payment is necessary in connection with the aforesaid object or purpose. Section 6. Subject .to the provisions of the Local Finance Law, the power to-sell such deferred payment note is hereby delegated to the Supervisor, the chief fiscal officer. Such note shall be of such terms, form and contents, andshali be sold in such ~an~er, as may be prescribed by said Supervisor, consistent with the provisions of the Local.Finance Law. Section 7. The.validity of such note may be contested only if: (1) Such note is authorized for an object or purpose for which said Town of Southold is not authorized to expend money, or (2) The provisions of law which should be complied With ~at the date of publication of this resolution are not substantially complied with, and an action, suit or proceeding contesting such validity is is co~enced within twenty days after the date of such publication, or (3) SUch note iS authorized in violation of the pro- ~isions of the constitution. Section 8. This resolution which takes effect immediately, shall be published in full in the Suffolk Times, Greenport, New York, together with a notice of the Town Clerk in substantially the form provided in Section 81.00 of the Local Finance Law. The Question of the adoption of the foregoing resolution was duly put to a vote en roll call, which resulted as follows: Supervisor Norman E. Klipp ---Voting Yes Councilman Lester M.
